HomeMy WebLinkAbout88-8 - Inventory & Business Emergency PlanRESOLUTION NO. 88- 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH GRANTING EXEMPTION FROM THE INVENTORY AND BUSINESS EMERGENCY PLAN PROVISIONS AS AUTHORIZED BY HEALTH AND SAFETY CODE SECTION 25503.05. • WHEREAS, under Resolution 87 -37, the City Council assumed responsibility for implementation of Chapter 6.95 of Division 20 of the Health & Safety Code and designated the Fire Department as the agency within the City to administer these provisions; and WHEREAS, Health & Safety Code Section 25503.5(2) grants the authority for the City Council to exempt from the inventory provisions of Chapter 6.9 the Health & Safety Code if the City Council hazardous substance would not pose a present to the environment or to human health if the was released into the environment; and hazardous substances 5 of Division 20 of finds that the or potential danger hazardous substance WHEREAS, the City Council finds that certain substances, because of their quantity, concentration or chemical characteristics, do not pose a significant present or potential hazard to human health and safety or to the environment if released into the community; and WHEREAS, the City Council desires to exempt inert compressed gases in quantities equal to or less than one thousand (1000) cubic feet at standard pressure and temperature from the inventory and business emergency plan requirements of Chapter 6.95 of Division 20 of the Health & Safety Code; and WHEREAS, the City Council desires to exempt oxygen and nitrous oxide maintained by doctors, dentists and veterinarians in quantities equal to or less than one thousand (1000) feet at standard pressure and temperature from the inventory and business _ emergency plan requirements of Chapter 6.95 of Division 20 of the Health & Safety Code; and WHEREAS, the City Council desires to exempt carbon dioxide, halon and dry chemical extinguishing agents used in approved fire protection systems from the inventory and business emergency plan requirements of Chapter 6.95 of Division 20 of the Health & Safety Code; and NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Newport Beach that: The following exemptions are ordered from the inventory and business emergency plan requirements of Chapter 6.95 of Division 20 of the Health & Safety Code: a. Inert compressed gases in quantities equal to or less than one thousand (1000) cubic feet at standard temperature and pressure on site at any one time. b. Oxygen and nitrous oxide maintained by doctors, dentist and veterinarians in quantities equal to or less than one thousand (1000) cubic feet at standard temperature and pressure on site at any one time. c. Carbon dioxide, halon and dry chemical extinguishing agents when used in approved fire protection systems. ADOPTED this 8th day ATTEST: City Clerk
