RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING 1984/85 AND 1985/86
DEVELOPMENT BLOCK GRANT ENTITLEMENT FUNDS SUB-
MISSIONS TO THE DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT.
WHEREAS, on June 25, 1984, the City Council of the City of
Newport Beach adopted Resolution No. 84 -59 amending the Housing
Element of the General Plan consistent with the provisions of Govern-
ment Code Sections 65580 et seq, (Roos Bill); and
WHEREAS, the City of Newport Beach is making a good faith
effort to implement the policies and programs contained in the General
Plan Housing Element; and
WHEREAS, it is the City's desire to benefit low and moderate
income households; and
WHEREAS, the City is eligible for $499,000 in 1984/85
entitlement funds and $506,000 in 1985/86 entitlement funds which can
be used for land acquisition as set forth in the attached Statement of
Community Development Objectives; and
WHEREAS, the City has published the two "Proposed Statements
of Community Development Objectives and Proposed Use of Funds ", and
made it available to the general public; and
WHEREAS, in the Final Statements the City will consider any
public comments or views which have been received either in writing or
at the public hearing.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council
of the City of Newport Beach that the 1984/85 and 1985/86 Community
Development Block Grant Submissions are hereby authorized.
BE IT, FURTHER RESOLVED that the City Manager is hereby
identified as the official representative of the Grantee to submit the
Final Statements, all understandings and assurances contained therein,
and such additional information as may be required.

SECTION IV - REMARKS
The City of Newport Beach's 1984 -85 Community Development Block Grant
• program funds will be used for land acquisition for the private
development of rental housing affordable to low and moderate income
households, financial assistance to the Orange Coast Interfaith
Shelter in Costa Mesa, California, to provide temporary shelter for
the homeless and needy, for fair housing activities, and for program
administration. One potential housing site has been identified and is
shown on the map which is a part of the attached Statement of
Community Development Objectives and Projected Use of Funds.

CERTIFICATIONS
The City of Newport Beach certifies that:
(a) It possesses legal authority to make a grant submission and
to execute a community development and housing program;
(b) The City Council has duly passed as an official act a Resolution
authorizing the City Manager to act as the official representa-
tive of the City and to submit the final statement and all
understandings and assurances contained therein, and directing
• and authorizing the City Manager to act in connection with the
submission of the final statement and to provide such additional
information as may be required;
(c) Prior to submission of its final statement to HUD, the City
has:
(1) met the citizen participation requirements of
S 570.301(a) (2) and has provided citizens with:
(A) the estimate of the amount of CDBG funds proposed
to be used for activities that will benefit
persons of low and moderate income; and
(B) its plan for minimizing displacement of persons as
a result of activities assisted with CDBG funds
and to assist persons actually displaced as a
result of such activities;
(2) prepared its final statement of community development
objectives and projected use of funds in accordance
with S 570.301(a) (3) and made the final statement
available to the public;
(d) The grant will be conducted and administered in compliance
with:
(1) Title VI of the Civil bights Act of 1964 (Pub. L.
88 -352; 42 U.S.C. 2000d et sec.); and
(2) Title VIII of the Civil Rights Act of 1968 (Pub. L.
90 -284; 42 U.S.C. 3601 et secs..);
(e) It will affirmatively further fair housing;
(f) It has developed its final statement of projected use of funds so
as to give maximum feasible priority to activities which benefit
low and moderate income families or aid in the prevention or
elimination of slums or blight; except that the aggregate use of
CDBG funds received under Section 106 of the Act and, if applica-
ble, under Section 108 of the Act, during 1985/86 (a period
specified by the grantee consisting of 1 program year) , shall
principally benefit persons of low and moderate income in a
manner that ensures that not less than 51 percent of such funds
are used for activities that benefit such persons during such
period;
(g) It has developed a community development plan, for the period
specified in paragraph (f) above, that identifies community
development and housing needs and specifies both short and
long -term community development objectives that have been devel-
oped in accordance with the primary objective and requirements of
the Act;
(h) It is following a current housing assistance plan which has been
approved by HUD pursuant to 5 570.306;
• (i) It will not attempt to recover any capital costs of public
improvements assisted in whole or in part with funds provided
under Section 106 of the Act or with amounts resulting from a
guarantee under Section 108 of the Act by assessing any amount
against properties owned and occupied by persons of low and
moderate income, including any fee charged or assessment made as
a condition of obtaining access to such public improvements,
unless: (1) funds received under Section 106 of the act are used
to pay the proportion of such fee or assessment that relates to
the capital costs of such public improvements that are financed
from revenue sources other than under Title I the Act; or (2) for
purposes of assessing any amount against properties owned and
occupied by persons of low and moderate income who are not
persons of low income, the grantee certifies to the Secretary
that it lacks sufficient funds received under Section 106 of the
Act to comply with the requirements of subparagraph (1); and
(j) It will comply with the other provisions of the Act and with
other applicable laws.

