A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH IMPLEMENTING PHASE 4 OF THE
WATER CONSERVATION AND RATIONING PROGRAM
ESTABLISHED BY ORDINANCE NO. 91 -17.
WHEREAS, the State of California is in the midst of a five
• year drought and recent rains have not had a measurable impact on
the amount of water available for sale by the Metropolitan Water
District of Southern California (MWD); and,
WHEREAS, MWD is the sole supplier of water to the City of
Newport Beach; and,
WHEREAS, MWD has implemented a program for water conservation
known as the Incremental Interruption and Conservation Plan
(II &CP). On January 11, 1991, in response to actions take by MWD
pursuant to the II &CP reducing the City of Newport Beach water
supply, the City Council adopted Emergency Ordinance No. 91 -3,
establishing a mandatory water rationing program. In accordance
with the cutback level set by II &CP, the City adopted a twenty
percent (200) reduction level; and,
WHEREAS, the Newport Beach City Council, in response to the
long term drought and recent action on part of MWD to continue
implementing twenty percent (20 %) reduction under the II &CP, has
adopted a comprehensive water conservation program as set forth in
Ordinance No. 91 -17, which became effective May 8, 1991; and,
WHEREAS, the Utilities Director has studied and evaluated the
supply of water from MWD, the demand for water by Newport Beach
residents, and has recommended implementation of Phase 4 of
Ordinance No. 91 -17, which proposes mandatory consumption
restrictions that reflect MWD's twenty percent (20 %) reduction in
allocation; and,
WHEREAS, the Newport Beach City Council has reviewed and
• considered the report from the Utilities Director and testimony
relevant to the appropriate conservation phase to be implemented
pursuant to this Resolution.
NOW, THEREFORE, BE IT RESOLVED:
1. The City Council hereby implements Phase 4 of Ordinance

No. 91 -17, which requires among other things, a mandatory twenty
percent (20 %) reduction in water consumed as compared with the
corresponding base period in 1989 -1990.
2. Phase 4 of Ordinance No. 91 -17 shall become effective
upon publication of this Resolution in a daily newspaper of general
• circulation, provided, however, the consumption reduction
provisions shall not take effect until the first full billing
period, commencing July 1, 1991.
3. The City Clerk is hereby directed to publish this
Resolution in the manner required by Ordinance No. 91 -17.
