MEMORANDUM
TO: Honorable Mayor and Members of the City Council

SUBJECT: UNSCHEDULED VACANCY ON THE PLANNING COMMISSION
RECOMMENDATION
1) Approve the extension of the term to June 30, 2004 (one full term plus the
remaining balance of the unexpired term); and
2) Appoint one of the two nominees (Steven Kiser or Earl McDaniel) to fill the
vacancy on the Planning Commission, which was created as a result of the
resignation of Mark Hoglund.
BACKGROUND
On January 11, 2000 the Council confirmed the nominations of Steven Kiser and Earl
McDaniel to the Planning Commission. Based on the length of time remaining on the
unexpired term, the ad hoc appointments committee consisting of Mayor Noyes, Mayor
Pro Tern Adams and Council Member O'Neil, have recommended that the term be
extended to June 30, 2004.
As per Council Policy A -2, the following is the procedure for voting on appointments to
City Commissions, Boards and Committees:
A. The Council will vote on all appointments and seats on each Board/ Commission
simultaneously. The voting will be by paper ballot and the City Clerk will
tabulate and announce the results, including the vote tally.
B. Each member of the Council will cast the number of votes as indicated on the
paper ballot for each seat from the list of the nominees. In order to be appointed,
the nominees must receive at least four votes.

C. For boards /commissions with two vacancies, if two of the nominees receive four
or more votes, they will be automatically appointed.
D. If there is a tie vote, ballots will be distributed to the Council Members to vote for
the tying candidates only.
E. In the event that no one receives four votes, nominees receiving zero or one vote
will be dropped and the Council will cast two votes from the list of the
remaining nominees and the determination will be made as previously stated.

others is the most rewarding use of a person's time. It would give me great
satisfaction to make a contribution to the people of Newport Beach by serving on the
Planning Commission. The time taken away from career and family to do volunteer work is i
t consideration, lout with my children now aged 12 and 15, and a wife who lends
of support, I can devote more time to giving something back to our community.
My specific qualifications for the position, in addition to that gained through the
_ivic Experience shown on the face page of this application, includes 17 years of
NLacticing law as transactional counsel to real estate owner and developer clients. I
,,Ave specialized in real estate throughout my career, which has led to involvement in a
%-oad range of commercial and residential projects, including office and industrial
__7dings, restaurants, shopping centers, apartment properties, condominiums and single
`anvil -y residential developments. Specific experience includes participation in the
- `itlements process for high -rise offices, restaurant and personal service businesses,
.-; analysis of the impact of land use restrictions on properties being considered for
'?velopment.
Other civic experience includes assisting in the student reading program at Harbor
view School, and 9 years of serving as a youth soccer referee.

Desire to serve as Plannine Commissioner
During my business career I have worked for several large, medium, and small Banks. I spent 4
years with the Federal Deposit Insurance Corporation as a Senior Commercial and Real Estate
credit specialist, and 6 years with Ticor Title Insurance Company as their Vice President
National Credit Manager.
In all of these capacities, I worked with and developed an understanding of Land Use issues.
Including Ownership issues, water rights, toxic regulations, Zoning requirements, tract maps,
developer agreements, city, state, local building standards and requirements, and many more.
I have negotiated, documented, and monitored many adversarial real estate agreements.
I have 9 years of community service in Newport Beach as a volunteer. Most recently, I am the
chairman of EQAC, a board member of EDC and Little Balboa Property'Owners Association.
In these capacities, I have had the opportunity to work with staff and applicants on land use
.issues which affect the quality of life in Newport Beach. Some of the major issues include The
Bonita Village Annexation, Newport Center Expansion, Airport Areas, General Plan
Amendment, the Dunes hotel construction, Down Coast Annexation, and Traffic Phasing
Ordinance.
As a Banker and business man, I have had many occasions to make difficult decisions based on
the application of facts, policy and the requirements of law and not emotions. I believe I can
bring a balance to the Commission and represent the higher good of Newport Beach.