STATEMENT OF COMMUNITY DEVELOPMENT OBJECTIVES
AND PROJECTED USE OF FUNDS
1984 -85 PROGRAM YEAR
• GOAL: To carry out the primary objective of Title I of the Housing
and Community Development Act of 1974, as amended, to
develop a viable urban community by providing decent housing
and suitable living environment and expanding economic
opportunities, principally for persons of low and moderate
income.
OBJECTIVES:
1. To expand the supply of rental housing affordable to low and
moderate income persons in the community.
2. To provide financial assistance for a facility operated by the
Orange Coast Interfaith Shelter to provide shelter for the
homeless and needy.
3. To implement programs needed to affirmatively further fair
housing

A. LAND ACQUISITION FOR AFFORDABLE HOUSING
• PROGRAM DESCRIPTION: Funds to acquire land to provide one
or more sites for rental housing affordable to low and
moderate income households
• ESTIMATED BUDGET: $ 402,400
• LOCATION: There is currently one vacant site that may be
suitable for acquisition, in whole or in part, by the City
for affordable housing development. This site is located
westerly of Placentia Avenue on Fifteenth Street in the
northwest area of this city. Other potential sites will be
considered in response to proposals from developers and /or
property owners.
o BENEFIT: Low and moderate income households.
o OBJECTIVE ADDRESSED: #1
B. FINANCIAL ASSISTANCE FOR THE ORANGE COAST INTERFAITH SHELTER
• PROGRAM DESCRIPTION: Funds to provide financial assistance
for a facility operated by the Orange Coast Interfaith

DESCRIPTION AND ASSESSMENT OF THE USE OF
FISCAL YEAR 1982 -83 AND 1983 -84 CDBG PROGRAM FUNDS
DESCRIPTION
is The City of Newport Beach received a $496,000 allocation of Community
Development Block Grant funds for the 1982 -83 program year and budget-
ed all of those monies for the design and implementation of a residen-
tial rehabilitation loan program. The 1983 -84 CDBG grant of $518,000
was designated for a land acquisition program to provide a site for a
rental housing development affordable to low and moderate income
families. The 1982 grant program was subsequently amended to permit
the utilization of those funds for land acquisition, as well. The
City has further supplemented the acquisition fund with the addition
of its $199,000 Jobs Bill grant.
Of the $1,014,000 CDBG entitlement funds and $199,000 of Jobs Bill
funds available to the City, $1,000,000 is being used to acquire an
interest in a 5.7± acre parcel of land at the North Ford site (see
map) to provide 50 rental units which will be affordable to low and
moderate income households. Tentative tract maps have been approved
for the development and grading permits have been issued for the site.
Construction is scheduled to begin in 1985 with completion in 1986 and
occupancy by 1987. The $1,000,000 of CDBG funding is scheduled to be
drawn down and spent in 1985.
The City has also utilized a small percentage of the combined funds
for program administration. Approximately $10,000 of indirect costs
have been incurred to date by staff administering the programs. In
addition, a consulting firm was hired in January 1985 to assist with
the administration and implementation of the CDBG program at an annual
cost of approximately $31,600. The administration of the City's Fair
Housing Program is estimated to cost $5;000 per year.
ASSESSMENT
The 50 low /moderate income rental units which will be built are in
compliance with the adopted Statements of Community Development
Objectives and, Projected Use of Funds for the past two program years
and exceed the City's 1982 -85 Housing Assistance Plan goal of provid-
ing 45 new lower income units. The City's use of its CDBG funds to
provide land for rental housing developments affordable to low and
moderate income families clearly complies with the Congressional
program goal of giving maximum feasible priority to activities which
benefit low and moderate income families or aid in the prevention or
elimination of slums or blight.

