SUBJECT: MARINERS LIBRARY JOINT USE PROJECT — APPROVAL OF
COOPERATIVE AND EXCHANGE OF REAL PROPERTY AGREEMENTS,
NOTICE OF EXEMPTION, AND RESOLUTION NO. 2002 -_ AUTHORIZING
SUBMITTAL OF GRANT APPLICATION PACKAGE
RECOMMENDATIONS:
Approve a Cooperative Agreement for the Joint Mariners Library Project with the
Newport-Mesa Unified School District and authorize the Mayor and City Clerk to execute
the Agreement.
Approve an Exchange of Real Property Agreement and Joint Escrow Instructions with
the Newport-Mesa Unified School District for the Mariners Library Project and authorize
the Mayor and City Clerk to execute the Agreement.
3. Approve Notice of Exemption.
4. Adopt Resolution No. 2002 - certifying the project budget, local funding commitment,
supplemental funds, and public library operation of the Joint Mariners Library Project
between the City of Newport Beach and the Newport-Mesa Unified School District.
Background:
On November 27, 2001, a proposal was presented to City Council regarding joint use of a new
library located near Mariners Elementary School. The proposal detailed a new Mariners Branch
Library, which would be designed to serve both as the Mariners Branch Library and the school
library for the Mariners Elementary School of the Newport-Mesa Unified School District, providing
enhanced services for both the community and the school. The new Mariners Library would be
relocated on the same site, but adjacent to Mariners School to provide direct student access to
the Library through a separate Children's Room entrance. The current City library facility would be
demolished and combined with the Mariners School Library to provide a 15,125 square foot
combined public and school library. The parking at the current library along Dover Drive will be
retained and 50 spaces will be added in front of the new library on Irvine Avenue.
The City and the District have a unique one -time opportunity to request funding for a new library
building from the Proposition 14, Library Bond Act Fund for building public libraries. The California
Public Library Construction and Renovation Board, which has the jurisdiction for awarding these
funds, has established the highest priority for award of funding to "Joint Use" library projects which
would combine ( "co- locate ") a public library and a school library in one service unit. The project
provides an opportunity to maximize the use of public funds, with the use of State grant funds for
the building projects, and the synergy of providing joint services with public funds.

On December 11, 2001, Council authorized a Professional Services Agreement in the amount
of $104,000 with Thirtieth Street Architects, Inc., to provide a Mariners Library joint -use
conceptual plan design. This design is required to be submitted as a component of the Grant
Application package, due on June 14, 2002.
Mariners Library Design
Thirtieth Street Architects, Inc., have prepared the conceptual design products including:

• An elevation plan
• A statement of costs
• A color rendering of project
The design is for a 15,125 square foot library incorporating 3,700 square feet of Children's
Room that will service the Mariners community and provide for a separate, secure, 2,000
square foot school library during school hours. The library will be open from 9:00 a.m. to 9:00
p.m. Monday through Thursday, 9:00 a.m. to 6:00 p.m. Friday and Saturday, and closed on
Sunday.
When school is session, a rolling divider, much like an aesthetically pleasing roll -up garage
door, will secure part of the room for school use. The general public will not be allowed to
access the school library portion except through authorization by the Mariners School
Administrative Offices. After 3:00 p.m. each school day and all weekends and holidays,
summer, school breaks, and other non - school hours such as minimum days and teacher
development days the entire room will be open to full public access and operate as a cohesive
children's area. All computers in the Children's Room will be filtered for the children's use and
security cameras will monitor the area. There will be two single occupant, ADA compliant
bathrooms.
Approximately 1,700 square feet in the Children's area will be accessible to the general public
during all hours the library is open. This area will have a storytime /activities room for pre - school
children. When the divider is down, each area will share a centrally located librarian's desk.
During school hours, the District's Library Media Technician will be on site in the school library
area as well as teachers and other school personnel who accompany the students to the library.
The main section of the library will provide outstanding resources, service, and state -of -the -art
library technology. The collections will be expanded, and there is increased library space
available for comfortable youth and adult seating. Library hours will be extended and security
increased. The new library will have a Teen Center and also a well designed Community Room.
The vision for the Mariners Joint Use Library is it will serve as an essential community and
educational center. The Library will house a carefully balanced collection of materials that will
contain popular youth and adult materials to meet the diverse needs of the community. As well,
the library will provide the District with educational resources to meet the needs of the increasing
student population. The new joint branch/school Library will continue to provide the outstanding
service for which the current Mariners Branch is renowned, and the personalized school library
service of the School Media Center to students and faculty of Mariners Elementary.

Fundraising
A community based Fundraising Committee has been working round - the -clock to raise $1 million
dollars in contributions for the matching funds requirement of the grant. As of the date of this
report, the City has received $465,000 in donations and $535,000 in pledges. Funding from the
Library Bond Act Funds will provide 65 percent ($2.47 million) and remaining 35 percent ($1.33
million) for construction and operating funds are to be provided locally. Staff anticipates the total
project request will be $3.8 million.

To accommodate the relocation of the Mariners Branch Library, it will be necessary to relocate
the tennis courts next to the City of Newport Beach Fire Station, and to shift the ball fields
approximately 10 feet. The batting cages and sports equipment storage containers will also be
relocated. The estimated cost to the City is $200,000 and is not included in the itemized
amounts above.
Cooperative Agreement
The application for funding under the Library Bond Act requires both the District and City to
approve a Cooperative Agreement for joint City and District use of the Mariners Library. The
Cooperative Agreement must contain certain required information on how the joint library will
operate. The major sections of the Agreement include:
• Description of the project

• Expenditure control
• Staffing
• Joint Advisory Committee
• Library collection
• Ownership of assets
• Responsibility of facility operation
• Term and review of Agreement
• 20 year commitment for joint service

The Cooperative Agreement will not become effective until the City receives Notice of Award of
the requested funding.

Exchange Agreement
The regulations also require evidence that the site for the Library is owned or will be owned by
the applicant. While the City owns most of the site for the new joint -use library, a portion of the
building would have to cross the City and District property line to be able to place a school
entrance adjacent to the Mariners School. The attached Exchange Agreement provides that
the City will acquire approximately 19,600 square feet of School property to complete City
ownership of the library site by exchanging 19,600 square feet of City property with the District.
A site plan indicating the property to be exchanged and the current and proposed property line
is attached to the Exchange Agreement. The City will also process a lot line adjustment to
reflect the new boundary between the City and District property. The Exchange Agreement
provides that the City and District will open an escrow and file the required quitclaim deeds and
lot line adjustment with the Escrow agent. Escrow would not close and the deeds and lot line
adjustments would not be recorded until 30 days after the City receives notice of award of the
requested funds.
Environmental Review
Under the California Environmental Quality Act Implementing Guidelines (CEQA), Planning
Department Staff have determined a Notice of Exemption is appropriate for this project. Staff
has been determined that it qualifies for a categorically exemption pursuant to Section 15332
(Class 32, In -Fill Development Projects) of the CEQA Guidelines and recommends Council
approve the Notice of Exemption. The Notice of Exemption with supporting opinion is attached.
Resolution of Certification and Application
Staff is also requesting Council approval of the Resolution supporting the submittal of the Grant
Application form. The Resolution will contain the following provisions:
• A commitment to provide the local matching fund amount
• A commitment to provide supplemental funds necessary
• A commitment to operate the completed facility
• A commitment to dedicate the facility for public library direct service for a period of 40
years
• Statement that the information in the Application and supporting documents is true and
accurate

