Your area has been identified by the homeowners association as one that needs dredging and we are currently scheduled to do this project the week of May 12. In conversation with the contractor, he will be there by May 13, but could begin on May 12. In order for this to be accomplished, it will be necessary for you to temporarily relocate your vessel during this dredging project until May 17. If you have no place to put the vessel, please let us know and we will let the O.C. Harbor Patrol provide an off shore mooring for you. RATIONALE: The proposed lobe area will not require additional pilings beyond the number necessary to support the dock without the lobe area. No eelgrass is present at the project site. In addition, the proposed development will not adversely impact coastal resources, public access, or public recreational opportunities, and is consistent with the City's certified Land Use Plan, past Commission actions in the area, and the Chapter 3 policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their April 13-16, 1999 meeting and the site of the proposed development has been appropriately noticed, pursuant to 13054(b) of the California Code of Regulations. The problem concerns the docking rights between 125 and 127 East Bay Front on Little Balboa Island. The present owner of 127, Glenn Lewis, has docked a Coronado 35 on the south side of the dock. In this po- sition, a major part of the boat encroaches on our property. Since September, 1975, we have attempted to resolve the problem through discussions with the Lewises and through meetings with the Marine Department of Newport Beach. However, despite our efforts, the boat remains as an encroachment on our property. Below, we have summarized the meetings and discussions which have taken place over the last seventeen months. We had discussed the matter of boat encroachment with the former owners at 127 East Bay Front, Mr. Loui Ihrig. Mr. Ihrig formerly docked a small runabout on the south side, finally had a Coronado 35 docked on the south side. An agreement was made with Mr. Ihrig that the Coronado 35 could remain temporarily, but that when its owner moved it, no other boat would be docked there. This concession was on our part, perhaps more I ib- eral than it should have been, and was an attempt to maintain good relations with our neighbor. However, the sale of the property completely changed this picture as far as we were concerned. While the property was still in escrow, we asked Mr. lhrig, the former owner, if the Lewises had been notified of the dock situation and of the status of the Coronado 35. Mr. Ihrig assured me that the Lewises had been advised and were fully cognizant of the dock's limita- tions. On November 1. 1976, a meeting was arranged among the Lewises, Mr. Glen Welden of the Marine Department and ourselves. At this meeting Mr. Welden reviewed the general policies of the City of Newport Beach regarding the use of the piers. In particular, he noted that boats must be docked within the extension of the owner's property lines and must not encroach on adjoining properties. On November 16, 1976, Mr. Glen Lewis indicated that he would dis- cuss the status of the encroaching boat with Mr. Bleeker, the boat's owner. On December 6, 1976, we inquired of Mr. Lewis as to the progress in disposition of the encroaching boat. Mr. Lewis would make no commitment. Further informal approach to Mr. Lewis was made on January 9 of this year. Mr. Lewis indicated that he had been "too busy" to do anything about the problem. On January 25, Mr. Lewis saw me relative to moving the Coronado 35, indicating that he had met with city officials and that the boat would have to be moved. Ole No date for its moving was established at that time, however. We then dropped a note to the Lewises, indicating that the moving should be concluded by the middle of the month - February 15th. On Saturday, February 12, Mr. Lewis indicated to me that it would be impossible to move the boat, since dredging on the north portion of his dock could not be done for 60 days - due to commitment of Shel [maker Dredging to other projects in West Newport. On February 17, 1 talked to Mr. Harshbarger of the Marine Department. He indicated that he had contacted the Lewises and that the boat would be moved Sunday, February 20. The boat was not moved. in accordance with the stated policy of the Marine Department of the City of Newport Beach, we feel it is incumbent upon the Lewises to vacate the encroached space as soon as possible. Their apparent reluctance to have Mr. Bleeker remove his boat from the encroached space cannot be understood or accepted. We would appreciate your prompt consideration of this matter. Mr. Derby of the firm Gill'is & Derby looked at the pier on 4141'arch 6 and stated that he -would build such a pier for $1150. The firm. Webb, City Engineer of Newport Beach,�he mentioned that you called on him recently concerning the pier on East Bay. Mr. Webb told me that we should, if possible, agree upon the amount you are to receive -for a one-half interest�in the pier. In my review of the matter starting several months ago I ascertained from the builder of the pier the original cost and rate of depreciation. The pier was built in December, 1944, cost $1,360.87, and is considered to�have a normal life of thirty years. This amount does not include the float. It would be my imoression that the spirit of the City Council's regulations adopted in 1941 is to use original cost depreciated as the basis for fixing the consideration to be paid the original owner. The pier is maintained