A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH ADOPTING AN AMENDMENT TO THE LAND USE ELEMENT OF
THE NEWPORT BEACH GENERAL PLAN SO AS TO
REDESIGNATE PROPERTY LOCATED AT NORTHWESTERLY
CORNER OF PARK AVENUE AND AGATE AVENUE FROM "RETAIL
AND SERVICE COMMERCIAL" TO "TWO- FAMILY RESIDENTIAL" USE

WHEREAS, as part of the development and implementation of the Newport
Beach General Plan, the Land Use Element has been prepared; and
WHEREAS, said element of the General Plan sets forth objectives and
supporting policies which serve as a guide for future development of the City of Newport
Beach; and
WHEREAS, pursuant to Section 707 of the Charter of the City of Newport
Beach, the Planning Commission has held a duly noticed public hearing to consider a certain
amendment to the above referenced element of the Newport Beach General Plan;
WHEREAS, in conjunction with the consideration of the above referenced
amendment to the Land Use Element of the General Plan, the project has been determined
to be Categorically Exempt from the provisions of the California Environmental Quality Act
(CEQA) under Class 3 (New Construction or Conversion of Small Structures); and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Newport Beach that an amendment to the Land Use Element of the General Plan is
approved as follows:
That the property located on the northwesterly corner of Park Avenue and
Agate Avenue (498 Park Avenue and 203 Agate Avenue), more particularly
described as Lots 22 and 23, Block 8, Section One, Balboa Island be
reclassified from "Retail and Service Commercial" to "Two- Family Residential"
use.
