SUBJECT: Appointments to the Newport Coast Advisory Committee
RECOMMENDED Appoint the following individuals to the Newport Coast Advisory Committee:
ACTION: Mr. Jim McGee

Mr. Al Willinger

and
BACKGROUND: As a part of the City's discussion with the residents of the Newport Coast who
. organized themselves into the Newport Coast Committee of 2000 (NCC2K), the
City agreed to form a committee to advise the City Council on matters of
importance to the Newport Coast community, including:
• Whether or not to place a community center in the Newport Coast; and, if so,
• The location, design, and use of the community center;
• The apportionment of $18 million in assessment district relief to the residents
of the Newport Coast who pay into Assessment Districts 88 -1 and 92 -1;
• The maintenance of certain slopes, medians, and parks in the Newport Coast;
and
• Any other matters of importance to the Newport Coast community in the
months and years following annexation.
Your City Council formed the Newport Coast Advisory Committee (NCAC) on
September 25, 2001 (see Committee responsibilities in Attachment A). The
Orange County Local Agency Formation Commission (LAFCO) certified and
recorded the Newport Coast annexation (No. CA01 -06) on November 28, 2001.
NCAC membership is directed to be seven people, all residents of the Newport
Coast. One of the members is to be the city council member whose district
includes the Newport Coast (the residency requirement does not apply to the
Council member seat). The NCC2K appoints four members with the City
Council the remaining three, including any Council Member appointees. Terms
are for three years, with two of the NCC2K's four appointments authorized to
• serve two consecutive three -year terms.
The NCC2K has told us that it will name the following individuals to the NCAC
for NCC2K's four appointments:
Mr. Jim McGee, a resident of the Newport Coast
Mr. Gerry Ross, a resident of the Newport Coast
Mr. Daniel Wampole, a resident of Newport Ridge
Mr. Al Willinger, a resident of the Newport Coast
The City Clerk advertised for applications for the City - appointive positions, with
the deadline being November 30, 2001. We also told attendees at the Newport
Coast Community Meeting (held October 10, 2001) about the Committee and had
applications with us at the Meeting.
We received five applications (Attachment B) on or before the deadline. The
Council's action that formed the NCAC allows the Mayor to appoint the City's
three appointive positions, with the City Council formally ratifying the action.
The Council's appointments will include Council Member John Heffernan, thus
allowing the Council to make two appointments from these five applicants:
Mr. Philip Bettencourt, a resident of the Newport Coast
Mr. Jack Butefish, a resident of Newport Ridge
Mr. Steven Fink, a resident of Newport Ridge
Mr. Donald Phelps, a resident of Newport Ridge
Mr. Robert Wilmoth, a resident of the Newport Coast
All meetings of the NCAC will be open to the public and operate via a published
agenda. We will make every effort to hold NCAC meetings in the Newport
Coast community - probably at Newport Coast Elementary. The NCAC's first
meeting date is set for:

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH
RELATING TO THE FORMATION OF THE
NEWPORT COAST ADVISORY COMMITTEE
WHEREAS, the Newport Coast community is a 7,799 -acre area within Newport
Beach's easternmost sphere of influence; and
WHEREAS, in Fall 2001, the Newport Coast community contains about 3,000
dwelling units and about 7,000 residents; and
WHEREAS, the City of Newport Beach has received the permission of the
Orange County Local Agency Formation Commission (OC LAFCO) to annex the
Newport Coast community pending a protest period and the satisfaction of certain
terms and conditions; and
WHEREAS, as a part of the annexation process, the City Council has agreed to
create a seven - member resident -based committee called the Newport Coast
Advisory Committee (NCAC) to advise the City Council in matters of importance to
the Newport Coast community; and
• WHEREAS, the City Council has agreed to structure the NCAC in a manner
that allows the Newport Coast Committee of 2000 to appoint four members to the
NCAC, with the City Council appointing three members including one or more
members of the City Council whose district includes the Newport Coast; and
WHEREAS, the NCAC is intended — at least initially — to address issues such as
the placement of a community center in the Newport Coast, a payment to refund (in
part) certain assessment district obligations in the Newport Coast, the City's
maintenance of specified slopes and medians in the Newport Coast, and more; now,
therefore be it
RESOLVED by the City Council of the City of Newport Beach that it hereby
forms the Newport Coast Advisory Committee to advise the City Council
regarding issues of importance to the Newport Coast community; and
BE IT FURTHER RESOLVED by the City Council of the City of Newport
Beach that the NCAC shall have the term, membership, staffing, and duties as
described in Exhibit A to this Resolution. The information in Exhibit A shall be
included within the City's Boards, Commissions, and Committees Manual under
Section V of the Manual.

