Resolution to Approve the Submittal for a Functional Classification Change for Tustin
Avenue
At the City Council meeting of February 11, 2014, Council asked to change the functional
classification of Tustin Avenue between Santiago Drive and 23rd Street from "Collector" to
"Local" street designation on the California Road System maps. City Council approval of a
Resolution approving the submittal to Caltrans for a functional classification change is the first
step in this process.
RECOMMENDATION:
Approve Resolution No. 2014 -26, A Resolution of the City Council of the City of Newport Beach
Approving the Submittal of a Functional Classification Change for Tustin Avenue to the State of
California, Department of Transportation ( Caltrans), from Santiago Drive to 23rd Street from
"Collector" to "Local' street on the California Road System maps.
FUNDING REQUIREMENTS:
No Fiscal Impact.
DISCUSSION:
The segment of Tustin Avenue under discussion is a quarter mile in length and runs between
and connects Santiago Drive to the south and 23rd Street to the north. A change in roadway
classification from "Collector" to "Local' street will allow for a posted speed limit of 25 mph. The
approval of a Resolution is the first step in the process to re- classify Tustin Avenue.
After the approval of a Resolution by the City Council, staff will request a concurrence letter from
Orange County Transportation Authority (OCTA). Upon receipt of the concurrence letter, staff
will submit to Caltrans a package including a standard form, marked -up map, Resolution and 41
OCTA concurrence letter. The Caltrans District Coordinator will review the request for
classification change and will prepare a concurrence letter if they support the City's request.
The Caltrans letter would then be submitted to the Federal Highway Administration (FHWA) for
final approval. If approved by the FHWA, the California Road System maps will be revised.
Based on discussions with other jurisdictions, the process can take 4 -6 months. Once the City
is advised by Caltrans that the Road System maps have been revised, staff will proceed with
changing the posted speed limit from 30 mph to 25 mph.
It is anticipated that when the posted speed limit is changed to 25 mph, area residents will
petition for traffic calming on this segment of Tustin Avenue. City Council Policy L -26
"Neighborhood Traffic Management" defines the process to review a request for traffic
calming. Education and enforcement based measures are required to be in place for the first
three (3) months after a request is received. Staff will continue communication with area
residents regarding their speed concerns. If the process continues, neighborhood meetings
would then be scheduled to discuss possible improvements to Tustin Avenue.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental
Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or
reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the
activity is not a project as defined in Section 15378)of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to
the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING THE SUBMITTAL OF A
FUNCTIONAL CLASSIFICATION CHANGE FOR TUSTIN
AVENUE TO STATE OF CALIFORNIA, DEPARTMENT OF
TRANSPORTATION
WHEREAS, incorporated cities are responsible for initiating requests for
changes to the functional classification of streets and roads under their jurisdiction; and
WHEREAS, the City Council has a Policy to provide residents with
measures that can serve to alleviate traffic speed concerns; and
WHEREAS, the City Council supports the posting of a speed limit of 25
mph on Tustin Avenue between Santiago Drive and 23rd Street as a means to address
the speed concerns of residents; and
WHEREAS, the California Vehicle Code requires Tustin Avenue to be
functionally classified as a Local street on the California Road System Maps to allow for a
legal posting of 25 mph;
NOW, THEREFORE, be it resolved by the City Council of the City of
Newport Beach that it does hereby approve the submittal for a Functional Classification
Change for Tustin Avenue between Santiago Drive and 23rd Street from Collector street
designation to Local street designation to the State of California, Department of
Transportation.
