A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH IMPLEMENTING PHASE I OF THE
WATER CONSERVATION AND RATIONING PROGRAM
ESTABLISHED BY ORDINANCE NO. 91 -17.
WHEREAS, the State of California is in the midst of a six year drought and
recent rains have had a slight impact on the amount of water available for sale by
the Metropolitan Water District of Southern California (MWD); and,
• WHEREAS, MWD is sole supplier of water to the City of Newport Beach; and.
WHEREAS. MWD adopted a program for water conservation known as the
Incremental Interruption and Conservation Plan (II & CP) requiring municipal
customers such as Newport Beach to reduce water consumption; and,
WHEREAS, because restrictions of the II & CP limited the City of Newport
Beach water supply to 20% less than the Base Year Period, the City Council
adopted Ordinance No. 91 -17, establishing a ten -phase water conservation and
rationing program. In accordance with the reductions specified by II & CP, the Cit;
adopted a twenty percent (20 %) reduction level under Resolution No. 91 -55; and,
WHEREAS, by action of the Board of Directors of MWD on March 27th,
1992, in response to actions taken by the State Department of Water Resources
WWII) to increase water supplies to Southern California and pursuant to the II &
CP, MWD has adopted a lower stage of the II & CP and has set Stage 3
restrictions; and,
WHEREAS, the Newport Beach City Council, in response to the long term
drought and recent action on part of MWD to implement ten percent (10 %)
reductions under the II & CP, have resolved to revise the Newport Beach
conservation program as set forth in Ordinance No. 91 -17, to a level equivalent to
MWD's; and,
WHEREAS, the Acting Utilities Director has studied and evaluated the
supply of water from MWD, the demand for water by Newport Beach residents,
and has recommended implementation of Phase I of Ordinance No. 91 -17, which
proposes voluntary consumption restrictions that reflect MWD's ten percent (10 %)
reduction in allocations; and,
WHEREAS, the Newport Beach City Council has reviewed and considered
the report from the Utilities Director and testimony relevant to the appropriate
conservation phase to be implemented pursuant to this Resolution.
NOW, THEREFORE, BE IT RESOLVED:
1. The City Council hereby implements Phase I of Ordinance No. 91 -17,
which requires among other things, a voluntary ten percent (10 %) reduction in
water consumed as compared with the corresponding base period in 1989 -1990.
2. Phase I of Ordinance No. 91 -17 shall become effective upon
publication of this Resolution in a daily newspaper of general circulation, provided
however, the consumption reduction provisions shall not take effect until the first
full billing period, commencing April 1 St, 1992.
3. The City Clerk is hereby directed to publish this Resolution in the
manner required by Ordinance no. 91 -17.
