Approval of the U.S. Army Corps of Engineers 2. Approval of -the California Coastal Commission 3. Approval by the City Building Department of the plans and specifications for the deck and support piles. Discussion: This application is before the City Council as required by Sections 5.B and Section 5.C.4 of the Harbor Permit Policies, which state: 5.B. "Prior approval of the City Council will be required before the Marine Department may issue any permit that does not conform to standard drawings and the adopted Harbor Permit Policies." 5.C.4. "Prior approval of the City Council will also be required before issuing a permit for shore -connected structures when... approved Bulkhead lines, Pierhead lines, or setback lines do not exist." In this particular location on Cove Street, there are five residences that face the waters of the Bay. In the past, four of these residences have built a concrete bulkhead bayward of their homes. The applicant's residence is the last of the five on the corner of Cove Street and Fernleaf. They do not have a bulkhead in front of their property and wish at this time to construct a wooden deck on piles approximately the same distance bayward of their residence as the adjacent bulkheads. The structure will be totally over private property. It will not encroach into public property although it is in an area where the waters of the bay F-19 (2) ebb and flow. There is no section in the Harbor Permit Policies that deals specifically with this type of construction. The deck, if built, however, will not affect public beaches nor will it encroach on public property. It is not a cantilevered deck. It will be a pier built.on concrete pilings and it will be totally on private property. The Marine Department will have available at the Council meeting an aerial photograph showing the existing situation with information as to the appearance of the proposed structure in relation to the adjacent properties.
