A RESOLUTION OF THE CITY COUNC I L OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE COUNTY
COUNSEL TO REPRESENT THE CITY IN RAILROAD TAX
CASE.
WHEREAS, Southern Pacific Transportation Co. and other
• railroad companies have filed a lawsuit against approximately
three - hundred and sixty (360) cities and counties in the State of
California to obtain a refund of property taxes for the fiscal
year 1983 to 1986; and
WHEREAS, the City of Newport Beach was served with this
lawsuit on July 8, 1987; and
WHEREAS, the County Counsel has agreed to represent the
City of Newport Beach, together with the other Orange County
cities, on the terms set forth in the attached letter from the
County Counsel; and
WHEREAS, it would be in the best interest of the City of
Newport Beach to retain the County Counsel to represent the City
in this lawsuit.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City
Council of the City of Newport Beach as follows that the County
Counsel is hereby authorized to defend the City of Newport Beach
in the case entitled Southern Pacific Transportation Co., et al.
v. Board of Equalization, et al., San Francisco Superior Court
Case No. 877359 on the terms contained in the attached letter
from the County Counsel of the Countv of Orange.
