RESOLUTION NO. 95- 100
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH INITIATING AMENDMENTS TO THE
NEWPORT BEACH PLACE PLANNED COMMUNITY DISTRICT
REGULATIONS AND AMENDMENTS TO CHAPTER 20.33 OF
THE NEWPORT BEACH MUNICIPAL CODE.
WHEREAS, Chapters 20.51 and 20.84 of the Newport Beach
Municipal Code provides that amendments to a planned community
development plan and the zoning code may be initiated by Resolution
of the City Council; and
WHEREAS, on August 14, 1995, the Newport Beach City Council
initiated amendments to the Newport Beach Place Planned Community
District Regulations (Newport Beach PC Text) and Chapter 20.33 of
the Newport Beach Municipal Code, which, if adopted, would prohibit
the establishment of auto repair or auto service facilities except
in conjunction with retail auto sales; and
WHEREAS, the City Council hereby instructs the Planning
Commission to conduct a public hearing on the proposed amendments
to the Newport Place PC Text and Chapter 20.33 as soon as possible.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Newport Beach that the following amendments to the Newport Place
PC Text are hereby initiated:
1. Part II, Section II, Group A (Commercial Uses) of the
Newport Place PC Text should be amended to read:
A. Automobile Center. Subiect to a Use Permit.
• 1. Automobile dealership selling only new cars. The sale of
used cars, automobile repair, and automobile detailing may be
permitted in conjunction with the sales of new vehicles but only as
accessory uses.
2. Service stations subject to the issuance of the use
permit and a finding that the use is supportive of the principal
uses permitted in the Newport Place PC Text.
• B. Table 20.33 Should be Amended So That Auto Detailing /Car
Wash is Specified as U/A in the APF & RMC Districts and vehicle
Storage should be added and specified as U/A in the APF and RSC
Districts and not allowed in the RMC District.
