RESOLUTION NO. 90 -20
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, FIXING THE DATE ON
WHICH OWNERS OF PROPERTY LOCATED IN ASSESSMENT
DISTRICT NO. 57 (CORONA HIGHLANDS) MUST BE READY
TO RECEIVE UNDERGROUND UTILITY SERVICE FROM
SERVING UTILITIES, AND ORDERING THE REMOVAL OF ALL
POLES, OVERHEAD WIRES AND ASSOCIATED OVERHEAD
STRUCTURES LOCATED WITHIN THE ASSESSMENT DISTRICT.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA
DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, the City Council, did, on June 26, 1989, after
holding of a public hearing on its resolution of intention to
order the construction of underground utilities in Corona
Highlands by means of special assessment district procedures, by
Resolution No. 89 -51 overruled and denied all protests and
objections of every kind and nature; confirmed the assessments;
ordered the improvements made; and directed the City Clerk to
mail a notice to each owner of a lot or parcel of land within the
assessment district, advising him that all electric and
communication facilities, including connections to the owner's
premises located on any lot or parcel of land within the
assessment district must be constructed, reconstructed, relocated
or converted by the owner of such lot or parcel at his own
expense, and stating that unless the owner complies with the
requirements of this section, all buildings and improvements
located upon the lot or parcel will be subject to disconnection
from the electric or communication facilities providing service
thereto.
NOW THEREFORE BE IT RESOLVED that the City Council does
hereby fix April 1, 1990, as the date upon which affected
property must be ready to receive utility service from
underground utilities, and does hereby order removal of all
poles, overhead wires, and associated overhead structures used
for supplying electrical and communication service within said
assessment district.
BE IT FURTHER RESOLVED that the City Clerk is hereby
instructed to notify all affected utilities and persons owning
real property located within Assessment District No. 57 of the
adoption of this resolution within ten (10) days after the date
of such adoption. The City Clerk shall further notify such
• property owners of the necessity that, if they desire to continue
to receive electric or communication service, they shall by the
date fixed in this resolution provide all necessary facilities
changes on their premises so as to be able to receive service
from underground lines of the serving utilities.