COOPERATIVE AGREEMENT
FOR THE JOINT MARINERS LIBRARY PROJECT
THIS COOPERATIVE AGREEMENT ( "Agreement'), made and entered into this
, 2002, by and between the CITY OF NEWPORT BEACH ( "City ")
and the NEWPORT -MESA UNIFIED SCHOOL DISTRICT ( "District ") is based on
following:
RECITALS
WHEREAS, City owns approximately 7.36 acres of property on the corner of Irvine
Avenue and Dover Drive ( "City Property "). Located on City Property is Mariners Park
and an approximately 9,298 square foot public library (Mariners Library"). District owns
approximately 9.87 acres of property adjoining City Property where it operates the
Mariners Elementary School, grades K through 6th ( "Mariners School ").
WHEREAS, District and City are each actively interested in grant opportunities offered
by the Library Bond Act, Education Code Section 19985 through 20011.
WHEREAS, City and District have proposed filing a joint application for "first priority"
funding under the Library Bond Act Regulations, Titles 24 CCR, Chapter 16, Article 5.1
through 5.5 and Title 5 CCR, Division 2, Chapter 3, Sections 204, 302, 20444
( "Regulations ").
WHEREAS, first priority funding is available for joint use projects with a co- located
library that houses a combined public library and public school library in a single facility.
City and District intend to apply for first priority funding to expand and relocate the
Mariners Library to also serve Mariners School.
WHEREAS, 30th Street Architects has been hired to prepare plans for a joint use library
that complies with Field Act requirements. City and District staffs have designed the
facility to provide direct access to Mariner's School and maximize security and safety for
the students and children that will use the Library. The design will provide security to
students during school hours to accommodate District obligations under the Education
Code.
WHEREAS, the Regulations require a Cooperative Agreement for joint City and District
use of the Mariners Library. The Parties have engaged in discussions regarding
funding requirements and have each made commitments to fund respective ongoing
operation costs.
WHEREAS, the Parties have reviewed and considered the provisions of the City
Charter and State law related to the exercise of land use jurisdiction over publicly
owned property and have determined that City and District are authorized to enter into
this Agreement and to exchange property to accomplish the proposed library expansion
and co- located project. The cooperative nature of this project supports City issuance of
appropriate permits and processing of required environmental and land use approvals.
WHEREAS, this Agreement is intended to memorialize the commitments of the Parties
and serves as a vehicle for monitoring the steps necessarily to complete the application
and ongoing operation and joint use of Mariners Library.
WHEREAS, the Parties are authorized to enter into the Agreement pursuant to the
provisions of Education Code Section 10900 et. seq., and Government Code Section
6500, et. seq..
WHEREAS, the Agreement is entered into consistent with the Library Bond Act and the
Regulations.
AGREEMENT
NOW, THEREFORE, in consideration of the above recitals and of the mutual covenants
and for other good and valuable consideration, the receipt and sufficiency of which is
acknowledged, the Parties agree as follows:
MARINERS LIBRARY PROJECT.
The Parties agree that the Mariners Library will consist of facilities and
improvements and offer the activities and opportunities specified in this Section:
1.1 Structure:
The Mariners Library will serve both as the Mariners Branch Library and
the school library for the Mariners Elementary School. It will be a 15,125
square feet one story library building housing a children's room, reference
desk, circulation room, public restrooms and a public meeting room. The
Children's Room will be approximately 3,700 square feet and will include
two single occupant unisex restrooms, and a children's activities room that
serves the children of the surrounding Mariners Community. A separate
"School Entrance" will provide Mariner's School students direct access to
the Children's Room during the hours that school is in session. The
Children's Room shall be designed so that a portion of the room can be
accessible only through the School Entrance during school hours as
provided in section 3.2 of this agreement. A separate teen corner will be
included in the main section of the library.
1.2 Improvements:
Onsite improvements shall include a parking area with fifty (50) spaces
and landscaping.

1.3 Functions and Activities:
The Mariners Library shall perform the functions and offer the activities
specified in Section 2.
2. DEFINITION OF ROLES AND RESPONSIBILITIES.
2.1 Establishment of Authority — The Mariners Library will remain a City
public library under the administrative control of the Board of Library
Trustees, as defined in Section 708 of the City Charter:
2.2. Free Public Library Service
Mariners Library shall be forever free to the inhabitants and non - resident
taxpayers of City, subject always to such rules, regulations, and bylaws as
may be made by the Board of Library Trustees. Any person who violates
any rule, regulations, or bylaw may be fined or excluded from the
privileges of the library. [Education Code section 18960.]
2.3 Establishment of control of expenditures
The City Council /Board of Library Trustees has exclusive control of all
expenditures of all moneys collected, donated, or appropriated for the
library as well as exclusive charge, control and custody of the building.
2.4 Staffing
The Mariners Library shall provide staff necessary to perform the public
library mission of the combined library.
The District shall employ a school library media technician to perform the
mission of the school library in the Children's Room during school hours. The
District shall be responsible for salaries and staff benefits of the Library Media
Technician and all other District/Mariners School personnel.
City shall be responsible for salaries and staff benefits of all Library
personnel employed by City.
The Mariners Library Branch Manager shall provide overall supervision all
staff, including the Library Media Technician.
Each of the Parties shall provide each other with the names and telephone
numbers of personnel that are responsible for the day -to -day operations at

the joint services to be provided under this Agreement. The list shall be
updated as needed based on personnel changes.
City and District shall comply with the requirements of State law with
respect to the fingerprinting of personnel and volunteers that may have
contact with children. All City and District employees are required to be
fingerprinted and clear criminal background check requirements prior to
employment with the City.
2.5 Joint Advisory Committee
A School Library Advisory Committee, comprised of three representatives
each from the District and the Library, will be appointed by the respective
agencies; will meet regularly, a minimum of three times during the school
year, to review the library service plan, collection development, functional
and library procedural matters, and other library administrative issues of
joint concern.
2.6 The Library Collection
Library staff will be responsible for selection of all materials appropriate to
meet the public library mission of the combined library.
Library staff and the Mariners School faculty will jointly be responsible for
the selection of all materials relevant to meet the Mariners School library
needs, working through the School Library Advisory Committee.
The Mariners School Library Collection will be integrated with the Mariners
Library Collection. ( "Joint Collection "). The identification of District
ownership of the Mariners School Library collection will continue including
new materials purchased annually by the District funds.
The Joint Collection will be part of the circulation and online catalog
system of the Newport Beach Public Library system. The specific District
requirements for materials supporting the Mariners School curriculum will
be honored.
The City library staff, with assistance of the School Library Advisory
Committee, will regularly review the children's collection and deselect
materials no longer relevant for the collection or the school curriculum.
2.7 Ownership of Assets
Ownership of all public library materials, equipment and furnishings shall
be retained by City and identified as such.

The Mariners School Library collection shall be retained by District.
All library materials, equipment, and furnishings shall be available for use
by the public, the students, and school personnel.
In the event of termination of the agreement at the end of the 20 -year
period, library materials originating from the District or purchased by
District during the 20 -year period will be returned to the District.
Library materials deselected and withdrawn from the collection will be
discarded according to the policies of the respective agency, identified as
the owner of the materials.
2.8 Library Construction Process
As available, City shall forward to District the development plans and
construction schedule for the Mariners Library. District may give
comments to City regarding the impact of the plans and schedule on the
Mariners School community. District and City shall cooperate in
implementing the final plans and schedule.
3. JOINT LIBRARY SERVICES.
3.1 The Mariners Library shall be the cultural, educational and informational
heart of the Mariners Community, providing a variety of exceptional
services for all ages, supported by state -of- the -art technology. It will be
dedicated to serving both as a public library for the community and the
school library for the students from kindergarten through sixth grade
enrolled at the Mariners School.
The Mariners Library, through the efforts of the City library staff, the
Mariners School staff and the guidance of the School Library Advisory
Committee, will provide enhanced services, including state of the art
technology and access to online resources in support of the school
curriculum and for personal enjoyment and use of the student population.
All access to online resources in the Children's Room shall be filtered.
The system of reserves shall be established for materials supporting
Mariners School, as needed, to assure that sufficient materials are
available to support the needs of the school and special school projects.
Students will be able to check -out materials in the Children's Room as
they return to their classrooms. A unique Mariners Library Card will be
issued for each Mariners student for use of the library during school hours;
and to facilitate the self check -out by individual students.

