A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE DESTRUCTION
OF CERTAIN FIRE DEPARTMENT RECORDS
• WHEREAS, California Government Code 534090 authorizes
the destruction of certain records upon the written consent of
the City Attorney, with the approval. of the legislative body; and
WHEREAS, the Fire Chief of the City of Newport Beach has
requested
the
right
to
destroy
certain
City records
that take up
space and
are
not
of
any use,
to wit:
incident
reports, fire
prevention inspections, and miscellaneous activity reports; and
WHEREAS, all such records are more than seven years old;
and
WHEREAS, the City Attorney has consented in writing, to
the destruction of these records with the exception of those
which could be evidence in any pending claim or litigation filed
against the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach, does hereby approve of the destruction
of those records specified above. Complaints which could be
evidence in any pending claims or litigation filed against the
City shall not be destroyed even if they exceed seven years of
age until the claim or litigation i. resolved.
BE IT FURTHER RESOLVED that this resolution shall take
• effect immediately; and

BE IT FURTHER RESOLVED that
the City Clerk
shall certify
to the passage
and adoption
of this
resolution; shall cause the
same to
be entered in the
book of
resolutions of
the City of
Newport
Beach, and shall
make a
record of the
passage and
adoption
thereof in the records of
the proceedings
of the City

Council
of said City in the
minutes
the meeting
at which the
of
same was
passed and adopted.
