HomeMy WebLinkAbout88-78 - General Municipal Election - 11-8-88RESOLUTION NO. 88 -78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CALLING AND GIVING NOTICE OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 1988, FOR THE ELECTION OF MUNICIPAL OFFICERS AS REQUIRED BY THE PROVISIONS OF SECTION 400 OF THE CITY CHARTER OF THE CITY OF NEWPORT BEACH AND FOR THE SUBMISSION TO THE VOTERS OF A MEASURE KNOWN AS THE r TRAFFIC MANAGEMENT • INITIATIVE. 0 WHEREAS, pursuant to the provisions of Section 400 of the City Charter of the City of Newport. Beach, a General Municipal Election shall be held on November 8, 1988 for the election of municipal officers; and WHEREAS, the City Council also desires to submit to the voters at that election a measure known as "The Traffic Management Initiative." NOW, THEREFORE, the City Council of the City of Newport Beach does hereby resolve, declare, determine, and order as follows: Section 1. Pursuant to the provisions of Section 400 of the City Charter there is called and ordered to be held in the City of Newport Beach, California, on Tuesday, November 8, 1988, a General Municipal Election for the purpose of electing three members of the City Council for the full term of four years. Section 2. The City Council, pursuant to previous order and the provisions of Section 4011 of the Elections Code, also confirms submission of the following question to the voters at the General Municipal Election to be held on November 8, 1988: 'HALL THE TRAFFIC MANAGEMENT YES INITIATIVE BE ADOPTED? NO 3 Section 3. The precise wording of the measure to be submitted to the voters is attached as Exhibit "A." Section 4. That the ballots to be used at the election • shall be in form and content as required by law. 0 Section 5. That the City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. Section 6. That the polls for the election shall be open at 7:00 A.M. of the day of the election and shall remain open continuously from that time until 8:00 P.M. of the same day when the polls shall be closed except as provided in Section 14301 of the Elections Code of the State of California. Section 7. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for conduct of general municipal elections. Section 8. That notice of the time and place for holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in the time, form and manner as required by law. Section 9. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. ADOPTED this 25th day of Ju: 2 • ATTEST: City I- TRAFFV' ANAGEMENT INITIATIVE ORDI NCE FWTHE CITY OF NEWPORT BEACPW The People of the City of Newport Beach hereby ordain as follows: - Section 1: Findings - In many areas of the City the circulation system is reaching capacity. Traffic studies indicate that proposed development projects will produce unacceptable levels of traffic congestion. If the City's General Plan is not amended to establish reasonable standards for traffic management, unacceptable traffic levels on many major streets and intersections will result. Section II: Purpose (a) This Ordinance is necessary to protect the public health, safety and welfare of present and future residents of the City and region by avoiding unnecessary and deleterious traffic congestion. Such traffic congestion would: impede emergency service vehicles from reaching their destinations; increase the numbers of traffic accidents; and cause loss of time, increased air pollution, wasted fuel, noise and general deterioration of the quality of life. (b) It Is the purpose of this Ordinance to amend the General Plan in order to establish policies and standards which: (1) Establish the limit for acceptable traffic service levels in the City at Level Of Service (LOS) D, which service level shag correspond to an average stop delay of 30 seconds or less per vehicle at major intersections for the 15 minute peak period, and a parallel standard of a . peak hour Intersection Capacity Utilization (ICU) of 0.89. (2) Insure that new developments do not receive building permits unless and until related and necessary traffic improvements are in place and operating at an acceptable level of service. (c) The City acknowledges that toa certain degree the traffic problemscurrently affecting the City are not entirelywilMn theCitys control. It Is the purpose of this Ordinance nonetheless to preserve the quality of life in the City through planning which Is within local authority and which relates to municipal concerns. Including but not limited to the aforementioned amendments to the General Plan. Section III: General Plan Amendments to the General Plan Policies Element of the Newport Beach General Plan. The text of the General Pian Polices Element is hereby amended as follows: (a) The text of the section entitled "Future Growth" at page 1 is hereby amended to insert new paragraph IN after the subtitle "Supporting Policies," as follows: - "h) The timingand pace of -future development shall be limited and Controlled such that development proceeds only as the existi no and planned circulation system affected by the development is in place and operating at an acceptable level of service." _ (b)The text of thesection entitled"Circulation and Transportation "at page 5 ist)erebyamended to lnsertin plaeeof existing paragraph (d) after the subtitle "Supporting Policies," paragraph (d) at page S, the following: - "d) Recognizing the vital relationship which exists between the street network and the use of the land, the City shalrapprove only land uses whose distribution, character and intensity are consistent with acceptable traffic service levels." (c) The text of the section entitled "Circulation and Transportation" at page 5 is hereby amended to insert new paragraph (o) at page 7, following the subtitle "Supporting Policies," as follows: Section IV: General Plan Amendment to the Circulation Element of the Newport Beach General Plan. The text of the Section entitled "Circulation Element - Proposals" at pages shall beamended to insert a new section afterthe section entitled "Basic Concept." as follows: "Circulation System Standards" (2) A parallel standard shall be Intersection Capacity Utilization (ICU) during the peak hour of 0.89, to be calculated using 1800 vehicles per hour per lane including a five percent yellow time factor. (c) (1) Any commercial orindustrial project which has: a gross floor area equal to orlessthan 10.000 square feet (and any par king incidental thereto), a buildable floor area ratio of less than 0.5, and an average daily trip generation of less than 130 daily trips. (2) Any residential project of four dwelling units or less; (3) Facilities serving the health and safety of the people which facilities shall be defined as hospitals. police, fire and safety facilities and schools: (6) Public benefit facilities. which shall be defined as public libraries. public administration facilities, publiCLarks and recreation facilities, and religious facilities, and �ecuon v: implementation This Ordinance shall amend the General Plan upon its effective date. If all General Plan amendments as allowed by the state and local law have already been approved during 1958. this Ordinance shall take effect on.lanuary 1, 1987 and shall bathe first General Plan Amendment of that year. Within a reasonable time but not later than nine months after passage of this Ordinance, the City shall review and amend, where necessary. the City zoning ordinance, the City Tragic Phasing Ordinance, and any other planning policies and regulations to insure consistency with the provisions of the General Plan as amended by this Ordinance. In the interim, the projects may be approved only if the City finds that such project(s) are consistent with the standards set ford in this Ordinance. A Secton VI: This Ordinance may be amended or repealed only by the voters at a municipal election. EXHIBIT A 6 Section VII: If any portion of this Ordinance is declared invalid, the remaining portions are to be considered valid.
