A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ADOPTING AN AMENDMENT TO
THE LAND USE ELEMENT OF THE NEWPORT BEACH
GENERAL PLAN FOR BAYVIEW LANDING [GENERAL
PLAN AMENDMENT 92-2 (C)]
WHEREAS, as part of the development and implementation of the Newport
• Beach General Plan the Land Use Element has been prepared; and
WHEREAS, said element of the General Plan sets forth objectives, supporting
policies and limitations for development in the City of Newport Beach; and
WHEREAS, said element of the General Plan designates the general
distribution and general location and extent of the uses of land and building intensities in
a number of ways, including residential land use categories and population projections and
the floor area ratio ordinances; and
WHEREAS, the Land Use and Circulation Elements are correlated as
required by California planning law; and
WHEREAS, the provisions and policies of the Land Use and Circulation
Elements are further implemented by the traffic analysis procedures of the Traffic Phasing
Ordinance and the implementation programs of that Ordinance and the Fair Share Traffic
Contribution Fee Ordinance; and
WHEREAS, pursuant to Section 707 of the Charter of the City of Newport
Beach, the Planning Commission has held a public hearing to consider a certain amendment
to the Land Use Element of the Newport Beach General Plan, and recommended approval
of this amendment to the City Council; and
WHEREAS, the City Council has held a duly noticed public hearing on this
amendment to the Newport Beach General Plan; and
WHEREAS, the circulation system will not be significantly impacted by the
proposed project; and
WHEREAS, the proposed addition of a senior citizen housing option is
• compatible with the surrounding community; and
WHEREAS, the City of Newport Beach prepared an Environmental Impact
Report for the Circulation Improvement and Open Space Agreement in compliance with
the California Environmental Quality Act (CEQA) and the State CEQA Guidelines; and
WHEREAS, the proposed Land Use Element change was studied as an
alternative to the proposed project in that Environmental Impact Report; and
WHEREAS, the Planning Commission recommended to the City Council that
this alternative be adopted; and
WHEREAS, the City Council has reviewed and considered the information
contained in the environmental document in making its decision on the proposed
• amendment to the Land Use Element of the Newport Beach General Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Newport Beach that an amendment to the General Plan Land Use Element is approved,
as follows:

4. "Bayview Landing. This site is located adjacent to the Newport Dunes site, on the
northwesterly comer of Jamboree Road and East Coast Highway. The higher level
of the site which is on the comer of Coast Highway and Jamboree Road is
designated for Recreational and Environmental Open Space. It is proposed that this
site be dedicated to the City when the balance of the site is approved for develop-
ment, and used for a view park, with a trail staging area for bicyclists and pedestri-
ans, restrooms. picnic areas, drinking fountains and bicycle racks.
The lower level of the site which is on the comer of Jamboree Road and Back Bay
Drive is designated for Retail and Service Commercial land use, and is allocated
10,000 sq.ft. for restaurant use, or 40,000 sq.ft. for athletic club use, excluding
parking. Use of the site for affordable senior citizen housing facilities is also
permitted as an optional land use (instead of restaurant or athletic club). If the site
is used for senior citizen housing, 30,000 sq.ft. of general retail use may be
transferred to Newport Center - Fashion Island.
The site may be developed with the Senior Affordable Housing option only if the
Coastal Development Permit findings demonstrate that adequate visitor serving uses
exist in the Newport Beach coastal zone consistent with the recreational and visitor
serving commercial policies of the Coastal Act."
