A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH CERTIFYING AS COMPLETE AND
ADEQUATE THE FINAL ENVIRONMENTAL IMPACT REPORT
• NO. 140 FOR THE GENERAL PLAN UPDATE
[GPA 87 -1(A) & 87 -1(E)]
WHEREAS, the Draft Environmental Impact Report No. 140 provided
environmental impact assessment for the General Plan Update involving the
Land Use and Circulation Elements of the Newport Beach General Plan, and
WHEREAS, the DEIR was prepared in accordance with the California
Environmental Quality Act (CEQA) and the State CEQA Guidelines as a Program
EIR as provided for in Section 15168 of the: State CEQA Guidelines; and
WHEREAS, the program EIR provides information on the series of
actions which constitute the General Plan Review and the implementing
actions which are anticipated to follow the adoption of the Land Use and
Circulation Elements; and
WHEREAS, the use of the Program approach to the environmental
analysis ensures consideration of cumulative impacts which may have been
slighted in a case -by -case analysis; and
WHEREAS, the Program EIR has allowed the City of Newport Beach to
consider broad policy alternatives and program wide mitigation measures at
an early stage in the planning process as they relate to the scope of the
General Plan Review program addressing the correlation of the Land Use and
Circulation Elements and the establishment of specific density and intensity
limitations on all land in the City of Newport Beach; and
WHEREAS, the Certified Final Environmental Impact Reports of the
County of Orange Nos. 237, 486, 508 and 508A; and the City of Newport Beach
Certified Final Environmental Impact Reports for the General Plan, GPA 81 -1
and GPA 85 -1(B) are incorporated by reference into the EIR for the General
Plan Update; and
0 WHEREAS, the DEIR was circulated to the public for comment and
review: and
WHEREAS, written comments were received from the public during and
after the review period; and

WHEREAS, the Planning Commission of the City of Newport Beach
conducted a public hearing to receive public testimony with respect to the
DEIR; and
WHEREAS, such comments and testimony were responded to through
Response to Comments and staff reports submitted to the Planning Commission
and City Council; and
WHEREAS, such comments and testimony were fully and adequately
responded to in the manner set forth in California Administrative Code
Section 15088 (b); and
WHEREAS, the Planning Commission of the City of Newport Beach has
reviewed the draft EIR and has found that it considers all environmental
impacts of the General Plan Update and is complete and adequate and fully
complies with all requirements of CEQA and the CEQA Guidelines; and
WHEREAS, the City Council of the City of Newport Beach has
reviewed all environmental documentation prepared to evaluate the proposed
project, including all elements of the Final EIR and the recommendation of
the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby
certify the Final Environmental Impact Report No. 140 for the General Plan
Update [CPA 87 -1(A) and 87- 1(E)], as complete and adequate in that it
addresses all environmental effects of the proposed project and fully
complies with the requirements of the California Environmental Quality Act
and the State CEQA Guidelines. Said Final Environmental Impact Report is
comprised of the following elements;
1. Draft EIR and Technical Appendices
2. Responses to Comments
3. Planning Commission Staff Reports
4. Planning Commission Minutes
5. Planning Commission Resolutions
6. City Council Staff Reports
7. City Council Minutes
8. City Council Resolutions
9. Comments and Responses received prior to final action and not
contained in 1 through 8 above.
10. CFEIR's Nos. 237, 468, 508 and 508A of the County of Orange.
11. CFEIR's of the City of Newport Beach for the General Plan,
GPA 81 -1 and CPA 85 -1(B).