NEWPORT COAST ADVISORY COMMITTEE
AUTHORIZATION: Established by Resolution 2001 adopted on September 25,
2001.
MEMBERSHIP: Seven members of the Newport Coast community, appointed as
follows:
• Terms shall be for three years.
• Four of the members shall be appointed by the Newport
Coast Committee of 2000 or, if the NCC2K ceases to exist,
the Master Homeowners' Associations in the Newport
Coast. Two of the four members shall be appointed to
"double -term" positions, meaning up to six years.
• Three of the members shall be appointed by the City Council
from an applicant pool. The council member(s) representing
the Newport Coast community shall make up one, two, or
all three of the Mayo's appointments. The Mayor shall
make his or her appointments from applicants who reside in
the Newport Coast. If the Council Member representing the
Newport Coast does not reside in the Newport Coast, this
council member's appointment shall be an exception to the
Newport Coast resident -only qualification for this
committees membership.
• Three consecutive unexcused absences by a committee
member shall disqualify that Committee member from the
NCAC. A vacancy from the City Council's appointments
shall be replaced by the City Council. A vacancy by the
NCC2K /Master HOAs' appointments shall be replaced by
the NCC2K /Master HOA.
Committee support shall come from the City Managers Office
and the City Attorney's Office. All meetings shall be open and
public and subject to the Brown Act.
TERM: The Committees term shall be six (6) years or the cessation of
annexation proceedings (Annexation #CA01 -06) at the time that
the LAFCO executive officer deems Annexation #CA01 -06) not
complete or withdrawn.

PURPOSE &
RESPONSIBILITIES:
A. Advise the City Council - Advise the City Council on any
matter of importance to the Newport Coast community not listed
herein.
B. Community Center - Advise the City Council on the Newport
Coast community's interest (or lack thereof) in the placement of a
community center in the Newport Coast. Advise the City
Council on the location, design, and use of the Community
Center.
C. Assessment District Relief - Advise the City Council on the
equitable allocation of approximately $18 million in assessment
district relief to owners and occupiers of single - family homes in
the Newport Coast.
D. SIope, Park, and Median Maintenance - Advise the City
Council regarding the maintenance of slopes, medians, and parks
within the Newport Coast. Advise the City Council of the
quality and standards of such maintenance.

I have been active in community affairs and homeowner issues for over 30 years in three
California cities (Santa Barbara, Santa Monica and Newport Beach).
I was the founder of The Santa Barbara International Jazz Festival and a founder of the
Santa Monica Police Activities League (PAL) and have served on the Newport Coast
Committee of 2000 for over 3 years. In that connection, I am attending the Newport
Beach Citizen's Police Academy to learn more about the police department that will be
serving Newport Coast after annexation in January 2002.
I am a member of the Balboa Yacht Club and the Catalina Island Conservancy.
I support the annexation of Newport Coast to the City of Newport Beach
Service on the to be named Newport Coast Advisory Committee would allow me to focus
my background in civic affairs and my local knowledge on the continued orderly growth
of our combined communities.

PHILIP BETTENCOURT
Philip Bettencourt is an independent real estate developer and land development
consultant and owner of Bettencourt & Associates of Newport Beach, California.
Bettencourt's firm provides land development acquisition and analysis as well as
governmental entitlement to use services for builder clients. Mr. Bettencourt's clients include
such leading California community builders as Fieldstone Communities, Inc., Rossmoor
Partners, L.P., Taylor Woodrow Homes, Inc. and Laguna Niguel Development, Inc. He
is a director and president at Cortese Properties, Inc., the Leisure World retirement
communities' development successor.
His more than two decades of experience in real estate planning and development
includes executive positions with Coleman Homes, Akins Development Company,
Texaco - Anaheim Hills, Inc., and The Irvine Company. In addition, he is the former
interim City Manager and real property manager for the City of Newport Beach.
Philip is a past president of the 900- member Orange County region of the Building
Industry Association of Southern California (BIA/SC) and the former executive director of
the region. He was the founding president of the BIA of Kern County, California.
He has taught real estate site and marketing analysis at the University of California,
Irvine and has lectured and written extensively on land use and public policy.
Bettencourt is a public administration graduate of California State University at
Long Beach. He is a former director of the National Association of Home Builders
( "NAHB ") and a member of the Urban Land Institute, Big Canyon Country Club, and the
Newport Harbor Area Chamber of Commerce. Philip is a former member of the City of
Irvine Transportation Authority, the Newport Beach City Council Ad Hoc Economic
Development Committee, and the Orange County Charter Commission. He is a member
of the Restoration Advisory Board for the U.S. Naval Weapons Station, Seal Beach.
Philip and his wife Diane and daughter Amanda reside on the Newport Coast, where
Philip is president of the 1,500 homes Newport Coast Community Association and vice

