TITLE: Capital Improvement Program Budget Transfers
ABSTRACT:
The City needs to allocate Measure M2 Funds towards projects earlier than we had anticipated.
The projects will include sidewalks, curbs and gutters, the traffic analysis for the Land Use
Element update and design for a bike lane in Eastbluff.
RECOMMENDATION:
Approve Budget Amendment No. 14BA -037 appropriating $456,200 from the unappropriated
Measure M Fair Share fund (280 -3605) to Account 7282- C2001009 for the FY 13/14 Sidewalk,
Curb and Gutter project and transferring $99,800 from 7013- C2001009 (Sidewalk, Curb and
Gutter) to 7013- C3001003 (Transportation Model Maintenance) and $89,400 from 7013-
C2001009 (Sidewalk, Curb and Gutter) to 7013- C3002021 (Eastbluff Bike Lane).
FUNDING REQUIREMENTS:
Upon approval of the Budget Amendment sufficient funding is available in the current
adopted budget for this action.
DISCUSSION:
In November 2006, Orange County voters approved the extension of the original Measure M
program approved in 1990. Renewed Measure M (M2) authorizes the imposition of a one -half
cent retail transaction and use tax for a period of 30 years starting in 2011 for transportation
related improvements. In addition to funding regional and competitive projects, M2 provides
local agencies 18% of the sales tax revenue collected under a program called "Fair Share." We
use this money for local transportation related improvements.
On February 24, 2014, the Orange County Transportation Authority (OCTA) advised the City160
that initial receipts of M2 Fair Share funds distributed to the City have not been spent and are
due to expire as early as July 2014. Upon investigation, staff found that early receipts of M2
funds overlapped with OCTA's distribution of its Measure M1 funding and were not appropriated
into the Capital Program Improvement budget. Therefore, we recommend that the City Council
appropriate the M2 funds to the FY13/14 Sidewalk, Curb and Gutter project which is underway
in the Newport Heights and Lido Isle communities. Staff also requests approval to
transfer some of the supplanted funds to be used for current projects needing supplemental
funding such as traffic modeling for the Land Use Amendment update and design work for
Eastbluff Bike Lane.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental
Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or
reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the
activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to
the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item).
