A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH CONFIRMING THE REPORT OF
THE FIRE AND MARINE CHIEF CONCERNING THE
COST OF THE ABATEMENT OF WEEDS AND OTHER
NUISANCES AND REQUESTING THE AUDITOR -
CONTROLLER OF ORANGE COUNTY TO ENTER THE
AMOUNT OF EACH ASSESSMENT REFERRED TO IN
SAID REPORT ON THE COUNTY TAX ROLL.
• WHEREAS, pursuant to the provisions of Chapter 10.48 of the Newport Beach
Municipal Code, entitled "Weed and Rubbish Abatement," the City Council, on the 12th
day of June, 1995, adopted Resolution 95 -55 which declared that weeds and other
conditions described therein which exist upon streets, alleys, sidewalks, parkways and
private property within the City, are a public nuisance and that said public nuisance
must be abated; set the time and place for a public hearing and consider protests from
persons objecting to the abatement of such public nuisance by the City, and directed the
Fire and Marine Chief to give notice of said hearing; and
WHEREAS, at the appointed time and place a public hearing was held by the
City Council, at which time final action was taken on all protests and the Fire and
Marine Chief was ordered to proceed with the abatement of said public nuisances; and
WHEREAS, the Fire and Marine Chief kept an account of the cost of abating
such public nuisances and has presented a report and assessment list to the City
Council for confirmation, which is attached hereto as Exhibit "A," and made a part
hereof; and
WHEREAS, notice of time and place set for public hearing by the Council on
said cost report has been duly given in accordance with all requirements of said
Chapter 10.48; and
WHEREAS, the City Council has reviewed said cost report, and no objections to
the acceptance of said work and assessment of the costs therefore were submitted to the
City Council at said hearing.
NOW, THEREFORE, BE IT RESOLVED:
Section 1. The itemized cost report of the Fire and Marine Chief of the City of
Newport Beach showing the cost of abating the public nuisances upon, or in the front or
rear of, each separate lot or parcel of land designated therein, which report is attached

hereto as Exhibit "A," and made a part hereof, is hereby confirmed, and the cost of
abating such nuisances upon, or in the front or rear of, the various lots or parcels as
confirmed shall constitute a special assessment against the respective lots or parcels of
land and shall be a lien thereon until paid.
• Section 2. The Orange County Auditor - Controller is requested to add the
assessments shown on said consolidated assessment list to the County property tax roll
as assessments against the respective parcels of land as shown therein, and the County
Tax Collector is hereby requested to collect said assessments on behalf of the City of
Newport Beach.

All affected property owners have been notified that they may appear at this hearing to
voice any objections to the report and assessments. The City Council may make such
modifications to the charges as deemed equitable. The costs will then be forwarded to
the Revenue Manager.
If the Revenue Manager is unable to collect said assessments, the uncollected amount
will then be forwarded to the County Auditor to enter the amount of the respective
assessments on the County Tax Roll opposite each parcel of land.
