RESOLUTION NO. 86 -17
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH OPPOSING ASSEMBLY BILL 2994
AUTHORIZING THE TRANSFER OF LITIGATION
CHALLENGING CERTAIN LAND USE DECISIONS BY A
LOCAL ENTITY TO A COUNTY OTHER THAN THE ONE IN
WHICH THE LOCAL AGENCY IS SITUATED
WHEREAS, the provisions of state law currently require
litigation challenging land use decisions of public entities to
be filed and tried in the county in which the public is located;
and
WHEREAS, Assembly Bill 2994 (Costa) would change this
law by requiring the transfer of any action challenging certain
land use decisions of public entities to a county other than the
one in which the public entity is located; and
WHEREAS, Assembly Bill 2994 would substantially increase
the cost and expenses incurred by public entities in defending
their land use decisions and increase the work time lost by
public employees required to travel to other counties to testify
in such litigation; and
WHEREAS, Assembly Bill 2994 creates a dangerous
precedent, and could eventually result in laws which require all
cases challenging public entity decisions to be transferred to
counties other than the one in which they are located.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Newport Beach hereby expresses its opposition to
Assembly Bill 2994 and asks members of the State Legislature to
defeat this legislation.