Beginning each school year the School Library Advisory Committee will
meet to discuss the school schedule for the upcoming year and shall
establish the hours use of the Children's Room will be secured for
Mariner's School students as provided below..
The Children's Room shall be designed so that the Mariner's School
students will have secured use of a school library, on those days and
during those hours of required student attendance during the school year.
Secured use of the Children's Room shall not exceed 30 hours per week
between the hours of 9 a.m. and 3 p.m. ( "Secured Use Hours "). The
Children's Room design will prevent access by the general public to a
portion of the Children's Room (approximately 1900 to 2100 square feet)
to serve as a school library to accommodate 32 students during Secured
Use Hours. All other non - student days and hours of the year including but
not limited to, holidays, school breaks, teacher development days,
minimum days and summer, the entire Children's Room shall be open to
the public.
However, general public access to the school library portion of the
Children's Room during the Secured Use Hours will be available through
the School Entrance after sign -in at the Mariner's School Administrative
Office in compliance with the Mariner's School's Visitor Policies and
Regulations.
The remaining area of the Children's Room (1600 -1800 square feet) will
remain open and accessible to the public from the main library entrance at
all times the library is open for pre - school activities and all other general
public uses

The Mariners Community Library will continue to utilize volunteers from
the community for general library use and circulation functions and
volunteers from the school /parent community for the Children's Room.
The current volunteer training and qualifications will be revised with
assistance from the Joint Advisory Committee to meet the needs of the
Children's Room.
Site Identification
The Mariners Community Library shall be sited on Irvine Boulevard,
Newport Beach.
3.6 Ownership
The City shall have sole ownership of the site, the facilities, furnishings,
equipment, and library materials, with the exception of the materials which
are integrated into the collection from the current Mariners School Library
and materials purchased annually with the allocation of funds for materials
from the District and which shall retain the District identification.
3.7 Fundinq
The Mariners Library shall be funded by the City with assistance from the
District. The City's current annual funding for Mariners Branch (FY
2002/03) is $400,000 plus a proportion of - Citywide branch library
operation costs of $1,800,000.
The District shall be responsible for continued dedicated resources to operate
a school library. Those resources include dedicated time of teachers and the
school principal to supervise and provide instruction and activities in the
Library during classroom or student visits and a Children's Room Library
Media Technician. The amount shall include the equivalent of the cost and
staff benefits for the District of approximately $100,000 /per year. The District
also agrees to continue funding allocations that become available to Mariners

School from the State collection improvement fund. Collection Improvement
funding at Mariner's School has historically averaged $20,000 per year.
If, during the period of this Agreement, the City as a response to economic
conditions reduces the funding for the Mariners Library, the contribution of
the District may be reduced by the same proportion.
4. RESPONSIBILITY OF FACILITY OPERATION,
The City assumes full responsibility for operation, maintenance and management
of the Mariners Library under the administration of the Board of Library Trustees.
The District's Board Policies and Regulations regarding student attendance and
release from school and visitors on school campuses during school hours shall
apply use of the Children's Room, by students of Mariners School.
5. REVIEW OF AGREEMENT.
The term of this Agreement is for 20- years. The agreement will be reviewed each
five years by the School Library Advisory Committee. Proposed amendments to
the contract shall be approved by both the City Council and District Board of
Trustees.
6. FIELD ACT.
Parties have agreed the architectural design and construction standards of the
Field Act are applicable to this project. As part of the joint program, the Children's
Room and the Community Meeting Room will serve as classrooms for the
students, and for student groups of 24 or more during school hours.
7. 20 -YEAR COMMITMENT FOR JOINT SERVICE.
Both the City and the District commit to providing joint use library services in the
facility for a period of 20 years under the terms of this Agreement.
8. 40 -YEAR COMMITMENT FOR PUBLIC LIBRARY SERVICE.
It is acknowledged, as incorporated on Education Code 19999 and section 20440
(e) (3) (G), that the City is to provide public library direct services from this facility
for a period of 40 years.
9. PROJECT APPROVAL CEQA COMPLIANCE.
The Parties agree that the Joint Mariners Library Project ("Project") will require
CEQA compliance and building and grading permits. City has prepared the

necessary environmental and planning documents and permit applications
required by and for the Project. City will waive any planning, building or grading
permit or plan check fees otherwise required of applicants for similar projects.
10. INDEMNITY.
City agrees to indemnify, hold harmless and defend District and their respective
officers, officials, employees, representatives, agents and /or volunteers from any
legal liability, or damages, for bodily injury, death and /or property damage,
reasonable costs and expenses arising out of the negligent acts or omissions of
City or its officers, employees, representatives, agents , and /or volunteer's in the
performance of City's responsibilities pursuant to this Agreement.
District agrees to indemnify, hold harmless and defend City and City's respective
officers, officials, employees, representatives, agents and/or volunteers from any
legal liability or damages for bodily injury, death and /or property damage,
reasonable costs and expenses arising out of the negligent acts or omissions of
District or its officers, employees, representatives and agents in the performance
of District's responsibilities pursuant to this Agreement.
11. COOPERATION.
The Parties acknowledge and agree to cooperate with one another in the
performance of duties pursuant to this Agreement including the prompt execution
of documents, and to provide funding and continuous operation of the Project.
12. PROJECT ADMINISTRATOR NOTICE.
The Parties have each designated "Project Administrators" to perform the duties
required by this agreement, to execute contracts and agreements on behalf of
the Parties and to ensure that all aspects of the Project are constructed,
administered or implemented in accordance with this Agreement, and the intent
of the Parties.
All notices, demands, requests or approvals to City shall be addressed to the

13. INSURANCE
13.1 District and Library shall maintain or be self insured for comprehensive,
broad form, general public liability insurance against claims and liabilities
for personal injury, death, or property damage, providing protection of at
least $1,000,000 for bodily injury or death to any one person for any one
accident or occurrence and at least $1,000,000 for property damage
occurring on their respective property.
13.2 Workers Compensation Insurance
District and City shall maintain Workers' Compensation Insurance for each
Party's own personnel as may be required by State law.
13.3 District participates in the Schools Alliance for Worker's Compensation
Excess, Self- Funded Joint Powers Authority for workers' compensation
excess insurance. The District also participates in the Southern Orange
County Property /Liability Self- Insurance Authority for casualty and
property insurance. The District shall provide all the insurance required of
the District through said programs.
13.4 City is self insured as respects general liability and automobile liability
coverage. City has a self insured retention ( "SIR ") limit of $500,000
dollars with excess coverage of $25 million dollars.
City is also self insured as respects workers compensation coverage. City
has a SIR of $300,000 dollars with statutory limits and employers' liability
excess coverage of $1 million dollars.

14. MISCELLANEOUS PROVISIONS
14.1 Term of Agreement. This Agreement shall continue in full force and effect
with respect to the Property for a period of twenty (20) years from the
Effective Date of this Agreement. This Agreement has been approved by
the Parties with the understanding that this Agreement will not be effective
until City receive notification of award of grant of the requested funding
under the Library Bond Act.
14.2 Entire Agreement. This Agreement sets forth and contains the entire
understanding and agreement of the Parties, and all oral or written
representations, understandings or agreements are expressly stated in
this Agreement. No testimony or evidence of any such representations,
understandings, or covenants shall be admissible in any proceeding or
any kind or nature to interpret or determine the terms or conditions of this
Agreement.
14.3 Severability. If any term, provision, covenant, or condition of this
Agreement is ruled invalid, void, or unenforceable by a court of competent
jurisdiction, this Agreement shall nonetheless remain in full force and
effect as to all remaining terms, provisions, covenants, and conditions.
14.4 Interpretation and Governing Law. This Agreement and any related
dispute shall be governed and interpreted in accordance with the laws of
the State of California. This Agreement shall be construed according to its
fair language and common meaning to achieve the objectives and
purposes of the Parties. The rule of construction to the effect that
ambiguities are to be resolved against the drafting Party shall not be
employed in interpreting this Agreement since all Parties have been
represented by counsel.
14.5. Section Headings. All section headings and subheadings are inserted for
convenience only and shall not affect any construction or interpretation of
this Agreement.
14.6 Singular and Plural. As used herein, the singular of any word includes the
plural.
14.7 Waiver. The failure of a Party to insist upon the strict performance of any
of the provisions of this Agreement by the other Party, or the failure of a
Party to exercise its rights upon the default of the other Party, shall not
constitute a waiver of that Party s right to demand and require, at any time,
the other Party s strict compliance with the terms of this Agreement.

