A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH SUMMARILY VACATING THE PUBLIC
SERVICE (SEWER) AT LOT 21, BLOCK 736, CORONA
• DEL MAR TRACT
WHEREAS, the City Council of the City of Newport Beach
proposes to vacate and abandon the public service (sewer)
depicted on the drawing attached as Exhibit "A," and more fully
described as follows:
A portion of that certain sewer easement in a
deed fo the City of Newport Beach recorded in
Book 1517, Page 58 of Official Records, in the
Office of the Recorder of Orange County, State
of California, more particularly described as
follows:
A strip of land, 4.00 feet wide, over a
portion of Lot 21, Block 736, Corona del Mar
Tract, filed in Book 3, pages 41 and 42 of
Miscellaneous Maps, records of said county,
lying 2.00 feet on each side of the following
described centerline:
Commencing at a point in the southwesterly
line of said Lot 21, said point being distant
30.00 feet southeasterly from the most
westerly corner of said lot; then
northeasterly, parallel with the northwesterly
line of said lot, a distance of 7.00 feet to
the True Point of Beginning; thence
northeasterly, parallel with said
northwesterly line, a distance of 23.00 feet
to the northeasterly line of said lot.
WHEREAS, public service (sewer) easement has not been
used for the purpose for which it was dedicated or acquired for
five consecutive years immediately preceding the date of this
resolution;
WHEREAS, the summary vacation proceeding is conducted
pursuant to the provisions of the ]Public Streets, Highways and
Service Easements Vacation Law found in Section 8300, et. seq. of
the Streets & Highways Code of the State of California; and
WHEREAS, the City Council has reviewed and considered
• the provisions of the various elements of the General Plan of the
City of Newport Beach as they pertain to the location of the
easement proposed to be vacated and abandoned and finds that the
vacation and abandonment of the easement is consistent with
provisions of the General Plan and other City ordinances,
policies and rules; and
WHEREAS, the City Council finds, based upon evidence
presented to it, that the public service (sewer) easement is
unnecessary for present or prospective public use.
• NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that Lot ::1, Block 736, Corona del Mar
Tract, is hereby vacated and abandoned and no longer constitutes
a public service easement;
BE IT FURTHER RESOLVED that the City Clerk shall cause a
certified copy of the Resolution of Vacation, attested by the
Clerk, under seal, to be recorded in the Office of the Recorder
of the County of Orange.
ADOPTED this 9th day of November, 1987.