on public property pursuant to the terms of a revocable permit, and I believe it should not be considered as an investment on which a profit should be taken, but as a con- venience. If today's costs were lower than when the pier was built, I believe the original owner would undoubtedly maintain that original cost depreciated would be a proper basis. My calcu- lation, using the above factors, indicates that a half interest CD should be valued at $454.00. With resDect to the float - I would be very happy to discuss with you the possibility of sharing the existing facility if you deem it desirable in order to prevent additional cost at this time to bringit into agreement with the City permit. He lives at 1260 Lago Vista Drive, Beverly Hills - tele- phone, CR 6-8769. I called at their house last Saturday about 1 p.m. and found that Mr. Meyer had just left for Anaheim. I asked Mrs. Meyer if the real estate broker had informed them of my applica- tion for an interest in the pier and she answered affirmatively. She stated that they were not interested, however, in disposing of an interest in the pier. I then proceeded to relate what the permit provision is and suggested that her husband and I get to- gether and attempt to negotiate the matter. I finally met Mr. Meyer in front of our properties on Sunday morning. He appeared to be considerably shocked at my re- quest but agreed that the information I had given Mrs. Meyer seemed to be correct. He stated that Mr. Felton told him that the pier and float were private and that he need not -worry about any provisions of the permit because Mrs. Roberts, former owner of the 125 East Bay Front property, had been given an opportunity to exer- cise her option some time ago and had forfeited it. During our conversation, however, Mrs. Bray did remark that the INTar Department required Mr. Felton to ask Mrs. Roberts if she desired to have an interest in the pier and the float before the War Department would issue its permit a few years ago. Mr. Meyer stated that he desired a private pier because he wanted boat mooring facilities for both the residence and the apart- ment. He stated that there didn't seem to be any possibility of mooring four boats at this location. I explained that it never was intended that more than two boats be moored at one pier. I pointed to the two piers southerly of this one to illustrate the separate float construction that is supposed to be at the pier in question. Before concluding our conversation I asked Mr. Meyer if he would check into the matter with you at an early date. He stated that he intended to check into the case but related that he will be exceptionally busy during the next few weeks and didn't know when he could get at it. I hope I am wrong but I take this remark to intimate that he intends to stall. On work which requires the presence of an employee of the City of Newport Beach as inspector, the salary and other incidental expense of such inspection during the work shall be paid by the Permittee upon presentation of a bill therefore. 6* Protection of Traffic: Adequate provisions shall be made for the protectioH of the travelling public. Barricades shall be placed on streets, with red lights at night, also flagmen employed, all as may be required by the particularlvrork in progress. The PerTdttee shall not attempt to forbid the full and free use by the public of all navigable waters at or adjacent to the work or structure., If the display of lights and signals on any work hereby auth- orized is not otherwise provided by law, such lights and signals, as may be prescribed by Bureau of Light Houses, Department of Commerce, shall be installed and maintained at the expense of the Permittee. 7. Liability for Damages-, The Fermitt-ce is responsible for all liability for'parsonal injury or property damage which may occur through work herein permitted, and in the event, any claim is made against the City of Newport Beach or any department, officer or employee thereof, through, by reason of, or in connection with such work, Permittee shall defend, indemnify and hold them, and each of them, harmless from such claim. The City of Newport Beach shall never be held liable or obligated for any injury or damage resulting to either persons or property through the erection, 'use or possession of$ private piers. 2. The pier shall be so constructed as not to obstruct, interfere with, or prevent the free use or passage of any sidewalks, street, alley, public way or navigable channel, 3. The right given for the erection and maintenance of a pier is permissive only and the Permittee shall, upon revocation hereof, remove said pier and appurtenances thereto, within thirty (30) days after date of mailing written notice of the revocation of this permit, which notice may be mailed to the last known address of the Permittee. 4. The City of Newport Beach reserves full right, power and authority to revoke this permit, and in the event the Permittee fails to remove said pier -within the time specified,, then the City Engineer shall have the right to immediately remove same at the cost and expense of the Permittee, 5. Pleasure piers shall be constructed in accordance with Standard Plan No. for Pleasure Piers,, adopted by the City CoUnGil. Painting of Piers shall be designated by the City Engineer. 6. The Permittee shall keep the pier in good repair at all times and shall paint the pier when required to do so. Failure to repair or paint pier, when written notice has been given by the City Engineer, shall be cause for revocation of the permit and removal of the pier. 7.