14.8 Third Party Beneficiaries. This Agreement is made and entered into for
the sole protection and benefit for the parties and their successors and
assigns.
14.9 Successors in Interest. The burdens of this Agreement shall be binding
upon, and the benefits of this Agreement shall inure to, all successors in
interest to the Parties to this Agreement.
14.10 Specific Performance. The Parties acknowledge that monetary damages
would be inadequate to remedy any breach of this Agreement by either
Party. Accordingly, the Parties agree that any breach of this Agreement
shall entitle the non - breaching Party to file an action for specific
performance in a court of competent jurisdiction. In no event shall either
Party be liable for monetary damages in the event of a breach of this
Agreement.
14.11 Counterparts. This Agreement may be executed by the parties in
counterparts, which counterparts shall be construed together and have the
same affect as if all of the parties had executed the same instrument.
14.12 Jurisdiction and Venue. Any action at law or in equity arising under this
Agreement or brought by any Party for the purpose of enforcing,
construing, or determining the validity of any provision of this Agreement
shall be filed and tried in the Superior Court of the County of Orange,
State of California. The Parties waive all provisions of law providing for
the filing, removal or change or venue to any other court.
14.13 Further Actions and Instruments. Each of the parties shall cooperate with
and provide reasonable assistance to the other to the extent contemplated
by this Agreement to achieve the objectives of this Agreement. Upon the
request of either party at any time, the other party shall promptly execute,
with acknowledgment or affidavit if reasonably required, and file or record
instruments and writing. The Parties shall also take any action as may be
reasonably necessary under the terms of this Agreement to carry out the
intent and to achieve the objectives of this Agreement.
14.14 Amendments in Writing /Cooperation. This Agreement may be amended
only by written consent of the parties specifically approving the
amendment and in accordance with the Government Code and
Educational Code provisions. The Parties shall cooperate in good faith
with respect to any amendment proposed in order to clarify that intent and
application of this Agreement, and shall treat any such proposal on its own
merits, and not as a basis for the introduction of unrelated matters.
14.15 Authority to Execute. Any person or persons executing this Agreement on
behalf of the City and District warrants and represents that he /she has the

authority to execute this Agreement on behalf of his/her agency and to
bind that Agency to the performance of its obligations pursuant to this
Agreement.
14.16 Notice. All notices, demands, requests or approvals to be given under this
Agreement shall be given in writing and shall be deemed served when
delivered personally or on the third business day after deposit in the
United States mail, postage prepaid, first class mail, addressed as follows:
14.17 Effective Date. This Agreement shall become effective as of the date City
receives notification of award of grant of the requested funding from the
California Public Library Construction and Renovation Board.
IN WITNESS THEREOF, the parties hereto have executed this Agreement on the

EXCHANGE OF REAL PROPERTY AGREEMENT
AND JOINT ESCROW INSTRUCTIONS
This Exchange of Real Property Agreement and Joint Escrow Instructions
( "Agreement") are entered as of the day of 2002, by and between
Newport-Mesa Unified School District ( "District ") and the City of Newport Beach
("City').
RECITALS
A. District is the owner of that certain real property identified as approximately 9.87
acres of property where it operates the Mariners Elementary School, ( "Mariners
grades K through 6th ( "Mariners School "), in the City of Newport Beach, Orange
County, California (the "School Site ") as further described in the "Legal
Description of Land" attached hereto as Exhibit "A" and incorporated herein
by reference.
B. City owns approximately 7.36 acres of property adjacent to the School Site
where it operates Mariners Park and a nine thousand (9,000) square foot public
library ( "City Site "), as further described in the Legal Description of Land
attached hereto as Exhibit "A" and incorporated herein by reference.
C. District and City are each actively interested in grant opportunities offered by the
Library Bond Act, Education Code Section 19985 through 20011.
D. City and District intend to apply for "first priority" funding under the Library Bond
Act Regulations, Titles 24 CCR, Chapter 16, Article 5.1 through 5.5 and Title 5
CCR, Division 2, Chapter 3, Sections 204, 302, 20444 ( "Regulations ").
E. First priority funding is available for joint use projects with a co- located library
that houses a combined public library and public school library in a single facility.
City and District intend to apply for first priority funding to build a new 15,000
square foot Mariners Library on the City Site adjacent to Mariners School.
F. The Parties have reviewed and considered the provisions of the City Charter,
State Government Code and State Education Code related to the exercise of
land use jurisdiction over publicly owned property and have determined that City
and District are authorized to enter into this Agreement and to exchange property
necessary to accomplish the proposed co- located library project.
G. City appraised the School Site to acquire the approximately 19,600 square feet
of School Site necessary to locate the Mariners Library next to Mariners School
to provide direct, separate access for students and faculty of Mariners School.
H. City desires to exchange approximately 19,600 square feet of property from City
Site ( "City Property') with District and District desires to exchange approximately
19,600 square feet of property from the School Site ( "School Property ") with City
on the terms and conditions provided in this Agreement.
FOR GOOD AND VALUABLE CONSIDERATION, THE RECEIPT AND ADEQUACY
OF WHICH ARE ACKNOWLEDGED, THE PARTIES AGREE AS FOLLOWS:

SECTION 1. PROPERTY EXCHANGE
District and City agrees to exchange real property to facilitate relocation of the Mariners
Library to a location on City Site adjacent to the Mariners School, subject to the terms
and conditions in this Agreement.
SECTION 2. CONSIDERATION
As consideration for the District to quitclaim 19,600 square feet of property within the
School Site to City ( "School Property'), City shall quitclaim to District 19,600 square feet
of City Site ( "City Property ") to District. The real property to be exchanged is legally
described on Exhibit "B ", and shown on Exhibit "C" and incorporated herein by
reference.
SECTION 3. ESCROW
By this Agreement, City and District agree to establish an escrow ( "Escrow ") subject to
the provisions of the standard conditions for acceptance of Escrow, but only to the
extent that the standard conditions impose no additional obligations or liabilities on the
Parties. The terms and conditions of this Agreement shall control in the case of conflict.
Escrow will be opened with a signed counterpart of this document to be delivered as
Escrow instructions to Escrow Agent.
SECTION 4. CONDITIONS TO CLOSE OF ESCROW
Within '14 days of approval of this Agreement by the governing bodies of District and
City:
A. City and District shall open an Escrow and deposit with Escrow Agent the
following documents:
(i) A Quitclaim Deed executed and acknowledged by District conveying to
City all rights, title and interest in the School Property, and
ii) A Certificate of Acceptance of City's Quitclaim Deed, executed and
acknowledged by District, to evidence the acceptance by District of
conveyance of the City Property to District pursuant to Section 27281 of
the California Government Code, as amended.
(iii) A Quitclaim Deed executed and acknowledged by City conveying to
District. All rights, title and interest in the City Property, and
(iv) A Certificate of Acceptance of District's Quitclaim Deed, executed and
acknowledged by City, to evidence the acceptance by City of conveyance
of the District Property to City pursuant to Section 27281 of the California
Government Code, as amended.
B. City shall process a lot line adjustment to adjust the property line between
the City and District Sites to reflect the exchange of property. The lot line
shall be adjusted as described and depicted in Exhibits B and C attached

hereto and incorporated herein by reference. The approved lot line
adjustment shall be deposited into Escrow prior to close of Escrow to be
recorded in accordance with the provisions of this Agreement.
C. City is obtaining a Phase I Hazardous Substance Report for City Property.
Once completed, District shall process approval of the District acquisition
of City Property from Department of Education ( "DOE ") and Department of
Toxic Substances Control ( "DTSC "). Once received, DOE and DTSC
approvals shall be deposited into escrow as a contingent to close of
escrow only.
SECTION 5. ACCESS
After execution of this Agreement, City and City's contractors and consultants
shall have access to the School Property at reasonable times upon at least five
(5) business day's notice to District. Access shall be for purposes such as
inspection, surveying and investigation. City shall indemnify and defend District
against and hold District harmless from all losses, costs, damages, liabilities, and
expenses, including without limitation, reasonable attorney fees, arising in
connection with City's inspection and investigation of the School Property.
SECTION 6. TITLE
A. City has received a preliminary report for a California Land Title Association
( "CLTA ") Owner's Policy for the School Property, setting forth all liens,
encumbrances, easements, restrictions, conditions, pending litigation,
judgments, administrative proceedings, and other matters affecting District's title
to the School Property ( "Preliminary Report"), together with copies of all
documents relating to title exceptions referred to in the Preliminary Report.
B. District has received a preliminary report for a California Land Title Association
( "CLTA ") Owner's Policy for the City Property, setting forth all liens,
encumbrances, easements, restrictions, conditions, pending litigation,
judgments, administrative proceedings, and other matters affecting City's title to
the City Property ( "Preliminary Report"), together with copies of all documents
relating to title exceptions referred to in the Preliminary Report.
C. City and District each represent they have had fourteen (14) days to review and
approve or disapprove any exceptions shown on the respective Preliminary
Report and each encroachment, overlap, or boundary line dispute, or any other
matter that materially and adversely affects title to the Property or that violates
any law, rule, or regulation (each an "Exception ") and have approved all
exceptions.
SECTION 7. CLOSE OF ESCROW
D. Closing Date. The Closing of this transaction ( "Close of Escrow ") shall take
place thirty (30) days from the date City receives notification of award of grant of

