A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING PLANNING COMMISSION
AMENDMENT NO. 653 FOR THE CIVIC PLAZA PLANNED
COMMUNITY
WHEREAS, as part of the development and implementation of
• the Newport Beach General Plan the Land Use Element has been
prepared; and
WHEREAS, the Newport Beach Municipal Code provides
specific procedures for the implementation of Planned Community
zoning for properties within the City of Newport Beach; and
WHEREAS, an amendment to the Civic Plaza Planned Community
is necessary in order to maintain consistency between the Newport
Beach General Plan and the Zoning Ordinance; and
WHEREAS, the City of Newport Beach prepared an
Environmental Impact Report (EIR) for the project in compliance
with the California Environmental Quality Act (CEQA) and the State
CEQA Guidelines; and
WHEREAS, the Planning Commission has held a public hearing
and recommended approval of said amendment to the City Council; and
WHEREAS, the City Council has reviewed and considered the
information contained in the EIR in making its decision on the
proposed amendment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Newport Beach that an amendment to the Civic Plaza Planned
Community designated as Planning Commission Amendment No. 653 is
approved as shown on Exhibit 1 attached.

4. Phasing of Development
34,000 sq. ft. of development was existing or under construction as of
January 1, 1979. The additional allowable development'in the total approved
development plan is 272,706 sq. ft. Any further development subsequent to
January 1, 1979 in excess of 30% of the additional allowable development,
being 81,812 sq. ft., shall be approved only after it can be demonstrated
that adequate traffic facilities will be available to handle that traffic
generated by the project at the time of occupancy of the buildings involved.
Such demonstration may be made by the presentation of a phasing plan consis-
tent with the Circulation Element of the Newport Beach General Plan. In the
review of this phasing plan, a test of reasonableness should be applied,
rather than the criteria of the Traffic Phasing Ordinance.3

2 Final approval of the number of square feet of office use shall be subject
to the establishment of. overall limits on development in Newport Center.
These limits shall be established in conjunction with the review of additional
traffic studies which are currently underway. No building permits shall be
issued on Lot 3, nor shall there be any further resubdivision of Lot 3 until
such limits are established by the Planning Commission.

FINDINGS AND CONDITIONS FOR APPROVAL
AMENDMENT NO. 632
TRAFFIC STUDY
SEPTEMBER 24, 1987
A. AMENDMENT NO. 632 Recommend approval of Amendment No. 632 to
the City Council, making the following findings:
Findings:
1. That the Fashion Island Planned Community District Regulations
and Development Plan are consistent with the Newport Beach
General Plan.
2. That adoption of the Planned Community District Regulations and
Development Plan are necessary to maintain consistency between
the General Plan and the Zoning Ordinance.
B. TRAFFIC STUDY
Findings:
1. That a Traffic Study has been prepared which analyzes the
impact of the proposed project on the circulation system in
accordance with Chapter 15.40 of the Newport Beach Municipal
Code and Council Policy S -1.
2. That the traffic study indicates that traffic will be greater
than one percent (1 %) of the existing traffic during the 2$
hour peak period at several intersections, and will add to an
unsatisfactory level of traffic service at one critical inter-
section which will have an Intersection Capacity Utilization
greater than 0.90.
3. That the study has identified an improvement which will improve
the level of traffic service to an acceptable level below 0.90
at the critical intersection.
4. That with the circulation system improvement, the project will
neither cause nor make worse an unsatisfactory level of traffic
service on any "major ", "primary- modified" or "primary" street.
Condition:
1. That prior to the issuance of occupancy permits for the
development enabled by General Plan Amendment 87 -1 (C) , the
General Plan Consistency Determination for Fashion Island
theater seats and Amendment No. 632, a third southbound through
lane shall be constructed at the intersection of Jamboree Road
and Santa Barbara Drive in a manner acceptable the City Traffic
Engineer and the Public Works Department.
