III. PUBLIC HEARING ITEM(S)
ITEM NO. 1. Patterson Tentative Parcel Map (PA2014-096)
506 and 506 1/2 Marigold Avenue (District 6)
Summary:
A Tentative Parcel Map application for two-unit condominium purposes. No waiver of
Title 19 (Subdivisions) development standards are proposed with this application. A
two-unit dwelling was demolished and will be replaced with a new two-unit duplex. The
Tentative Parcel Map would allow each unit to be sold individually.
Recommended Action:
1) Conduct a public hearing; and
2) Adopt Draft Zoning Administrator Resolution No. _ approving Tentative Parcel Map
No. NP2014-009 (Attachment No. ZA 1).
CEQA Compliance:
The project is categorically exempt under Section 15315, of the State CEQA
(California Environmental Quality Act) Guidelines - Class 15 (Minor Land Divisions).
ITEM NO. 2. Annual Review of a Development Agreement for Newport Harbor Lutheran
Church (PA2009-137)
798 Dover Drive (Council District 3)
Summary:
An annual review of Development Agreement No. 10 for Newport Harbor Lutheran
Church ("Church"), pursuant to Section 15.45.080 of the Municipal Code and Section
65865.1 of the California Government Code. The Development Agreement was
executed in 1997, and it vested development rights for the expansion of Church
facilities, addressed parking for the Church, and it required the conveyance of park
land to the City. The Zoning Administrator will review the Church's good faith
compliance with the provisions of the DA.
Recommended Action:
1
1) Conduct a public hearing;
2) Find the annual review exempt from the California Environmental Quality Act
("CEQA") pursuant to Section 15321 (Class 21 - Enforcement Actions by Regulatory
Agencies) of the CEQA Guidelines;
3) Find that the applicant has demonstrated good faith compliance with the terms of
the Development Agreement; and
4) Receive and file the Annual Report of the Development Agreement for Newport
Harbor Lutheran Church (Attachment No. ZA 2).
CEQA Compliance:
This annual review is exempt from the California Environmental Quality Act ("CEQA")
pursuant to Section 15321 (Enforcement Actions by Regulatory Agencies) of the
CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has
no potential to have a significant effect on the environment. This section exempts
actions by regulatory agencies to enforce or revoke a lease, permit, license, certificate,
or other entitlement for use issued, adopted, or prescribed by the regulatory agency or
enforcement of a law, general rule, standard, or objective, administered or adopted by
the regulatory agency.
ITEM NO. 3. Bos Residence Minor Use Permit (PA2014-120)
1810 W. Ocean Front (Council District 1)
Summary:
A minor use permit to allow the repair, restoration, and reconstruction of a
nonconforming 3-story residence up to 89 percent of the replacement value.
According to the applicant, the structure was being remodeled and was involuntarily
damaged as a result of a windstorm, which occurred on February 28, 2014.
Recommended Action:
1) File closed. No action required.
