A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ESTABLISHING A FEE FOR AN APPEAL OF
A DECISION OF THE PLANNING DIRECTOR OR PLANNING
COMMISSION REGARDING AN APPLICATION FOR AN AMATEUR
RADIO ANTENNA PERMIT OR A SATELLITE DISH ANTENNA
PERMIT.
• WHEREAS, the City Council of the City of Newport has
adopted ordinances regulating the installation and placement of
amateur radio antennas and satellite dish antennas;
WHEREAS, the ordinances regulating amateur radio antennas
and satellite dish antennas do not require applicant for a permit
to pay a fee in conjunction with the application;
WHEREAS, the ordinances regulating amateur radio antennas
and satellite dish antennas do require the payment of a fee as a
condition to the appeal of a decision of the Planning Director or
Planning Commission relating to an application for an amateur
radio antenna permit or satellite dish antenna permit;
WHEREAS, an appeal of a decision regarding an amateur
radio antenna permit application requires notification to nearby
property owners, the preparation of a comprehensive staff report,
and the attendance of staff personnel at the hearing before the
Planning Commission or City Council; and
WHEREAS, Planning Department has determined that the
average cost to the City of processing an appeal of an application
for an amateur radio antenna permit or satellite dish antenna
permit to the Planning Commission or the City Council is $347.00.
• NOW THEREFORE, BE IT RESOLVED, that the fee for processing
an appeal of a decision of the Planning Director or Planning
Commission relative to an application for an amateur radio antenna
permit or a satellite dish antenna permit is $347.00; and

BE IT FURTHER RESOLVED that the City Council may authorize
a waiver of some or all of the fee at the request of the applicant
and upon a determination that fees required by this Resolution are
unreasonable in light of the expense of acquiring and installing
the antenna proposed by the applicant.
