A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS INTENTION TO VACATE A
PORTION OF SUPERIOR AVENUE NORTHERLY OF PACIFIC
COAST HIGHWAY AND SETTING SEPTEMBER 12, 1988 AS
THE DATE FOR THE PUBLIC HEARING ON THE PROPOSED
VACATION.
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of the Street Vacation Act (Section
8300 et. seq. of the Streets & Highways Code) is authorized to
vacate public easements; and
WHEREAS, the City Council of the City of Newport Beach
intends to vacate that portion of Superior Avenue depicted on the
map attached as Exhibit B, and legally described on Exhibit A, the
vacation to be processed pursuant to the provisions of the Street
Vacation Act; and
WHEREAS, the City Council of the City of Newport Beach has
reviewed and considered the various elements of the General Plan
of the City of Newport Beach prior to declaring its intent to
vacate this portion of Superior Avenue and has determined that the
proposed vacation is consistent with the General Plan; and
WHEREAS, the proposed vacation is consistent with, and
required by, the provisions of an Agreement between the City of
Newport Beach and State of California for the acquisition of
right -of -way essential to the prior realignment of Superior
Avenue.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Newport Beach that the time and place for hearing all
persons interested in, or objecting to, the proposed vacation of
that portion of Superior Avenue depicted on Exhibit A and
described in Exhibit B, shall be at 7:30 P.M. or as soon
thereafter as the matter may be heard, on September 12, 1988 in
the Chambers of the City Council of the City of Newport Beach
located at 3300 Newport Boulevard, Newport Beach, California.
BE IT FURTHER RESOLVED that this Resolution of Intention
shall be published for at least two (2) times prior to the hearing
iin the official newspaper of the City of Newport Beach; and
BE IT FURTHER RESOLVED that at least two (2) weeks before
the day set for the hearing, notices of the proposed vacation
shall be conspicuously posted along the line of that portion of
Superior to be vacated, with the notices to be posted not more
than three hundred (3001) feet apart and a minimum of three (3)
notices posted. The notices shall state the day, hour, and place
of the hearing and refer to the adoption of the Notice of
Intention.
