RESOLUTION NO. 87 -21
WHEREAS, the City Council of the City of Newport Beach
has adopted a resolution declaring the City's intention to
abandon and vacate a portion of the existing sewer easement
within "MacArthur Court," located at 4655 Birch Street at the
northeasterly corner of Birch Street and MacArthur Boulevard in
the Koll Center Newport Planned Community; and
WHEREAS, this vacation proceeding is conducted pursuant
to the provisions of the Public Streets, Highways and Service
Easements Vacation Law (the "Act ") found in Section 8300, et se g.
of the Streets & Highways Code of the State of California; and
WHEREAS, the City has complied with all public notice
and publication requirements of the Act prior to holding the
public hearing on the proposed abandonment on February 9, 1987;
and
WHEREAS, on February 9, 1987, the City Council held a
public hearing to hear all persons interested in, or objecting
to, the proposed vacation; and
WHEREAS, the City Council has considered all evidence
and /or testimony submitted in conjunction with the proposed
• vacation and finds, from all the evidence submitted, the portion
of the sewer easement to be vacated is unnecessary for present or
prospective public use; and

WHEREAS, the City Council of the City of Newport Beach
has adopted a resolution declaring the City's intention to
abandon and vacate a portion of the existing sewer easement
within "MacArthur Court," located at 4655 Birch Street at the

WHEREAS, the City Council has considered and reviewed
provisions of the General Plan of the City of Newport Beach and
• finds that the proposed vacation and abandonment of the easement
is consistent with all provisions of the General Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the easement to that portion of
Parcel 4 as shown on a Map Filed in Book 196, Pages 40, 41, 42
and 43 of Parcel Maps, in the Office of the Orange County
Recorder, as shown on Exhibit "A," is hereby vacated and
abandoned; and
BE IT FURTHER RESOLVED that the City Clerk shall cause a
certified copy of this Resolution of Vacation, attested by the
City Clerk, under seal, to be recorded in the Office of the
Recorder for the County of Orange.