JACK A BUTEFISH
Mr. Butefish is founder and President of Special Events, Inc. (SEI) a
sports marketing, advertising and promotion company (formerly Group
Dynamics Inc. Santa Monica California, a corporation he founded and
directed for over 20 years).
SEI operates events for it's own account as well as participating in joint
ventures in the sports and entertainment field.
Joining the early efforts to establish a professional tour for women's
tennis, Mr. Butefish created 6 Women's Tennis Association Tour events
. in the US and Japan. He has directed more than 50 international
women's professional tennis tournaments including the creation of the
Women's World Doubles Championship. For 12 years Mr. Butefish
served on the Women's International Professional Tennis Council.
Mr. Butefish guided the restructuring of the Professional Beach
Volleyball Association (AVP) and brought key sponsors to the sport. In
a three -year period he expanded the tour and increased sponsorship
and prize money by 500 %.
In the music area of promotion, Mr. Butefish produced four annual jazz
festivals in Japan for the Toshiba Company's Aurex Home
Entertainment Division. The 1983 Aurex Jazz Festival still holds the
world attendance record for a single day crowd for a jazz festival
(65,000 fans at the Yokohama Baseball Stadium).

Continuing with his interest in music, Mr. Butefish in 1989 established
the Santa Barbara International Jazz Festival and directed the event for
10 years. The event was sold in 1998 to local interests.
Mr. Butefish has been active in sales and marketing since he joined the
foreign division of CitiGroup, New York and later with the Bank of
America International Banking Headquarters, San Francisco.
During his tour with these banks he spent more than three years in
Latin America managing local branch public relations and advertising
campaigns.
Mr. Butefish graduated from the University of California, Santa
Barbara and received his graduate degree in International Business
from the Thunderbird Graduate School of International Management,
Phoenix Arizona. He speaks fluent Spanish.
He lives in Newport Coast California with his wife Robin ( the former
Robin Whyte).

ADVISORY CONMUTTEE
As Group General Counsel for the Dial Corp, I designed and implemented corporate and civic programs
working with government agencies, legislative bodies and other corporate members of the
business community. I received recognition from the Arizona Senate for service and
contributions for reform of Judicial Selection, and from the corporate community for the
successful passage of the Arizona Corporate Takeover Legislation.
If appointed to the NCAC I believe my background, coupled with the time I can devote to
Committee, and my desire to see the annexation be a positive step forward for both Newport
Coast and Newport Beach, would be a benefit to both communities, soon to be one.

I am writing to ask that I be appointed to the Newport Coast Advisory
Committee
The widespread support for a vote on annexation from all residents of Newport
Coast, registered and unregistered voters alike, deafly shows that the Committee of 2000 does
not represent all the residents of the community and Is either unable or unwilling to take the
steps necessary to communicate with a majority of the people who live in our community. On the
other hand, our ability to mobilize neighbors and collect almost 1,000 signatures in a little more
than two weeks, shows that we do have the ear of the community. This is a sizable constituency
which has been disregarded and disenfranchised by the Committee of 2000 leadership.
It is my goal to bring those people into the process, to act as a conduit between
this large segment of the community and its new government. I believe that I have the
experience, expertise and relationship with the community to fill that role and help champion the
concerns of my neighbors and neighborhoods. And, while many of us disagreed with the process
of annexation, perhaps more than the concept, I believe that It is now essential far the City of
Newport Beach to adopt a policy of Inclusion, assuring that all residents of Newport Coast feel
represented and comfortable with Its new government. I, humbly, believe that my inclusion on
the Advisory Committee will enhance that prod.
I look forward to being appointed to the Advisory Committee and to working with
you and the entire City Council to make Newport Coast an integral part of the City of Newport
Beach.