the requested funding from the California Public Library Construction and
Renovation Board.
E. On the Closing Date, Escrow Agent shall Close Escrow as follows:
(i) Verify receipt of approval from DOE and DTSC.
(ii) Record the Quitclaim Deed for District Property and Certification of
Acceptance (marked for return to City) with the Orange County Recorder
(which shall be deemed delivery to City);
(iii) Record the Quitclaim Deed for City Property; and Certification of
Acceptance (marked for return to District) with the Orange County
Recorder (which shall be deemed delivery to District)
(iv) Record the Lot Line adjustment
(v) Charge City for the respective costs and expenses to be paid by City and
District pursuant to this Agreement and disburse any funds remaining
after the preceding disbursements to the depositing Party; and
(vi) Prepare and deliver to City and District one signed copy of Escrow
Agent's closing statement showing all receipts and disbursements of the
Escrow.
F. If Escrow Agent is unable to simultaneously perform all of the instructions set
forth above, Escrow Agent shall notify City and District and retain all funds and
documents pending receipt of further instructions jointly issued by City and
District.
G. Prorations. City and District shall deposit to Escrow the following costs 14 days
before the Close of Escrow:
(i) District shall pay all governmental conveyancing fees and taxes (if there
are any) due upon transfer of the School Property; and
(ii) City shall pay:
(a) all governmental conveyancing fees and taxes (if there are any)
due upon transfer of the City Property; and
(b) the recording charges in connection with recordation of the
Quitclaim Deeds and Certificates of Acceptance;
(c) the escrow fee charged by Escrow Agent;
(iii) Real Estate Taxes, Bonds and Assessments. No taxes will be owed as
part of this transaction as the exchange will be documented by a lot line

adjustment that results in same land area for School site and City site,
recorded in office the Orange County recorder and County assessor.
SECTION 8.
Each party shall deliver possession of the property to be exchanged to the other upon
Close of Escrow,
SECTION 9. DISTRICT REPRESENTATIONS AND WARRANTIES
A. District makes the following representations, covenants and warranties and
acknowledges that City will rely on such representations, covenants, and
warranties in acquiring the School Property, each of which shall survive the
Closing:
(i) District holds title to an indefeasible estate in fee simple in the School
Property. District is the sole owner of the School Property and has good,
absolute and marketable title to the School Property. The School
Property is not subject to any unrecorded instruments or agreements
affecting title to or the use or possession of the School Property and no
other person claims or has claimed title to or the use of possession of the
School Property, any part thereof or interest therein, or any right thereto
not reflected in the public record. District will forever defend the title to the
School Property against the claims of any third parties.
(ii) This Agreement and all other instruments and documents delivered by
District to City now or at the Close of Escrow have been or will be duly
authorized, executed and delivered by District and are or will be the legal,
valid and binding obligations of District, sufficient to convey to City good,
absolute and marketable title to the School Property and are enforceable
in accordance with their respective terms.
(iii) Hazardous Substances.
(a) To District's knowledge, the School Property is free from
Hazardous Substances and is not and has never been in violation
of any Environmental Laws.
(b) To District's knowledge, no toxic or hazardous chemicals, waste, or
substances of any kind have ever been spilled, disposed of, or
stored on, under, or at the School Property, whether by accident,
burying, drainage, or storage in containers, tanks, or holding areas,
or by any other means.
(c) To District's knowledge, the School Property has never been used
as a dump or landfill.
(d) District has disclosed to City all information, records, and studies
maintained by District in connection with the School Property
concerning Hazardous Substances.

(iv) Leases. No leases, licenses, or other agreements allowing any third party
rights to use the School Property are, or will be, in force.
(v) Litigation. There is no pending or threatened litigation, administrative
proceedings, or other governmental action with respect to the School
Property.
(vi) Condition of School Property. To District's knowledge, there are no
natural or artificial conditions upon the School Property or any part of the
School Property that could result in a material and adverse change in the
condition of the School Property.
(vii) Disclosure. Any information that District has delivered to City, either
directly or through District's agents, is accurate to the best of District's
knowledge and District has disclosed all material facts in District's actual
knowledge with respect to the School Property.
B. District shall notify City of any facts that would cause any of the representations
contained in this Agreement to be untrue on or before the Close of Escrow. The
City's consummation of this Agreement is in reliance upon the representations of
District made prior to the Close of Escrow. If City reasonably concludes that a
fact materially and adversely affects the School Property, City shall have the
option to terminate this Agreement by delivering written notice to District and
Escrow Agent.
C. District agrees to indemnify City and agrees to defend and hold City harmless
from all loss, cost, liability, expense, damage, or other injury, including without
limitation, attorney fees and expenses, to the fullest extent not prohibited by
applicable law, and all other costs and expenses incurred by reason of, or in any
manner resulting from the breach of any warranties and representations made by
District as expressly limited in this Section 9 to the extent of District's actual
knowledge and without any independent investigation by District.
SECTION 10. DISTRICT COVENANTS
Commencing with the full execution of this Agreement by both Parties and until the
Close of Escrow:
A. District shall not permit any liens, encumbrances, lease, tenancy, rights of
possession or easements to be placed on the School Property, other than the
Approved Exceptions, nor shall District enter into any agreement regarding the
sale, rental, management, repair, improvement, or any other matter affecting the
School Property that would be binding on City or the School Property after the
Close of Escrow without the prior written consent of City.
B. District shall not permit any act of waste or act that would tend to diminish the
value of the School Property for any reason, except that caused by ordinary wear
and tear.

SECTION 11. CITY REPRESENTATIONS AND WARRANTIES
A. City makes the following representations, covenants and warranties and
acknowledges that District will rely on such representations, covenants, and
warranties in acquiring the City Property, each of which shall survive the Closing:
(i) City holds title to an indefeasible estate in fee simple in the City Property.
City is the sole owner of the City Property and has good, absolute and
marketable title to the City Property. The City Property is not subject to
any unrecorded instruments or agreements affecting title to or the use or
possession of the City Property and no other person claims or has
claimed title to or the use of possession of the City Property, any part
thereof or interest therein, or any right thereto not reflected in the public

claims of any third parties.

(v) Litigation. There is no pending or threatened litigation, administrative
proceedings, or other governmental action with respect to the City
Property.
(vi) Condition of City Property. To City's knowledge, there are no natural or
artificial conditions upon the City Property or any part of the City Property

that could result in a material and adverse change in the condition of the
City Property.
(vii) Disclosure. Any information that City has delivered to District, either
directly or through City's agents, is accurate to the best of City's
knowledge and City has disclosed all material facts in City's actual
knowledge with respect to the City Property.

Property that would be binding on School or the City Property after the Close of
Escrow without the prior written consent of District.

SECTION 13. AUTHORITY OF PARTIES
Each Party warrants and represents for itself:
A. Each Party has the legal power, right and authority to enter into this Agreement
and the instruments referenced herein, and to consummate this transaction.

