A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ADOPTING THE CITY SOURCE
REDUCTION AND RECYCLING ELEMENT (SRRE).
WHEREAS, in 1988 over 38 million tons of solid waste were
produced in the State of California, 90 percent of which was disposed
• of in landfills, amounting to more than 2,500 pounds of solid waste
for each person living in the Stater and
WHEREAS, in September of 1989, the California Legislature passed
the California Integrated Waste Management Act (AB 939); and
WHEREAS, AB 939 requires each local government to make adequate
provisions for solid waste handling within their respective
jurisdiction by promoting source reduction, recycling, composting,
environmentally safe waste transformation, and environmentally safe
land disposal; and
WHEREAS, AS 939 requires that each municipality in California
prepare a Source Reduction and Recycling Element (SRRE) which
delineates what programs are to be utilized to reach stated solid
waste reduction goals of 25 percent by the year 1995 and 50 percent by
the year 2000; and
WHEREAS, AB 939 requires that each municipality submit its SRRE
to its respective county for inclusion in a County Integrated Solid
Waste Management Plan (COISWMP) to be adopted in the year 1994; and
WHEREAS, the City has contracted with Kleinfelder, Inc. to
prepare its SRRE, which specifies programs for source reduction,
recycling, composting, and public education for implementation by the
• City to achieve the specified solid waste reduction goals; and
WHEREAS, an initial study was conducted to assess potential
environmental effects of the SRRE, in compliance with the California
Environmental Quality Act (CEQA) and the State CEQA Guildelines; and

WHEREAS, based upon the information contained in the Initial
Study, comments received, and all related documents, there is no
substantial evidence that the project, as conditioned or as modified
by mitigation measures identified in the Initial Study, could have a
significant effect on the environment, therefore a Negative
Declaration has been prepared. The Negative Declaration adequately
addresses the potential environmental impacts of the project, and
satisfies all the requirements of CEQA, and is therefore approved.
The Negative Declaration reflects the independent judgement of the
City Council and was reviewed and considered prior to approval of the
project; and
WHEREAS, considering the record as a whole there is no evidence
before this agency that the proposed project will have the potential
for a adverse effect on wildlife resources or the habitat upon which
wildlife depends. On the basis of the evidence in the record, this
agency finds that the presumption of adverse effect contained in
Section 753.5(d) of Title 14 of the California Code of Regulations
(CCR) has been rebutted. Therefore, the proposed project qualifies
for a De Minimis Impact Fee Exemption pursuant to Section 753.5(c) of
Title 14, CCR; and
WHEREAS, the Environmental Quality Affairs Committee and its
ad hoc Recycling Subcommittee have monitored the development of the
document and recommended it for adoption.
NOW, THEREFORE, BE IT RESOLVED that the City of Newport Beach has
complied with the requirements of AB 939 and AB 1820 and that the City
Council does hereby adopt this Source Reduction and Recycling Element
and approves its submission to the Orange County Integrated Waste
Management Department for inclusion in the County Integrated Solid
Waste Management Plan.