(h) It is following a current housing assistance plan which has been

W It will not attempt to recover any capital costs of public
improvements assisted in whole or in part with funds provided
under Section 106 of the Act or with amounts resulting from a
guarantee under Section 108 of the Act by assessing any amount
against properties owned and occupied by persons of low and
moderate income, including any fee charged or.assessment made as
a condition of obtaining access to such public improvements,
unless: (1) funds received under Section 106 of the act are used
to pay the proportion of such fee or assessment that relates to
the capital costs of such public improvements that are financed
from revenue sources other than under Title I the Act; or (2) for
purposes of assessing any amount against properties owned and
occupied by persons of low and moderate income who are not
persons of low income, the grantee certifies to the Secretary
that it lacks sufficient funds received under Section 106 of the
Act to comply with the requirements of subparagraph (1); and
(j) It will comply with the other provisions of the Act and with
other applicable laws.

DESCRIPTION AND ASSESSMENT OF THE USE OF
FISCAL YEAR 1984 -85 CDBG PROGRAM FUNDS
DESCRIPTION
The City of Newport Beach received a $496,000 allocation of Community
Development Block Grant funds for the 1982 -83 program year and budget-
ed all of those monies for the design and implementation of a residen-
tial rehabilitation loan program. The 1983 -84 CDBG grant of $518,000
was designated for a land acquisition program to provide a site for a
rental housing development affordable to low and moderate income
families. The 1982 grant program was subsequently amended to permit
the utilization of those funds for land acquisition, as well. The
City has further supplemented the acquisition fund with the addition
of its $199,000 Jobs Bill grant.
Of the $1,014,000 CDBG entitlement funds and $199,000 of Jobs Bill
funds available to the City, $1,000,000 is being used to acquire an
interest in a 5.7± acre parcel of land at the North Ford site (see
map) to provide 50 rental units which will be affordable to low and
moderate income households. Approximately $10,000 of indirect costs
have been incurred to date in administering the program. Tentative
tract maps have been approved for the development and grading permits
have been issued for the site. Construction is scheduled to begin in
1985 with completion in 1986 and occupancy by 1987. The $1,010,000 of
CDBG funding is scheduled to be drawn down and spent in 1985.
The City's 1984 -85 grant of $499,000, processed concurrently with the
1985 -86 grant submission, will be used in conjunction with its
on -going land acquisition program. Approximately $203,000 remaining
from previous years' CDBG grants plus the $499,000 received for
1984 -85 will be added to the 1985 -86 grant of $506,000. The City
intends to utilize a small percentage of the combined funds for
program administration. In each of the next two program years, as in
previous years, approximately $10,000 in indirect costs, $31,600 in
consultant fees, and $5,000 for fair-housing programs is budgeted.
Over the 1984/85 and 1985/86 program years this represents approxi-
mately $103,200 in costs to administer the various programs. There-
fore, approximately $1,114,800 in combined program year funds are
available to be used for purposes of acquiring land to provide one or
more sites for the development of rental housing affordable to low and
moderate income families. A potential site has been identified and is
also shown on the attached map. The City also intends to provide the
Orange Coast Interfaith Shelter, located at 1963 Wallace Avenue, Costa
Mesa, with $50,000 of 1984 -85 grant funds to provide temporary shelter
for the homeless and needy.
ASSF.SSMRNT
Lard acquisition for housing development complies with the community
development objectives identified in previous Statements and complies
with the low and moderate income benefit objective of the CDBG pro-
gram. In addition, the Orange Coast Interfaith Shelter also provides
temporary housing assistance to the homeless and needy.