B. All requisite action has been taken by each Party in connection with the entering
into this Agreement, the instruments referenced herein, and the consummation
of this transaction. No further consent of any trustee, official, shareholder
creditor, investor, judicial or administrative body, governmental authority or other
Party is required.
C. The individuals executing this Agreement and the instruments referenced herein
on behalf of each Party and the partners, officers or trustees of each Party, if
any, have the legal power, right, and actual authority to bind each Party to the
terms and conditions of those documents.
D. This Agreement and all other documents required to close this transaction are
and will be valid, legally binding obligations of and enforceable against each
Party in accordance with their terms, subject only to the applicable bankruptcy,
insolvency, reorganization, moratorium laws or similar laws or equitable
principles affecting or limiting the rights of contracting Parties generally.
SECTION 14. BROKERS, AGENTS AND CONSULTANTS
Neither Party has retained the services of any broker, agent or consultant in this
transaction. If any broker, agent, or consultant is retained in connection with this
transaction, each party shall be responsible for all fees, costs and expenses paid to
such broker, agent or consultant. Each Party agrees to defend, indemnify, and hold
harmless the other from any claims, expenses, costs, or liabilities arising in connection
with breach of any agreement between the party and any broker, agent or consultant. .
SECTION 16. NOTICES
All notices to be given under this Agreement shall be in writing and sent by:
A. Certified mail, return receipt requested, in which case notice shall be deemed
delivered three (3) business days after deposit, postage prepaid in the United
States' mail; or
B. Personal delivery; or
C. Facsimile or similar means if a copy of the notice is also sent by United States
Certified Mail, in which case notice shall be deemed delivered on transmittal by
facsimile or other similar means, provided that a transmission report is generated
by reflecting the accurate transmission of the notices, as follows:

SECTION 17. ENTIRE AGREEMENT
This Agreement contains the entire Agreement between the Parties to this Agreement
and supersedes any prior written or oral agreements between them concerning the
purchase of the property. There are no representations, agreements, arrangements or
understandings, oral or written, between the Parties relating to the subject matter
contained in this Agreement which are not fully expressed in this Agreement. This
Agreement shall not be modified in any manner except by an instrument in writing
executed by the Parties or their respective successors in interest.
SECTION 18. SEVERABILITY
If any term or provision of this Agreement shall, to any extent, be held invalid or
unenforceable, the remainder of this Agreement shall not be affected.
SECTION 19. WAIVERS
A waiver or breach of covenant or provision in this Agreement shall not be deemed a
waiver of any other covenant or provision in this Agreement, and no waiver shall be
valid unless in writing and executed by the waiving Party. An extension of time for
performance of any obligation or act shall not be deemed an extension of the time for
performance of any other obligation or act.
SECTION 20.
The section headings and captions of this Agreement are, and the arrangement of this
instrument is, for the sole convenience of the Parties to this Agreement. The section
headings, captions, and arrangement of this instrument do not in any way affect, limit,
amplify, or modify the terms provisions of this Agreement. This Agreement shall not be
construed as if it had been prepared by one of the Parties, but rather as if both Parties
have prepared it. Unless otherwise indicated, all references to sections are to this
Agreement. All exhibits referred to in this Agreement are attached to it and
incorporated in it by this reference.
SECTION 21. MERGER

All of the terms, provisions, representations, warranties, and covenants of the Parties
under this Agreement shall survive the Close of Escrow and shall not be merged in the
Grant Deed or other documents.
SECTION 22.
This Agreement may be executed in one or more counterparts. Each shall be deemed
an original and all, taken together, shall constitute one and the same instrument.
SECTION 23. TIME OF THE ESSENCE
Time is of the essence in this Agreement.
SECTION 24. SUCCESSORS
This Agreement shall inure to the benefit of and shall be binding upon the Parties to this
Agreement and their respective heirs, successors, and assigns.
SECTION 25. GOVERNING LAW
This Agreement shall be governed and construed in accordance with California law.
SECTION 26. OFFER AND ACCEPTANCE
This Agreement as executed by the Parties constitutes an offer to purchase and an
acceptance to sell the School Property on the terms and conditions contained in this
Agreement, by each respective Party.

Environment Review
Under the California Environmental Quality Act Implementing Guidelines (CEQA),
Planning Department Staff has determined a Notice of Exemption is appropriate.
Following is a discussion of the project and the reasons for the exemption:
Proiect Description
The Mariner's Library project is a cooperative project between the City of Newport Beach
and the Newport Mesa Unified School District (NMUSD) for the development of a joint
use library. The new Mariners Library will be a 15,125 square foot facility located on
Irvine Avenue,, which will replace an existing 9,298 square foot library located on
adjacent Dover Drive and the 1,300 square foot school portable. The project site is
located at the southwest corner of the intersection Irvine Avenue and Dover Drive. The
existing Mariner's Branch Library will be demolished. A new library building will be
constructed on the same site, but will be relocated approximately 400 feet west from its
current location facing Dover Drive to face Irvine Avenue. The expanded area of the
proposed library will accommodate relocation of the existing school library presently
located within Mariner's Elementary School. The project includes an equal exchange of
property between the District and the City to accommodate the construction. The two
existing tennis courts will be relocated further to the northwest to make space for the
new library building, and the batting cages and sport equipment storage containers will
also be relocated. A new off - street parking lot will be created to accommodate the new
library building.
Environmental Analysis
This project has been reviewed, and it has been determined that it qualifies for a
categorical exemption pursuant to Section 15332 (Class 32, In -Fill Development
Projects) of the California Environmental Quality Act Implementing Guidelines. This
exemption permits the development of projects that meet the following criteria:
(a) Consistent with the General Plan and applicable Zoning regulations.
(b) The project occurs within the city limits and is not in excess of 5 acres
surrounded by urban uses.
(c) The site has no value as habitat for endangered, rare or threatened species.
(d) Project approval will not result in a significant effect related to traffic, noise, air
quality or water quality.
(e) The site can be adequately served by all required utilities and public services.
(a) The site will be the combination of the existing Mariner's Library site that is owned
and operated by the City of Newport Beach and a portion of Mariner's Elementary
School owned and operated by the Newport-Mesa Unified School District. The project
site is designated Governmental, Educational, and Institutional Facilities. Libraries are
listed as a permitted use within the GEIF designation. The site is within Statistical Area
J2 of the General Plan. Land Use Element anticipates an additional 3,304 square feet of
development for the City uses (Fire Station, Mariner's Park and Mariner's Library). The
Land Use Element also anticipates an additional 4,354 square feet of development for
Mariner's Elementary. The combined area (7,758 square feet) exceeds the 6,000 square
feet of expansion planned with the new library. The zoning of the site is Governmental,
Educational, and Institutional Facilities (GEIF) which permits cultural institutions
including libraries as permitted uses. The project will be designed to meet all applicable
development standards of the Zoning ordinance including minimum parking spaces,
setbacks and building height.
(b) The site is located within the corporate limits of the city of Newport Beach and the
project site is surrounded by urban uses including single- family subdivisions, an
elementary school and a neighborhood. The project site is approximately 3.1 total acres
in area, which includes all areas where construction potentially will take place. This
acreage also includes the area of land to be exchanged between the City and NMUSD
that does not have any construction proposed.
(c) The project site is developed as a library and active recreational use. The site
includes two tennis courts, an existing library building and active playgrounds covered
with turf grass used by both the school and park. The ornamental landscaping and the
lawn areas provide limited habitat value. No known rare, endangered or threatened
species are known to use the site as habitat.
(d) Traffic is not anticipated to increase over existing levels as the expanded library building
will house the existing branch library and the children's library presently being operated by
the NMUSD. The new library will have access from two (2) driveways off of Irvine Avenue.
One driveway will be a right -in, right -out driveway. The second driveway, across from
Flower Street, is being reviewed for full access. Access will be further refined during
detailed design of the project to minimize any operational issues. The new library will be
expanded in size from the existing library, however, the size of the book collection will be
roughly equivalent to the book collections (existing Mariners and Mariners Elementary
libraries) that it replaces. Some of the additional space is also attributed to expanded staff
work areas. Improved public reading areas, public workspaces, and computer workstations
also contribute to the additional size of this facility. The replacement multi-
purpose /community meeting room will be equivalent in size to the existing facility.
It is expected that there will be some additional vehicle trips due to the increased reading
and workspace, improved book collection quality, and increased number of library
computer workstations, but the increase in traffic is not expected to be proportional to the
greater size, as libraries tend to draw from a fixed area. Also, the library is being designed
to be used as a joint library with Mariners Elementary School, and some of the trip
generation associated with the library use can be credited because of this planned use.
The negligible additional trips generated by the library expansion will not present any
impacts to the adjacent circulation system.
With the relocation of the library from Dover Drive to Irvine Avenue, access to the parking
facility will be from Irvine Avenue with secondary parking access from the former library site
along Dover Drive. The impact to the Irvine Avenue level of service will be negligible. The
average daily traffic (ADT) volume on Irvine Avenue is 25,000- 28,000 vehicles per day.
The trip generation rate for a regular public library would show the existing library generates
approximately 400 trips per day. Although traffic counts have not been taken, the number
of vehicle trips to Mariners Library is believed to be lower. Mariners Library is more of a
community library, compared to the Central Library where a higher trip generation rate
would be expected.
The current public library shares parking with park users along Dover Drive (approx. 45
parking spaces currently available). The proposed project will add fifty (50) parking spaces
that can also be used for park use when the library is not open. Additionally, the increased
parking will reduce the burden of overflow parking on the adjacent residential streets.
For safety purposes, a pedestrian path is being included in the design of the project behind
the library adjacent to the park. Students leaving school and going north to cross at the
Irvine Avenue /Dover Drive intersection can use the pedestrian path behind the library
through the park to Dover Drive.
Noise generated by the project is expected to be construction related. The Newport Beach
Municipal Code regulates the hours and days of constructions activities to ensure that
construction related noise is less than significant. Air Quality impacts are projected to be
less than significant based upon the thresholds identified in Table 6 -2 and 6-3 of the South
Coast Air Quality Management District CEQA Handbook. Impacts to water quality are not
anticipated as the use will not require greater amounts of water over an above the current
use. The development will require a Water Quality Management Plan (WQMP) pursuant to
Council Policy L -22. The WQMP will identify all feasible best management practices for
construction of the project to ensure that project related impacts to water quality are less
than significant.
(e) The Utilities Department indicates that adequate water, wastewater and storm water
facilities with adequate capacities serve the project presently exist within the abutting
rights -of -way of Irvine Avenue and Dover Drive. No expansions or extensions of existing
utility lines are necessary to serve the project site. The project will only require new
localized connections from the new library building to the existing utility systems. Police
and Fire Department services currently serve the site and the project is not anticipated to
increase the need for Police services due to the nature of the use or reduce Fire
Department response times. The new library building will be provided with a full fire
sprinkler and alarm system in accordance with the Building and Fire Codes. Staffing for
the new library is anticipated with the project and will be provided in accordance with a
joint agreement between the City and NMUSD. No other impacts to public services are
anticipated as a result of the project.
RESOLUTION NO.2002-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, CERTIFYING THE
PROJECT BUDGET, LOCAL FUNDING COMMITMENT,
SUPPLEMENTAL FUNDS, AND PUBLIC LIBRARY
OPERATION OF THE JOINT MARINERS LIBRARY
PROJECT BETWEEN THE CITY OF NEWPORT BEACH
AND THE NEWPORT -MESA UNIFIED SCHOOL DISTRICT
WHEREAS, the City of Newport Beach ( "City ") owns approximately 7 acres of
property on the corner of Irvine Avenue and Dover Drive in the City ( "City Property").
Currently located on this property is a 9,298- square -foot public library known as
Mariner's Library and an adjacent public park. The Newport-Mesa Unified School
District ( "District ") owns approximately 10 acres of property directly adjoining City
Property, where it operates the K -6 Mariners Elementary School ( "Mariners School ").
WHEREAS, City and District are interested in grant funding opportunities offered
under the Library Bond Act, Education Code Sections 19985 through 20011.
WHEREAS, first priority funding is available for joint use projects with a co-
located library that houses a combined public library and public school library in a single
facility.
WHEREAS, City and District have prepared an application for "first priority"
funding under the Library Bond Act Regulations, Titles 24 CCR, Chapter 16, Article 5.1
through 5.5 and Title 5 CCR, Division 2, Chapter 3, Sections 204, 302, 20444
( "Application "). The Application is attached hereto as Exhibit A.
WHEREAS, the City and District have entered into a cooperative agreement
( "Agreement') for joint -use of the Mariners Library. Under the Agreement, the Mariners
Library will be relocated and expanded to become a 15,125- square -foot building that will
serve jointly as the Mariners Branch Library and the school library for the Mariner's
School ( "Mariners Library').
WHEREAS, pursuant to the Agreement, the Mariners Library will remain a City
public library under the administrative control of the Board of Library Trustees, as
defined in Section 708 of the Newport Beach City Charter. Moreover, as part of the
Agreement, the City has agreed to provide public library direct services from the
Mariners Library for a period of 40 years.
WHEREAS, under the Agreement, the Mariners Library shall be funded by City
with assistance from District. City and District have prepared a Project Budget for the
Mariners Library ( "Library Project Budget "), attached as Exhibit B.

