They were appointed by the City Council by majority vote for 4 -year terms. At the table in front are City staff members who are here to advise the Commission during the meeting. They are: KIMBERLY BRANDT, Community Development Director BRENDA WISNESKI, Deputy Community Development Director LEONIE MULVIHILL, Assistant City Attorney TONY BRINE, City Traffic Engineer MARLENE BURNS, Administrative Assistant NOTICE TO THE PUBLIC Regular meetings of the Planning Commission are held on the Thursdays preceding second and fourth Tuesdays of each month at 6:30 p.m. The agendas, minutes, and staff reports are available on the City's web site at: http: / /www.newportbeachca.gov and for public inspection in the Community Development Department, Planning Division located at 100 Civic Center Drive, during normal business hours. If you have any questions or require copies of any of the staff reports or other documentation, please contact the Community Development Department, Planning Division staff at (949) 644 -3200. This Commission is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the Commission's agenda be posted at least 72 hours in advance of each meeting and that the public be allowed to comment on agenda items before the Commission and items not on the agenda but are within the subject matter jurisdiction of the Commission. The Commission may limit public comments to a reasonable amount of time, generally three (3) minutes per person. All testimony given before the Planning Commission is recorded. It is the intention of the City of Newport Beach to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an attendee or a participant of this meeting, you will need special assistance beyond what is normally provided, the City of Newport Beach will attempt to accommodate you in every reasonable manner. APPEAL PERIOD: Use Permit, Variance, Site Plan Review, and Modification Permit applications do not become effective until 14 days following the date of approval, during which time an appeal may be filed with the City Clerk in accordance with the provisions of the Newport Beach Municipal Code. Tentative Tract Map, Tentative Parcel Map, Lot Merger, and Lot Line Adjustment applications do not become effective until 10 days following the date of approval, during which time an appeal may be filed with the City Clerk in accordance with the provisions of the Newport Beach Municipal Code. CONSENT ITEMS ITEM NO. 1 MINUTES OF JANUARY 23, 2014 Recommended Action: Approve and file VII. PUBLIC HEARING ITEMS Speakers must limit comments to three (3) minutes on all items. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues, which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. ITEM NO. 2 1000 Halyard Memory Care Facility (PA2013 -195) Site Location: 1000 Halyard Summary: A conditional use permit and site development review request for a new approximately 19,200- square- foot, two -story convalescent facility. The convalescent facility would be in the form of a memory care facility licensed by the state with 42 beds occupied by residents that are considered non - ambulatory. Access to the site will be taken from Halyard, which is a private easement. The project would occupy two building sites that are currently vacant and used as boat storage. The request also includes a lot merger to merge the two sites into one parcel for the development and a Variance for a fence to be 6 feet high where the Zoning Code limits the height to 42 inches. CEQA Compliance: The project is categorically exempt under Section 15332, of the State CEQA (California Environmental Quality Act) Guidelines - Class 32 (In -fill Development Projects). Recommended Action: 1. Conduct public hearing; and 2. Adopt Resolution No. _ approving the following: a. Conditional Use Permit No. UP2013 -019 b. Site Development Review No. SD2013 -005 c. Lot Merger No. LM2014 -001 d. Variance No. VA2014 -002 2 of 4 ITEM NO.3 Acacia Street Laboratory (PA2013 -247) Site Location: 20377 Acacia Street, Suite 200 Summary: The applicant proposes a urinalysis laboratory on the second floor of an existing two -story office building. A conditional use permit is required to allow the laboratory use. CEQA Compliance: The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Recommended Action: 1. Conduct public hearing; and 2. Adopt Resolution No. approving Conditional Use Permit No. UP2013 -028. ITEM NO.4 Uptown Newport Affordable Housing Implementation Plan Amendment (PA2014 -011) Site Location: 4311 & 4321 Jamboree Road, NIS of Jamboree Road., between Birch Street and MacArthur Boulevard Summary: Uptown Newport LP requests an amendment of an approved Affordable Housing Implementation Plan (AHIP) that is part of the approved Uptown Newport Planned Community. The Uptown Newport Planned Community consists of a mix of 1,244 residential units, retail service commercial and public parks on a 25 -acre site located northwest of the intersection of Jamboree Road and Fairchild Road. The proposed amendment would modify the timing of affordable housing construction potentially allowing all of the affordable housing to be constructed in first phase of construction. The Planning Commission will make a recommendation to the City Council for future action on this application. CEQA Compliance: All significant environmental concerns for the proposed project have been addressed in a previously certified Environmental Impact Report No. ER2012 -001 (SCH No. 2010051094), and that the City of Newport Beach intends to use said document for the above noted project, and further that there are no additional reasonable alternative or mitigation measures that should be considered in conjunction with said project. Recommended Action: 1. Conduct public hearing; and 2. Adopt Resolution No. _ recommending City Council approval of an amendment of the Uptown Newport Affordable Housing Implementation Plan. VIII. STUDY SESSION ITEM NO. 5 Lido Marina Village Study Session (PA2014 -002) Site Location: 3600 -3700 Newport Boulevard, 3400 -3444 Via Lido and 3400 -3505 Via Oporto Summary: The applicant, DJM Capital, shall present the proposed renovations for Lido Marina Village. Lido Marina Village is approximate 5.6 acre retail, office, and marina site on the Balboa Peninsula bounded to the south by Via Lido, to the west by Newport Boulevard, and to the north and east by Newport Harbor. The project consists of exterior fagade and signage improvements to existing buildings, interior tenant improvements, modification to the adjacent rights -of -way along Via Oporto and Central Avenue, and reconfiguration of the marina. Consideration of discretionary applications will not occur at this meeting, 3 of 4 IX. 0 but will occur at future, noticed public meetings. The study session will be informational only and no decisions will be made at this meeting. Recommended Action: 1. Staff recommends that the Planning Commission discuss the proposed project and provide direction to staff as necessary.
