A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH ESTABLISHING THE
BANNING RANCH DEVELOPMENT AGREEMENT COMMITTEE
WHEREAS, the General Plan provides that the Banning Ranch property
may be developed with a residential village, if not acquired for open space; and
WHEREAS, the Municipal Code provides that projects that require a Zoning
Code amendment and include the development of fifty or more residential units
require a development agreement; and
WHEREAS, Banning Ranch development requires a Zoning Code
amendment and could include up to 1,375 residential units; and
WHEREAS, the City and the owners of Banning Ranch desire an
agreement that outlines terms regarding annexation of the property to the City of
Newport Beach;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Newport Beach as follows:
Section 1. The City Council establishes the Banning Ranch Development
Agreement Committee, which shall be comprised of two (2) Council members,
appointed by the Mayor.
Section 2. The duties of the Committee shall be to negotiate the terms of a pre -
annexation and development agreement, which will describe development rights of
and public benefits to be provided by the developer and outline the terms for
annexation of the property to the City of Newport Beach.
Section 3. The Committee shall be an ad hoc committee, and shall sunset upon
City Council approval of the pre- annexation and development agreement, or
earlier if so decided by the City Council.
This Resolution was adopted at a regular meeting of the City Council of the City of
Newport Beach held on April 22, 2008, by the following vote, to wit:

Webb Urry Gardner, Mayor Selich
NOES, COUNCIL MEMBERS.

I, LaVonne M. Harkless, City Clerk of the City of Newport Beach, California, do
hereby certify that the whole number of members of the City Council is seven; that the foregoing
resolution, being Resolution No. 2008 -29 was duly and regularly introduced before and adopted by
the City Council of said City at a regular meeting of said Council, duly and regularly held on the
22nd day of April 2008, and that the same was so passed and adopted by the following vote, to wit:
