RESOLUTION NO. 94-64
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH RELATIVE TO THE FILING OF
ARGUMENTS AND REBUTTALS FOR THE MEASURES TO BE
SUBMITTED TO THE VOTERS AT THE GENERAL
MUNICIPAL ELECTION TO BE HELD ON NOVEMBER S.
1994.
WHEREAS, the City Council of the City of Newport Beach has
called and given notice of a General Municipal Election and a
Special Election to be held on November 8, 1994; and
WHEREAS, the City Council has determined to submit a proposed
amendment to the City Charter to the voters on that date; and
WHEREAS, Sections 4015.5 and 5014.5 of the Elections Code of
the State of California authorize the City Council, by majority
vote, to adopt provisions for the filing of rebuttal arguments for
City measures submitted to the voters at any general or special
municipal election.
WHEREAS, the Elections Code establishes a procedure for
selecting arguments if more than one is filed and gives the City
Council or Councilmembers priority if the argument was authorized
by the legislative body.
NOW, THEREFORE, BE IT RESOLVED, DECLARED,

ORDERED by the City Council of the City of Newport Beach as
follows:
Section 1. The City Council hereby adopts the provisions
of Section 5014.5(a) of the Elections Code of the State of
California which shall apply to the municipal election to be held
on November 8, 1994 and each ensuing municipal election unless this
Resolution is repealed by the City Council. The City Clerk is
hereby directed to strictly comply with the requirements specified
in Section 5014.5 (a) of the Elections Code.
Section 2. The Mayor is hereby authorized to sign, on
behalf of the City Council, an argument in favor of the proposed

amendment to the City Charter regarding the composition and duties
of the Library Board of Trustees and to author and sign any
rebuttal argument in the event an argument against the measure is
filed.
Section 3. The Mayor is hereby authorized and empowered to
request other members of the City Council or representatives of the
community to sign the argument in favor of the measure described in
Sections 2 and any desired rebuttal.
Section 4. All previous resolutions providing for the
filing of rebuttal arguments for City measures are hereby repealed.
Section S. That the City Clerk shall certify to the
passage and adoption of this Resolution and enter it into the book
of original resolutions.
