Bludau, City Manager DATE: November 27, 2001 SUBJECT: Appointment of Council Subcommittee Regarding American Legion Lease Negotiations RECOMMENDED ACTION: 1. Have the City Council create an American Legion Lease Council Subcommittee by Resolution 2. Have Council appoint two of its members to the Subcommittee EXECUTIVE SUMMARY: American Legion Post 291 has operated a clubhouse and 50 -slip marina with dry dock spaces at 215 15th Street since September 2, 1940. The current lease, entered into on March 10, 1975 and amended in August 2000 and October 2000, expires on March 15, 2002. Your Council approved a one -year extension to the American Legion Lease Agreement on October 25, 1999 due to uncertainty about the proposed uses of the remainder of the City-owned or managed parcel upon which the Legion's clubhouse sits. The parcel includes the Marinapark mobile home park. In the meantime, your Council approved a Lease Extension with the Marinapark residents that extended their tenancy to March 15, 2002. BACKGROUND: American Legion Post 291's history in Newport Beach dates back to January 1924, when Newport -area veterans from the Santa Ana Post decided to break off and form their own structure in Newport Beach. Post 291 raised money for the purchase of a permanent meeting site by holding Sunday dances at the Balboa Pavilion in the 1920s. Later it purchased a bayside site on 10th Street. City Hall • 3300 Newport Boulevard • Post Office Box 1768 • Newport Beach, California 92659 -1768 Appointment of Council Subcommittee Regarding American Legion Lease Negotiations Page 2 When road improvements imEacted the 10th Street site, the City and the Legion signed a lease for the 215 15 Street site on September 2, 1940. Construction of the current meeting hall began in 1949. The 1940 Lease was later extended in February 1951 and again in March 1975. The premises under lease include: • a clubhouse and bar • shower and restroom facilities • 34 boat lockers . 47 dry storage spaces • a 62 space parking lot • 50 wet slips • a hoist dock • 43 racks for dinghy storage The rent schedule generates about $105,000 a year to the City. Resolution No. 2001- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING AN AMERICAN LEGION SITE LEASE SUBCOMMITTEE WHEREAS, the American Legion Post 291 occupies a site owned by the City; and WHEREAS, the current lease between the City and the American Legion Post 291 expires March 15, 2002. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Newport Beach hereby establishes the American Legion Site Lease Council Subcommittee which will consist of two Council Members. BE IT FURTHER RESOLVED that said Committee is charged with the following duties and responsibilities: 1. Meeting with representatives from the Newport Beach American Legion Post 291; and 2. Making recommendation to the City Council on future lease terms and conditions. BE IT FURTHER RESOLVED that said Committee shall automatically cease to exist at such time as the next American Legion lease agreement is approved by the City Council. ADOPTED this day of 2001.
