SUBJECT: UNSCHEDULED VACANCY ON THE PLANNING COMMISSION
RECOMMENDATION
Appoint one of the three nominees (Earl McDaniel, Barry Eaton or Christi Bettingen) to
fill the vacancy on the Planning Commission, which was created as a result of the
resignation of Richard Fuller. The successful applicant will fill the balance of the
unexpired term, which expires on June 30, 2003.
BACKGROUND
On April 25, 2000 the Council confirmed the nominations of Earl McDaniel, Barry Eaton
and Christi Bettingen to the Planning Commission.
As per Council Policy A -2, the following is the procedure for voting on appointments to
City Commissions, Boards and Committees:
A. The Council will vote on all appointments and seats on each Board /Commission
simultaneously. The voting will be by paper ballot and the City Clerk will
tabulate and announce the results, including the vote tally.
B. Each member of the Council will cast the number of votes as indicated on the
paper ballot for each seat from the list of the nominees. In order to be appointed,
the nominees must receive at least four votes.
C. For boards/ commissions with two vacancies, if two of the nominees receive four
or more votes, they will be automatically appointed.
D. If there is a tie vote, ballots will be distributed to the Council Members to vote for
the tying candidates only.
E. In the event that no one receives four votes, nominees receiving zero or one vote
will be dropped and the Council will cast two votes from the list of the
remaining nominees and the determination will be made as previously stated.

Orange County is a very special place to live and has been my home for over 20 years. I
am very proud to be a part of a city that has so many things to offer and would feel
; :Ir w, ioaorect; o.;be an,acEive participant. in both the.ipreservation and controlled development
of a city that remains one of the best in the country.
I feel that it is important to have a diversified board comprised of individuals that can
contribute from varied perspectives. I feel that my many years in dealing within the
media, in addition to representing major corporations as a public relations and investor
relations consultant, has given me multiple skills that could be of great value to this
position.
I am very familiar with the responsibilities and governing process involved with being
associated with a board. For nearly six years I served on the Board of Directors for
"American Women in Radio and Television" in addition to advising presidents and
CEO's of many public companies in my daily role as their investor relations specialist.
In my professional background, I have continuously exercised skills as an effective
communicator, strategic planner, decision maker, visionary, negotiator, good listener,
team player, and one that understands the needs of a company and its constituencies,
I am a hard worker and have dealt with enormous levels of responsibility both in running
my own company and having been associated with many high profile companies. Crisis
communications and knowing how to deal with the public at large, has been a part of my
job description for some time now. I am aware of the difficult position involved with the
decisions made as a planning commissioner and feel equipped to handle such challenges.
I have recently undertaken a great deal of research regarding the process involved in city
planning for my own peisonal reasons and have found it to'be quite interesting. I am
prepared to learn whatever is needed in order to serve in this position with integrity and
would love to give of my talents to the city of Newport Beach. Thank you for your time

QUALIFICATIONS AND EXPERIENCE• Please see attached 1 -page resume.
PHILOSOPHIC VIEWPOINT• I have been interested in the betterment of my
neighborhood and the City as a whole for the 26 years I have lived here -
but especially since I retired 3 years ago. I believe that the Planning
Commission could use a member with independent technical knowledge of
planning issues and procedures - particularly if it loses Commissioner
Adams to the City Council. I also believe that as wide a range of City
geographic areas as possible should be represented on the Commission. I
believe I have achieved credibility on the Environmental Quality Advisory
Committee (EQAC); and would like to remain on EQAC as the Planning
Commission's liason to it.
I believe I would bring a balanced viewpoint to the Commission, as
evidenced on one hand by my public opposition to last year's proposed
amendments to the Traffic Phasing Ordinance (TPO) (which went too far, in
my opinion); and, on the other hand, by my public support of the Four
Seasons Hotel expansion and Dunes Resort Hotel, both of which were well -
designed, spread their traffic impacts throughout the day, and represented
major enhancements to the City's budget, due to their large Transient
Occupancy Tax (TOT) generation. (I have also publically supported the
annexation of Newport Coast.) I think I can bring a well- reasoned and
thoughtful attitude to a process that I am already familiar with, and I
would welcome the opportunity to do so.

Thirty five year career in public and private city -wide and site- specific
Urban Planning, including Chief Planner or Planning Director positions in 5
Southern California Cities, 2 Planning Consultant firms and i nation -wide
Development Company; the last 20 years as the Chief Planner for the City
of Fullerton. Highlights include designing site -plans for projects
constructed from Calgary, Alberta to West Palm Beach, Florida; and author
of programs that won nation -wide recognition from HUD, 2 awards from
local Environmental groups, and 3 awards from the Orange County Section
of the American Planning Association. Also testified as an expert witness
in numerous Depositions and Trials regarding Land Use, Zoning, Hazardous
Waste, and other Environmental issues. Early retirement (age 57) in 1995.
ACTIVITIES SINCE RETIREMENT:
Board member, now President, of the 460 -home Eastbiuff Homeowners
Association. Primary author of 58 -page report analyzing gating and non -
gating solutions to severe HOA traffic problem. Named Board Member of the
Year (1997) for Orange County (Rookie Category) by the Orange County
Chapter of the Community Associations Institute. Named to the City of
Newport Beach Environmental Quality Advisory Commitee.

Desire to serve as Plannine Commissioner
During my business career I have worked for several large, medium, and small Banks. I spent 4
years with the Federal Deposit Insurance Corporation as a Senior Commercial and Real Estate
credit specialist, and 6 years with Ticor Title Insurance Company as their Vice President
National Credit Manager.
In all of these capacities, I worked with and developed an understanding of Land Use issues.
Including Ownership issues, water rights, toxic regulations, Zoning requirements, tract maps,
developer agreements, city, state, local building standards and requirements, and many more.
I have negotiated, documented, and monitored many adversarial real estate agreements.
I have 9 years of community service in Newport Beach as a volunteer. Most recently, I am the
chairman of EQAC, a board member of EDC and Little Balboa Property'Owners Association.
In these capacities, I have had the opportunity to work with staff and applicants on land use
issues which affect the quality of life in Newport Beach. Some of the major issues include The
Bonita Village Annexation, Newport Center Expansion, Airport Areas, General Plan
Amendment, the Dunes hotel construction, Down Coast Annexation, and Traffic Phasing
Ordinance.
As a Banker and business man, I have had many occasions to make difficult decisions based on
the application of facts, policy and the requirements of law and not emotions. I believe I can
bring a balance to the Commission and represent the higher good of Newport Beach.

SUBJECT: UNSCHEDULED VACANCY ON THE PLANNING COMMISSION
RECOMMENDATION
Confirm the nominations as presented by the Ad Hoc Appointments Committee to fill
the unscheduled vacancy as a result of the resignation of Richard Fuller and schedule
the appointment to be made on May 9, 2000. The successful applicant will be appointed
to fill the unexpired term, which expires on June 30, 2003.
BACKGROUND
At the Regular Meeting of February 22, 2000 the City Council accepted the resignation
of Richard Fuller from the Planning Commission effective on March 31, 2000 and
directed the City Clerk to advertise the vacancy pursuant to Council Policy A -2. Mayor
Noyes, Mayor Pro Tern Adams and Council Member O'Neil were appointed as the Ad
Hoc Appointments Committee. The City Clerk's office forwarded thirty-four (34)
applications to the Ad Hoc Appointments Committee for their review. The deadline to
apply was Thursday, March 16, 2000.