WHEREAS, the Regulations require that the applicant's governing body certify by
resolution the project budget, the local funding commitment, the availability of
supplemental funds and commitment to public library operation and that it submit a copy
of the Resolution with the Application Form.
NOW, THEREFORE, the City Council of the City of Newport Beach hereby
resolves and certifies as follows:
1. The City is committed to providing the local matching fund amount
identified in the Library Project Budget, as required by Education Code
section 19995(a), including and identifying any amounts to be credited to
local matching funds pursuant to section 19995 (c) and (d).
2. The City is committed to providing supplemental funds necessary to
complete the project at the level stated in the Library Project Budget.
3. The City certifies that the local matching and supplemental funds specified
in the Library Project Budget will be available when needed to meet cash
flow requirements for the project.
4. The City certifies the Library Project Budget contained in the Application
Form.
5. The information included in the Application Form and supporting
documents is true and accurate.
6. The City is committed to operating the completed facility and providing
public library direct service.
7. The City is committed that the Mariners Library shall be dedicated to public
library direct service use for a period of 40 years following completion of
the project, regardless of any operating agreements the City may have
with other jurisdiction or parties.

Newport Beach Public Library (NBPL) consists of a Central Library, Balboa, Corona del Mar, and Mariners Branch Libraries.
The branch libraries are attractive and highly active facilities, particularly the Mariners Branch. In recent years the branches
have been repainted, re- carpeted, and have had new or refinished furniture installed. The reality is these buildings were initially
very small, averaging 2,000 square feet, and each has been expanded or undergone major remodeling at least 4 times. The
last remodel, creating more public space, was at the Balboa Branch in 1998. Continual remodeling with very limited budgets
has severe drawbacks, usually resulting in less than maximum functionality and usability of space.
NBPL is committed to improving and properly maintaining the physical facilities at all locations in order to meet the expanding
educational, informational, and cultural needs of the community by providing inviting and accommodating environments. As
part of this commitment, NBPL has formed a task force, which includes library staff, members of the community, and City
government staff. The task force developed a long -range plan — Commitment to Excellence: Library Services 2000 -2005, Goal
4 — Facilities, which includes a Facilities Master Plan with identification of needed site improvements.
The Mariners Branch is the busiest of the 3 branch libraries. It is located adjacent to Mariners Elementary School (K -6) in a
very busy City park with playground, picnic areas, playing fields, and tennis courts. The area draws many families with children
from surrounding residential neighborhoods who are able to walk to the library, park, and school because of the location.
Newport Harbor High School and Ensign Middle School are also in the neighborhood. The branch was built in 1963 and has
been remodeled many times. It has a very active meeting room that also serves as a homework center staffed by library
personnel. Mariners Elementary School has always had a close relationship with the branch due to its proximity to the school.
The small school library is currently housed in a temporary, modular building placed at the site in 1999. A new joint use facility
would provide enhanced service both to Mariners Branch Library and to Mariners Elementary School.
The third branch, Corona del Mar Branch, at 3,800 square feet, is the smallest. It serves an aging population and is located just
3 blocks from the City's OASIS Senior Center. This branch is housed in a modular building; major remodeling or expansion is
not an option. NBPL has considered relocating this branch to the OASIS Senior Center in order to provide expanded service to
this part of the community.
In January 2002, the City annexed the area along the southern coastal boundary of Newport Beach. The annexation agreement
includes a proposal to build a new branch library in that part of the community. If the proposal is approved, a Newport Coast
Community Committee along with Library staff will analyze the services to be provided at the new branch and to draft an initial
building program.
The branch libraries are an integral part of the NBPL system. They serve their local neighborhoods, providing materials to meet
the informational and recreational needs of all users from youth to the lifelong learner. The new Mariners Joint Use project, with
Mariners Branch Library integration with the Mariners Elementary School Library, will give the City and School District the
opportunity to create a well designed public building with a comfortable, friendly environment enhancing library services for all
members of the community.

