HomeMy WebLinkAbout2014-103 - Establishing a Parking Permit System for Balboa Village (PA2014-016)RESOLUTION NO. 2014 -103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA ESTABLISHING A PARKING PERMIT SYSTEM FOR BALBOA VILLAGE (PA2014 -016) WHEREAS, Newport Beach Municipal Code ( "NBMC ") Section 12.44.120 provides, in relevant part, that in both on- street and off - street parking meter zones, a vehicle may be parked and remain parked in a parking space without payment deposit in the corresponding parking meter if the vehicle has a current valid parking meter permit issued by the City of Newport Beach ( "City ") pursuant to authorization of a City Council resolution; WHEREAS, it has been a long- standing goal of the City to revitalize Balboa Village and to expand its vibrant commercial village serving both visitors and residents; WHEREAS, in 2012, the City evaluated the area to establish policies and programs to spur economic activity and manage existing parking, which resulted in the adoption of the Balboa Village Master Plan; WHEREAS, the Balboa Village Master Plan established a comprehensive parking strategy to better manage existing parking resources and proposed the establishment of a voluntary employee permit parking program to encourage employees to park in designated areas and avoid parking in prime visitor - serving parking locations, thereby freeing up parking spaces in Balboa Village to encourage residents and visitors to visit the area; WHEREAS, the Balboa Village Master Plan established a comprehensive parking strategy to better manage existing parking resources and proposed the establishment of a non -peak season resident parking permit and a commercial parking validation program to promote increased visits to the area by residents and tourists to increase economic activity; WHEREAS, the Balboa Village Advisory Committee ( "BVAC ") held monthly public meetings between December 2013, and January 2014, that provided a forum for public participation where implementation of the Balboa Village Master Plan and the recommendations of Nelson Nygaard Consulting Associates, including establishment of a voluntary employee permit parking program, a non -peak season resident parking permit, and a commercial parking validation program were discussed; and WHEREAS, on January 8, 2014, the BVAC voted to recommend to City Council the creation of a parking permit system for Balboa Village. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: A voluntary Balboa Village Employee Parking Permit Program ('Business Parking Program ") is hereby established and shall be implemented for the Resolution No. 2014 -103 Page 2 of 4 benefit of employers and employees of businesses located within the Balboa Village Area Benefit District established by Section 12.44.029 of the Municipal Code. The Business Parking Program shall consist of the following: 1. A Balboa Village Employee Parking Permit ( "Business Parking Permit ") entitles a qualified and registered motor vehicle to occupy a single parking space located in designated parking areas during designated times without the payment of parking meter fees. 2. One (1) Business Parking Permit for each registered motor vehicle shall be issued for qualified employers or employees upon request, submittal of required information, and payment of applicable fees. Employers may apply for Business Parking Permits for themselves and each employee employed at their business located in the Balboa Village Area Benefit District. The following information shall be presented to the City to purchase a Business Parking Permit: 1) proof of employment within the Balboa Village Area Benefit District; 2) a valid California Driver's License; 3) proof of vehicle registration; and 4) vehicle license plate number. 3. The peak season is defined as the period between May 1st and September 30th of each year and the non -peak season is defined as period between October 151 and April 30th of each year. 4. During the peak season, the designated parking area is the Balboa Boulevard median between Medina Way and 8th Street and during street sweeping times, the Balboa Pier Parking Lot shall be a designated parking area. During the non - peak season, the designated parking area is the Balboa Pier Parking Lot. The City Manager or his /her designee may modify or identify other designated parking areas when necessary. 5. Business Parking Permits may be issued on an annual basis or on a seasonal basis. Annual Business Parking Permits shall be valid for twelve (12) months. Seasonal Business Parking Permits shall be valid for the season for which they are issued (e.g., peak season May 151- September 30th or non -peak season October 1st -April 30th). Annual permits may be transferred from one qualified employer or employee to another three times per year and seasonal permits shall be non - transferable. 6. A Business Parking Permit is not valid on any motor vehicle that is more than eighty -four inches (84 ") in width and /or more than eighty -four inches (84 ") in height and /or more than twenty feet (20') in length. 7. Issuance of a Business Parking Permit does not allow violation of any applicable parking regulations. 8. A Business Parking Permit does not establish any parking priority. Parking spaces are provided on a first come first serve basis and there is no Resolution No. 2014 -103 Page 3 of 4 representation or guarantee made that a parking space will be available on a given date or time. 9. To encourage employers and employees to utilize the Business Parking Program, the cost of an annual Business Parking Permit shall be fifty dollars ($50) and the cost of a seasonal Business Parking Permit shall be twenty -five dollars ($25). 10.The Business Parking Program shall be monitored periodically by the City Manager or his /her designee and may be modified if necessary to achieve the desired result, which is to encourage employers and employees to parking in designated areas and avoid parking conflicts with visitors and residents to the maximum extent practicable. Section 2: A non -peak season parking permit program allowing City residents to park in the Balboa Village Area Benefit District is hereby established ( "Resident Parking Program "). The Resident Parking Program shall consist of the following: 1. A Balboa Village Resident Parking Permit ( "Resident Parking Permit ") entitles a qualified and registered motor vehicle to occupy a single parking space in any metered parking area or any municipal parking lot within Balboa Village during the non -peak season, if a parking space is available, without paying a parking meter fee for up to two (2) hours. If a vehicle occupies a space for more than two (2) hours, the payment of applicable fees shall be required after the two (2) hour mark. 2. One (1) Resident Parking Permit for each registered motor vehicle may be issued to any City resident upon request. The following information shall be presented to purchase a permit: 1) proof of residency within the City of Newport Beach; 2) a valid California Driver's License; 3) Proof of vehicle registration; and 4) vehicle license plate number. A resident who has a valid parking permit may transfer the permit to another vehicle under their personal control one time during the period the permit remains valid. 3. A Resident Parking Permit is not valid on any motor vehicle that is more than eighty -four inches (84 ") in width and /or more than eighty -four inches (84 ") in height and /or more than twenty feet (20') in length. 4. Issuance of a Resident Parking Permit does not allow violation of any applicable parking regulations. 5. A Resident Parking Permit does not establish any parking priority. Parking spaces are provided on a first come first serve basis and there is no representation or guarantee made that a parking space will be available on a given date or time. 6. Resident Parking Permits are valid from October 1st to April 30'h of the year issued. Resolution No. 2014 -103 Page 4 of 4 The fee for a Resident Parking Permit shall be the preferential parking permit fee provided in the City's Master Fee Schedule, which may be amended from time - to -time by the City Council. Section 3: A commercial parking permit validation program is hereby established for businesses located within the Balboa Village Area Benefit District ( "Validation Program "). The Validation Program shall consist of the following: 1. Merchants within the Balboa Village Area Benefit District may provide a one (1) hour or two (2) hour validation to customers who patronize their establishment provided there is no direct cost to the City for the validation. 2. Validation shall take the form of a credit to the patron's meter payment and a corresponding payment of the credited amount paid by the merchant to the City to ensure that the full amount of the particular parking meter fee is remitted to the City. The Finance Department is authorized to take all steps necessary to implement the Validation Program. Section 4: The City Council finds that the establishment of the parking permit programs in this resolution are not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. The resolution does not authorize development or physical changes to the environment and it only establishes parking permit programs within developed parking facilities. Section 5: The recitals provided in this resolution are true and correct and are hereby incorporated into the substantive portion of this resolution. Section 6: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
