RESOLUTION NO. 88 -32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH SUPPORTING THE REPEAL OF THE
FIREMAN'S RULE (SB 2417).
WHEREAS, the Courts have created a rule, known as the
Fireman's Rule, that prevents public safety employees from suing
persons whose intentional or negligent conduct injures them during
the course and scope of their employment; and
WHEREAS, the Fireman's Rule has been applied by Courts to
prevent public safety employees from suing persons who have
intentionally and maliciously injured them during the course and
scope of their employment; and
WHEREAS, Workers' Compensation benefits protect public
safety employees to some extent with respect to damages they
suffer from work - related injuries, but the employee remains unable
to sue the responsible party for pain and suffering and other
damages; and
WHEREAS, the Fireman's Rule prevents cities, counties, and
other public entities from recovering, from the responsible party,
salaries and medical expenses paid on behalf of the injured
employees; and
WHEREAS, the Fireman's Rule represents an unfair exception
to the general principle that persons should be held responsible
for their wrongful conduct and repeal will help public entities
recover taxpayers' dollars from persons who intentionally injure
public safety employees.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Newport Beach hereby supports SB 2417 (Roberti) which
would repeal the Fireman's Rule.
