MINUTES

1. Call Meeting to Order—The meeting was called to order at 4:05 p.m.
2. Roll Call —All CAP Members were present, with the exception of Mark Hoover.
3. Approval of Minutes — December 20, 2011 (Attachment 1)
After some discussion and changes proposed by CAP members and members of the public, CAP
Member Stratton motioned to approve the minutes as amended and the motion was seconded by
CAP Member Smith. The meeting minutes from December 20, 2011, were approved by a 4 yes to 0
no vote.
4. Current Business
a. Discussion of Code Enforcement Issues — Matt Cosylion, Code Enforcement Supervisor
Mr. Cosylion made a presentation and answered questions from CAP members and attendees
of the meeting. The PowerPoint presentation is available online at this link:

The key issues from the discussion are summarized below:
• Code enforcement is often complaint driven, however Code Enforcement staff are
proactive when time permits.
• The loud music ordinance is also applicable to residential uses; however, complaints
should be directed towards the Police Department on the nonemergency phone line.
• Harbor issues are addressed by the Harbor Resources Department and the County
Sheriff.
• Specific properties were asked about. Mr. Cosylion addressed what Code Enforcement
had done for particular properties and noted which ones to look into further.
• For health related questions, the County Health Department or Code Enforcement can
be contacted.
• Ms. Nelson made suggestions for the CAP Members to consider including determining if
the existing regulations are able to accomplish the CAP's goals and deciding if Code
Enforcement should be more proactive for certain issues.
• CAP Member Smith suggested that financial incentives be available for property owners
to maintain property and /or fix violations.
• For life safety issues, Code Enforcement works with the Building Division.
• CAP Member Pasquale asked about the citation time limits for correcting a violation. Mr.
Cosylion explained that it can vary from one day to one month, depending on the
violation, and that the officers have some discretion and try to be fair.
• The ordinances that Code Enforcement enforce are located within the City Municipal
Code. The Code Enforcement website has further information and a flyer with common
code violations.
• Questions were asked regarding garage violations, illegal dwelling units, covenants, trash
receptacles, and other general enforcement questions. Mr. Cosylion discussed the
process for various violations and mentioned that he is available to discuss these
concerns further (Code Enforcement can be reached at 949 - 644 - 3215).
• Council Member Henn reiterated that code enforcement is complaint based and he
stated that complaints are anonymous so there should be no worry about retribution.
He acknowledged that Code Enforcement is a tough job. City Council is aware of code
enforcement as an issue because it shows up in citizen surveys, and City Council has
looked into fines, timing, and other issues. The City Attorney's Office is also aware and
involved with these issues.
b. Presentation on Leavenworth, WA — Committee Member Rodheim
CAP Member Rodheim showed a few pictures and discussed Leavenworth, Washington. The
town was transformed from a blighted lumber town to a vibrant community with retail stores,
restaurants, banks, and hotels. Design plans were created to make the town into a Bavarian
Village that would bring tourism into the area. Newport Beach could similarly transform
Balboa Village through the use of design guidelines.

5. Status of Ongoing Activities— Cindy Nelson, Project Consultant
a. Branding
Gary Sherwin will sit down with the branding working group once some administrative issues
are resolved (insurance, etc.). Mr. Peyton Reed would like to join the working group. He lived
in Newport Beach for a long time. He is a former lifeguard for the City and now works in real
estate. His role can be developing concepts and presenting the City with examples.
CAP Member Stratton pointed out that any non -CAP Member on the working group would be
an extra person to help. The CAP only has an advisory role, and will be making
recommendations to the City Council for the final decisions. A member of the public said that
the residents' opinions should be represented by the CAP, not just businesses. CAP Member
Rodheim stated that he would like Balboa Village to look nice, that fewer retail establishments
may be necessary, and that he is looking forward to going to the theater locally instead of
needing to travel to Laguna Beach. A member of the public posed the question of why we
would want to attract more people to the area.
b. Parking Management Study and
C. Economic Analysis
The meetings and research are ongoing. City staff and the consultants are busy working on
strategies. KMA will present an update at the next meeting. The end result will be an
implementation plan.
6. Public Comment
• Thanks were given to those in attendance for public participation.
• A member of the public questioned if the Council resolution creating the CAP provided for the
creation of "working groups" and asked whether formal action needed to be taken by the CAP to
appoint non -CAP Members. Staff indicated that they will seek an opinion from the City
Attorney's Office and report back to the CAP.
• Concerns were addressed regarding the abatement extensions being processed through the
Community Development Department.
How will this benefit and affect the residents? Council Member Henn expressed that they would
like to maximize citizen participation and will take comments into consideration. A vibrant
Balboa Village is better for the residents in the area and the residents at large in the community.
The City would like resident input to shape the answer for a vibrant business district. The
Neighborhood Revitalization process was consciously structured for maximum participation.
