A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH
ADOPTION GENERAL PLAN AMENDMENT 89 -3(D)
AMENDING THE LAND USE ELEMENT OF THE NEWPORT BEACH
GENERAL PLAN SO AS TO RECLASSIFY PROPERTY LOCATED AT
3245 -3251 BROAD STREET FROM "RETAIL AND SERVICE
• COMMERCIAL" TO "TWO FAMILY RESIDENTIAL" USES
WHEREAS, as part of the development and implementation of the
Newport Beach General Plan the Land Use Element has been prepared; and
WHEREAS, said element of the General Plan sets forth objectives,
supporting policies and limitations for development in the City of Newport Beach; and
WHEREAS, said element of the General Plan designates the general
distribution and general location and extent of the uses of land and building intensities
in a number of ways, including residential land use categories and population projections,
commercial floor area limitations, and floor area ratio ordinance; and
WHEREAS, the Land Use and Circulation Elements are correlated as
required by California planning law; and
WHEREAS, the provisions and policies of the Land Use and Circulation
Elements are further implemented by the traffic analysis procedures of the Traffic
Phasing Ordinance and the implementation programs of that Ordinance and the Fair
Share Traffic Contribution Fee Ordinance; and
WHEREAS, pursuant to Section 707 of the Charter of the City of Newport
Beach, the Planning Commission has held a public hearing to consider a certain
amendment to the Land Use Element of the Newport Beach General Plan; and
WHEREAS, the Planning Commission of the City of Newport Beach has
recommended approval of General Plan Amendment 89 -3(D) to the City Council; and
WHEREAS, the proposed project is compatible with the existing land uses
in the Broad Street area; and
• WHEREAS, the circulation system will not be significantly impacted by the
proposed project; and
WHEREAS, the City of Newport Beach has determined that the subject
project is exempt from the provisions of CEQA as provided in Section 1501(b)(3) of the
State CEQA Guidelines; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that an amendment to the General Plan with related
provisions and requirements as described in Exhibit "A" and "B" is approved.

Commencing at the southeasterly corner of said Lot 2, Block 8 of Tract No. 27; thence
northwesterly N 70 57' 30" W along the southwesterly line of said Lot 2 a distance of
84.0 feet; thence northerly N 0 02' 32" W a distance of 119.27 feet to a point on the
northwesterly edge of said Lot 1; thence northeasterly N 79 06' 08" E along the
• northwesterly line of said Lot 1 a distance of 80.83 feet to a point on the easterly edge
of said Block 8; thence southerly N 0 02' 32" W along the easterly edge of said Block
8 a distance of 161.96 feet to the true point of beginning.
