RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ESTABLISHING THE OCEANFRONT WALK
CITY COUNCIL AD HOC COMMITTEE.
• WHEREAS, an Orange County Superior Court jury has awarded
$270,000 to a person who was struck by a bicycle while walking on
Oceanfront Walk near 18th street; and
WHEREAS, the basis for the jury's award was a finding that
Oceanfront Walk was in a dangerous condition due, in part, to
insufficient width to accommodate the large number of pedestrians,
skateboarders, rollerskaters and rollerbladers that use the
walkway; and
WHEREAS, the City Council is considering the adoption of a
pilot program that would temporarily prohibit the operation or use
of bicycles, skateboards, rollerskates and rollerblades on
Oceanfront Walk during weekends, holidays and summer months to
avoid conflict with pedestrians during periods of peak usage; and
WHEREAS, there is no readily apparent alternative facility
capable of accommodating the demand for recreational use of
Oceanfront Walk, the widening of the existing facility or the
construction of a new bicycle path would cost in excess of $1.5
million dollars and take at least 18 months to complete, and there
is insufficient paved area within the oceanfront alley, Balboa
Boulevard or Bay Avenue to construct a bicycle path or a facility
dedicated to use by skateboarders or rollerskaters; and
WHEREAS, the City Council desires to appoint a committee to
• evaluate the pilot program and make recommendations to the City
Council regarding long term solutions to the demand for a
recreational use of Oceanfront Walk.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Newport Beach as follows:
1. The City Council of the City of Newport Beach hereby
establishes the Oceanfront Walk City Council Ad Hoc Committee.
2. The Committee shall have the following composition, term,
responsibilities and staff:
(a) The Committee shall consist of the following:
i. Two members appointed by the Balboa Peninsula
Point Association, with one of the members to
be a resident of Oceanfront property and the
other appointee to be a resident of an inland
parcel;
ii. Two members appointed by the Central Balboa
Association, with one member to be a resident
of the Oceanfront Walk and the other member to
be a resident of an inland parcel;
iii. Two members appointed by and from the Bicycle
Trails Committee;
iv. The Mayor and two members of the City Council.
3. The Committee shall sunset on January 1, 1993 unless
earlier terminated by action of the City Council.
4. The Committee shall evaluate the advantages and
disadvantages of the pilot program whereby Oceanfront Walk is
• closed to bicyclists, skateboarders, rollerskaters and
rollerbladers on weekends, holidays, and during the summer months,
to evaluate the alternatives for safely accommodating the demand
for recreational cycling and skating along the oceanfront, and to

make recommendations
to
the City
Council
as soon as possible but in
no event subsequent
to
March 13,
1992.
5. The Committee shall be staffed by the Planning
Department, Public Works Department and Police Department.
