A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH DECLARING THE
CITY'S INTENTION TO VACATE THE PORTION
OF SPYGLASS HILLS ROAD ADJACENT TO 3841
OCEAN BIRCH DRIVE AND SETTING A DATE FOR
PUBLIC HEARING.
WHEREAS, the City Council of the City of Newport Beach pursuant
to the provisions of the street vacation act (8300 et seq. of the
Streets and Highways Code) is authorized to vacate public use; and
WHEREAS, the City Council of the City of Newport Beach intends
to vacate the portion of Spyglass Hills Road legally described on
Exhibit "A" and depicted on the Map attached as Exhibit "B ", the
vacation to be processed pursuant to the provisions of the Street
Vacation Act; and
WHEREAS, the City Council of the City of Newport Beach has
reviewed and considered the various elements of the General Plan
of the City of Newport Beach prior to declaring its intent to
vacate this portion of Spyglass Hills Road and has determined that
the proposed vacation is consistent with the General Plan.
NOW, THEREFORE, be it resolved by the City Council of the City
of Newport Beach that the time and place for hearing all persons
interested in, objecting to, their proposed vacation of the
portion of Spyglass Hills Road legally described on Exhibit "A"
and depicted on the Map attached as Exhibit "B" shall be at 7:30
p.m. or soon thereafter as the matter may be heard, on November
14, 1988 in the Chambers of the City Council of the City of
Newport Beach located at 3300 Newport Boulevard, Newport Beach,
California.
BE IT FURTHER RESOLVED that this resolution of intention shall
be published for at least two (2) successive weeks prior to the
hearing in the official newspaper of the City of Newport Beach;
and
• BE IT FURTHER RESOLVED, that at least two (2) weeks before the
day set for hearing, notices of the proposed vacation shall be
conspicuously posted along Spyglass Hills Road, with the notices
to be posted not more than three hundred feet (3001) apart and a
minimum of three (3) notices posted. The notices shall state the
day, hour, and place of the hearing Bind refer to the adoption of
the Notice of Intention_
DESCRIPTION
That particular parcel of land located in the city of Newport Beach,
County of Orange, State of California, described as follows:
Beginning at the southeast corner of Spyglass Hill Road as shown on
Tract Map No. 7247 recorded in book 278, pages 21 through 25 of
Miscellaneous Maps on file in the office of the County Recorder in
Orange County; thence S 88° 57' 00" W 84.00 feet to the beginning of
non tangent curve, concave southwesterly having a radius of 25.00
feet; thence northwesterly along said curve an arc distance of 40.12
feet through a central angle of 91° 57' 30" to the southerly line of
Ocean Birch Drive as shown on said map; thence N 860 59' 30" E 109.92
feet along the easterly prolongation of said southerly line of Ocean
Birch Drive (to the easterly line of Spyglass Hill Road) to the point
of beginning.
