SUBJECT: Funding Request Submittal to the Department of Conservation
Recommendation
Adopt Resolution No. 2000 - authorizing the submittal of a Funding Request Form to the
Department of Conservation's Recycling Division.
Background
Pursuant to Section 14581(a)(4)(A) of the California Beverage Container Recycling and Litter
Reduction Act, the Department of Conservations division of Recycling is required to distribute
a total of $10,500,000 to eligible cities and counties for beverage container recycling and litter
cleanup activities during the 2000 -2001 fiscal year.
Beginning in 2000 and each year thereafter, the Department of Conservation will provide the
City a Funding Request Form, which specifies the amount of funds the City is eligible to receive.
Funding amounts for each jurisdiction are calculated by the Department of Conservation based
on each jurisdiction's respective population.
Discussion
The available funds may be used only for programs with a primary emphasis on collection and
recycling of beverage containers or litter abatement in public places or other related activities
involving the recycling of beverage containers. To receive the appropriated funds, the City must
submit a completed Funding Request Form including a description of the recycling and/or litter
reduction activities for which the funds will be expended. The City is also required to adopt a
Resolution authorizing the submittal of the Funding Request Form and designating a City official
to prepare and execute any necessary documents to implement proposed activities. Staff has
prepared both documents as required (see attachments).
The attached Funding Request Form proposes to use the funds to pay labor costs for a litter
abatement program at the Newport and Balboa Commercial Districts. The abatement areas will
include the Newport and Balboa Piers, the adjacent beach parking lots, and beach areas under
each pier. The General Services Department, Beach /Storm Drain Maintenance Division will
administer the program which involves hiring four temporary employees to work full -time shifts
during the summer months. Some of the workers will be scheduled to work weekend shifts. The

City is eligible for sufficient funding to employee the temporary workers for a period of twelve
weeks.
The Department of Conservation will issue payment at the end of the fiscal year in which the
activities are implemented (on or near June 30, 2001).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE SUBMITTAL OF A
FUNDING REQUEST FORM TO THE DEPARTMENT OF
CONSERVATION'S DIVISION OF RECYCLING.
WHEREAS, the people of the State of California have enacted the California Beverage
Container Recycling and Litter Reduction Act that provides funds to cities and counties for beverage
container recycling and litter cleanup activities; and
WHEREAS, the California Department of Conservation's Division of Recycling has been
delegated the responsibility for the administration of the program within the State, setting up necessary
procedures for cities and counties or their designees under the program; and
WHEREAS, per Section 14581 (a)(4)(E) of the California Beverage Container Recycling and
Litter Reduction Act, the eligible participant must submit the Funding Request Form by the due date
and time in order to request funds from the Department of Conservation's Division of Recycling.
NOW THEREFORE, BE IT RESOLVED that the City of Newport Beach authorizes the
submittal of the Funding Request Form to the Department of Conservation's Division of Recycling.
The General Services Director is hereby authorized and empowered to execute in the name of the City
of Newport Beach all necessary forms hereto for the purposes of securing payments and to implement
and carry out the purposes specified in the Section 14581 (a)(4)(A) of the California Beverage
Container Recycling and Litter Reduction Act and provide information regarding this program to the
Division upon request.

To quality to receive funds, each activity listed below must meet one or more of the following criteria:
(1) Primary emphasis is collection and recycling of beverage containers at large venues; public areas, residential communities or
schools.
(2) Primary emphasis is public education promoting beverage container recycling and/or litter prevention.
(3) Primary emphasis is beverage container/litter abatement in public places including community clean -up projects or other related
activities involving the recycling of beverage containers.

Districts are very high public use areas especially during the summer months, and are ideal venues for
implementing beverage container recycling. Both Districts are identified with existing signage as "Litter Free
Zones ".
