A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
DECLARING CITY'S INTENTION TO VACATE AND ABANDON A PORTION
OF AN EXISTING ALLEY LOCATED BETWEEN BELVUE LANE (WALKWAY) AND
"M" STREET NORTHERLY OF MIRAMAR DRIVE IN THE PENINSULA POINT AREA
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of the Street Vacation Act (Section 8300
et seq. of the Streets & Highways Code) is authorized to vacate
public easements; and
WHEREAS, the City Council of the City of Newport Beach
intends to vacate a portion of the alley legally described on
Exhibit "A" and depicted on a map attached as Exhibit "B ", the
vacation to be processed pursuant to the provisions of the Street
Vacation Act; and
WHEREAS, the City Council of the City of Newport Beach
has reviewed and considered the various elements of the General
Plan of the City of Newport Beach prior to declaring its intent to
vacate this portion of alley and has determined that the proposed
vacation is consistent with the General Plan.
NOW, THEREFORE, be it resolved by the City Council of the
City of Newport Beach that the time and place for hearing all
persons interested in, objecting to, the proposed vacation of this
alley legally described on Exhibit "A" and depicted on Exhibit "B ",
shall be at 7:00 p.m. or as soon thereafter as the matter may be
heard on April 8, 1991, in the Chambers of the City Council of the
City of Newport Beach located at 3300 Newport Boulevard, Newport
Beach, California; and
BE IT FURTHER RESOLVED that this resolution of intention
shall be published for at least two (2) successive weeks prior to
the hearing in the official newspaper of the City of Newport Beach;
and
BE IT FURTHER RESOLVED, that at least two (2) weeks
before the day set for hearing, notices of the proposed vacation
shall be conspicuously posted along the alley, with the notices to
be posted not more than three hundred feet (3001) apart and a
minimum of three (3) notices posted. The notices shall state the
day, hour, and place of the hearing and refer to the adoption of
the Notice of Intention.

Those portions of that certain Alley, 35.00 feet wide, as
shown on map of Tract No. 1090 filed in Book 35, Page 24 of
Miscellaneous Maps, in the office of the Recorder of Orange County,
California, lying easterly of and adjoining Lot 31 of said tract,
said portions are more particularly described as follows:
Parcel 1
Beginning at the most southerly corner of said tract, said
corner being the easterly terminus of that certain curve concave
northeasterly and having a radius of 8145.00 feet as shown on said
map; thence northwesterly along said curve, through a central angle
of 0 00213211, an arc length of 6.01 feet; thence N 16 019106" E along
a line parallel with and 6.00 feet northwesterly, measured at right
angles, from the southeasterly line of said tract to a line
concentric with and 5.00 feet southwesterly, measured radially,
from that certain 8075.00 -foot radius curve in the boundary of said
tract; thence easterly in a direct line to the most easterly corner
of said tract; thence S 160 19106" W along the boundary of said
tract to the Point of Beginning.
Parcel 2
Beginning at the most southerly corner of Lot 31 of said Tract
No. 1090, said corner being a point in that certain 8145.00 -foot
curve, concave northeasterly, in the boundary of said tract as
shown on said map; thence southeasterly along said curve, through
a central angle of 000114111, an arc length of 4.01 feet to a line
parallel with and 4.00 feet southeasterly, measured at right
angles, from that certain course having a bearing and length of
S 16 019106" W 56.24 feet as shown on said map; thence
N 16 019106" E along said parallel line to its intersection with the
southerly prolongation of that certain course, in the boundary of
said lot, having a bearing and length of South 12.15 feet; thence
northerly along said prolongation to the southerly terminus of said
last mentioned certain course; thence southwesterly in a direct
line to the Point of Beginning.
