Appointment of a New Water Quality /Coastal Tidelands Committee Member
Due to a resignation on the Water Quality /Coastal Tidelands Committee, the City Council may
appoint a new member pursuant to City Council Policy A -2 (Board, Commission and Committee
Appointments).
RECOMMENDATION:
Appoint Kathleen Andrews, Jamie Holmes, or Michael Melby, as recommended by the Mayor's
Ad -Hoc Appointments Committee, to the Water Quality /Coastal Tidelands Committee to fill the
unexpired balance of Laird Hayes' term which expires on January 22, 2017.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
On January 30, 2014, Water Quality /Coastal Tidelands Committee ( "Committee ") Member Laird
Hayes resigned from his seat on the Committee as a result of being appointed to the Parks,
Beaches and Recreation Commission on January 28, 2014. His term was scheduled to expire
on January 22, 2017.
Pursuant to City Council Policy A -2, the City Council's appointee to the Committee will serve Mr.
Hayes' unexpired term. Pursuant to the Maddy Act and City Council Policy A -2, the City Clerk
prepared and posted a Notice of Unscheduled Vacancies on Wednesday, February 5, 2014, in
the City Clerk's Office, at the Central Library, and on the bulletin board in the City Council
Chambers; and placed on the City's webpage. The Notice was also published in the Daily Pilot
on Saturday, February 8, 2014. As per the Notice, applications were accepted by the Cit #01
Clerk's Office until 4:00 p.m. on Wednesday, February 14, 2014. The City Clerk's Office
received three applications by the close of the application period.
Following the application deadline, the Ad -Hoc Appointments Committee requested that the
application deadline be extended to allow for more applications. The City Clerk prepared and
posted a second Notice of Unscheduled Vacancies on Monday, February 24, 2014, in the City
Clerk's Office, at the Central Library, and on the bulletin board in the City Council Chambers;
and placed on the City's webpage. The Notice was also published in the Daily Pilot on
Saturday, March 1, 2014. As per the Notice, applications were accepted by the City Clerk's
Office until 4:00 p.m. on Monday, March 17, 2014. The City Clerk's Office received seven
applications by the close of this application period.
Pursuant to City Council Policy A -2, the Mayor convened an Ad -Hoc Appointments Committee,
consisting of Mayor Rush Hill, Council Member Leslie Daigle, and Council Member Nancy
Gardner, to review the seven applications received. As a result of their review, the Ad -Hoc
Appointments Committee recommends appointing Kathleen Andrews, Jamie Holmes, or
Michael Melby to fill the unscheduled vacancy on the Committee. A copy of the three
recommended applications are attached hereto as Attachment A.
It should be noted that Michael Melby currently serves on the Land Use Element Amendment
Advisory Committee ( LUEAAC) and will need to step down from the LUEAAC if he is selected
to serve on the Water Quality /Coastal Tidelands Committee, pursuant to Council Policy A -2.
Appointment Process
Pursuant to City Council Policy A -2, appointments to the Committee will take place in the
following manner:
A. The City Council will vote on all appointments simultaneously. The voting will be done by
paper ballot and the City Clerk will tabulate and announce the results, including the vote tally.
B. Each member of the City Council will cast one vote on the paper ballot. In order to be
appointed, an applicant must receive at least four votes.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental
Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or
reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the
activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to
the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item).

1 would like to serve on this committee because I would like to be part of an effective, efficient team dealing with Newport Beach's water
issues. I feel I can contribute greatly to the group due to my professional and personal background. I worked for 20 years as an
environmental consultant to industrial companies, the military, and petroleum companies, and thus I have extensive professional
experience with surface runoff and storm water issues; metals and sedimentation; water, soil and vapor laboratory analyses, and the
associated technical reporting; and project budgets. As a resident of Newport Beach, I have participated in training programs put on by
groups such as the local State Fish and Wildlife office. I am an avid hiker and bicyclist, so I am familiar with water quality issues in Big
Canyon, Buck Gully and Upper and Lower Newport Bay. Two years ago, I replaced the landscaping in my front yard with native plants, so I
am familiar with many native plants and animals. Four years ago, I began working for the California Division of Oil, Gas and Geothermal
Resources, and as such am familiar with the oil and gas operators in the area, and their potential for impacting environmental quality.

- Love for Newport Beach: Thanks to my parents, I have been a proud resident of Newport, since I was 3 years old (now almost 33).1 have
lived, worked & surfed in various parts of the world, but I truly believe that Newport is the best place on earth.
- Desire to Contribute: I have been informally involved with ongoing city matters, since I graduated from college and moved back to
Newport, including the river dredging debacle back in '04/'05. Following graduate school, I decided it was time to get officially involved,
and so I met with Steve Rosansky several times and he encouraged me to apply for certain appropriate positions. I was subsequently
elected to the LUEAA committee, through which I have learned a considerable amount of the interworkings of the city and the various
resident interests. Following the most recent LUEAA committe meeting, Nancy Gardner informed me there was a vacancy on the Water
Quality committee and suggested I apply, given my love for the beach and eventual desire to serve on the PB &R Commission.
- Qualifications: I have extensive experience in finance, management, strategy, marketing and technology, which I can apply to Newport.
