A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH TO FORM THE AD -HOC
OCEAN FRONT ENCROACHMENT CITIZENS ADVISORY COMMITTEE
WHEREAS, the California Coastal Commission has requested the City of
Newport Beach to investigate and address encroachments on the ocean front; and
• WHEREAS, the City Council wishes to collect all the available
information and facts regarding encroachments on the Balboa Peninsula ocean
front; and
WHEREAS, the City Council wishes to investigate how ocean front
encroachments in other California Coastal communities have been resolved; and
WHEREAS, the West Newport Beach Association has requested that a
Citizens Committee on beach encroachments be formed; and
WHEREAS, the City Council wishes to involve the citizens and residents
of the City in addressing the issue of encroachments on the Balboa Peninsula
ocean front.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Newport Beach shall form an Ad -Hoc Citizens Ocean Front Encroachment Committee
whose function and structure shall be as follows:
COMMITTEE ORGANIZATION: The Committee shall be made up of 7 members
representative of the following groups:
A. One member from the Board of Directors of the following Community
Associations:
1. West Newport Community Association
2. Central Newport Community Association
3. Balboa Peninsula Point Association
2. Parks, Beaches & Recreation Commission

B. One
member
from each of the following Community Associations:
1.
West Newport Community Association
2.
Balboa
Peninsula Point Association

C. One
member
shall be from following:
appointed each of the
1.
Harbor
& Tidelands Committee
2. Parks, Beaches & Recreation Commission

D. One non - voting member from the staff of the following City
Departments:
1. City Attorney's office
2. Public Works Department
E. The Chairman shall be a member selected by the committee.
. DUTIES OF THE COMMITTE: The committee is charged with the
responsibility of:
A. Gather and review available facts and information regarding the
Balboa Peninsula ocean front encroachments and report information to the City
Council. Research to include work sessions with professional experts and staff
to discuss the following:
1. Current status of encroachments
2. Current City policy
3. Coastal Commission's concern
4. Legal status of the encroachments
5. Resolution of encroachments in other coastal communities
B. Determine need for any additional facts, information and legal
opinion regarding the Balboa Peninsula ocean front encroachments.
C. Develop alternative plans which address the issue
D. Solicit comments from all of the Peninsula Associations
E. Present monthly status report to City Council
COMMITTEE TERMINATION: The Committee shall be disbanded and shall
cease function when final status report is presented to City Council. The
anticipated duration of Committee function is approximately 6 months.