The Newport Beach Public Library (NBPL) developed as a system of branches because of (1) the timing of the development
the City; (2) the geography of the City with 2 bays which divide the City, a peninsula, and B islands; and (2) the commitment
the Board of Library Trustees to provide services in the neighborhoods where customers could walk or bike to the library.
The Mariners Branch was sited 40 years ago in what was considered at the time as a way to maximize public services, make
them accessible to the residents, and make the area a center of community activity. The site provides for the Mariners School,
the Mariners Branch Library, a fire station, and a wealth of recreational activities — soccer, baseball, football, tennis courts,
racket ball, playgrounds, and picnic areas.
The site has fulfilled the dreams of the original planners. The entire Mariners side, including the library is a hub of activity for the
whole community. As a consequence, the library has successfully and graciously provided library service to customers who do
not reside in the City. This non - resident service will continue with the Mariners Joint Use Library. Because the branch has
become such an important part of the community, the residents and political bodies feel it must remain in the Mariners Park
area, even if it is located on the edge of the City. Moreover the community, whether Newport Beach or Costa Mesa residents,
form one neighborhood unit, with a long tradition of joint projects in the general Mariners area.
The major collection of the NBPL system is housed at the Central Library on the other side of the bay. However, all library
customers have equal access to the entire collection at any site with daily deliveries between all the facilities.

Parking Rationale

The preliminary plans include a 50 space parking lot adjacent to the Library. The Municipal Code requirement for Cultural
Institutions would require 46 spaces. In addition, there are numerous on- street and off -stmt spaces along the Dover Drive
edge of Mariners Park. These spaces will be connected to the library by a pedestrian walkway system though the park. Bicycle
parking will be provided at the library as well. During non - school hours, the Mariners School parking lot will be available for
additional parking.
Visibility
Describe how visible and prominent the public library building will be within the library service area.
The library will be highly visible in Mariners Park on Irvine Avenue, next to Mariners Elementary School, and will form an
educational and cultural complex. Since there are 22,000 vehicle trips on Irvine Avenue daily, the library, by its location will
serve as its own marketing agent with appropriate signage.
Moreover, since the Mariners Park is a multi-block site and the hub of the community with a wide range of resources, it is a
natural draw. The park serves as a center for special events on the western side of the bay, such as concerts, and other major
community events.
The library will form the major component of a true community and cultural center.

Community Context & Planning
Describe the proximity of the proposed site to other facilities and areas of the community, and how that proximity enhances the
use of the library by the residents in the library service area. Describe the appropriateness of the proposed site includin
whether the proposed library project will contribute to the establishment, redevelopment, or revitalization of a community oAW
downtown core, business district, or neighborhood. Describe how the proposed library is connected to other uses, including
public use facilities, by a full range of transportation and pedestrian options.
The library is located in a multi block park, which provides a wide variety of community services. The major buildings are the
Mariners School, the library, and the fire station. Another amenity which attracts the entire community is the open park space
that is used for enjoyment, playgrounds, ball fields, tennis courts, and racket ball courts.
This park is in a developed neighborhood of primarily single - family homes. Redevelopment consists of upgrading and
remodeling the current homes. It is a walking and bicycling neighborhood with a large percentage of residents walking or biking
to the library. The Orange County Transit Authority also provides transportation on Irvine Avenue. The City's Senior Services
Division provides one-on -one transportation service to seniors on a scheduled basis. The library also provides a Homebound
Library Delivery Service of library resources for homebound customers.
Site Selection Process
Describe the site selection process including community and planning department involvement, consultant assistance, as well as
any other pertinent activities associated with determining the best site for the library project
The joint library/school community initiated the planning by assuming a remodel of the current Mariners Branch, the equivalent of
a walk of 2 City blocks from Mariners School. The City /School District Committee with input from Mariners School Staff, analyzed
service programs and elected to relocate the library closer to the school to provide better, safer, and more meaningful access.
With that decision, the Planning Department was consulted for zoning requirements for the site; City Attorney for feasibility of land
exchange; and Public Works - Transportation fortransportation, access /egress issues.
The site selected is in the long established Mariners Park, which includes school, library, fire station, picnic area, and playground.
For 40 years, the park and its amenities has served as the community center of the area of primarily single - family homes. It has
become an icon in the neighborhood. There was initial discussion of locating the new joint venture with another Newport-Mesa
Unified School District school on the western side of the bay, but the negative public outcry overrode any further consideration.
The Mariners Branch Library has a long history of cooperative and joint projects with the Mariners School. However, the
approximate two -block walk across the playing fields between the school and the library has been an impediment to many
projects.
After public hearings, staff level meetings of both jurisdictions, and political considerations, it was determined the best altemative
was to relocate Mariners Library to a new facility on Irvine Avenue next to the school, so that the library in effect becomes an
integral part of the school complex.

Site Selection Summary
Describe why the proposed site was selected and why it is the best available location for the proposed public library project. If
there are problems with the proposed site, are there mitigating circumstances that lessen the negative impact of the problem or

The site selected for the Mariners Joint Use Library is located adjacent to Mariners Elementary School in Mariners Park. This
site provides easy, safe access for the children during the school day, where they will enter the new children's section of the
library through their own secure access door. Community leaders have supported these suggestions by incorporating them into
the conceptual design of the building.
Traffic is not anticipated to increase over existing levels, as the new joint use library will house the existing branch library and the
children's library presently being operated by the school. The new library will have access from 2 driveways off of Irvine Avenue.
One driveway will be a right -in, right -out driveway. The second driveway, across from Flower Street, is being reviewed for full
access. Access will be further refined during detailed design of the project to minimize any operational issues.
It is expected that there will be some additional vehicle trips due to the increased reading and workspace, improved book
collection quality, and increased number of library computer workstations, but the increase in traffic is not expected to be
proportional to the greater size, as libraries tend to draw from a fixed area. Also, the library is being designed to be used as a
joint library with Mariners Elementary School, and some of the trip generation associated with the library use can be credited
because of this planned use. The negligible additional trips generated by the library expansion will not present any impacts to
the adjacent circulation system.
The current public library shares parking with park users along Dover Drive (approx. 45 parking spaces currently available). The
proposed project will add fifty (50) parking spaces that can also be used for park use when the library is not open. Additionally,
the increased parking will reduce the burden of overflow parking on the adjacent residential streets.
For safety purposes, a pedestrian path is being included in the design of the project behind the library adjacent to the park.
Students leaving school and going north to cross at the Irvine Avenue /Dover Drive intersection can use the pedestrian path
behind the library through the park to Dover Drive.

Energy Conservation

Energy efficiency will be accommodated by implementing the following:
1. The building envelope will be designed to minimize heat gain and loss to the outside through the use of effective insulation,
broad overhangs at windows, and high performance double-glazing.
2. The HVAC system will be very energy efficient, high performance and will include a built -in energy management system. At
this early stage, we envision a four pipe system with water - cooled high efficient chiller and boiler. Recent energy analysis has
proven this system to be more fuel efficient than VAV systems.
3. Indirect light from clerestories will help reduce lighting needs during daytime use. Lighting will be provided by high efficient
lamps and lighting fixtures. The building will have occupancy sensors for control of lighting in individual spaces in concert with an
energy management system.
4. All plumbing fixtures will be low flow and water heating will be by an efficient loop system with recirculating pump.

Geotechnical Report
Identify and summarize any special geologic conditions, including, but not limited to, compressible and expansive soils, tunnels
and mine shafts, unstable slopes, active seismic zones, excessive ground water and areas prone to liquefaction. Indicate it
these conditions will prevent the use or significantly increase the cost of developing the site for a public library building.
A Geotechnical Engineering Report was performed in May 2002, and is enclosed in the submittal. The site is relatively flat with
no ascending or descending slopes. The site is at elevation 93 -feet and is 3,300 -feet northwest of Newport Bay. The surrounding
area is residential. The soil is marine terrace deposits of unconsolidated flat lying sand with a small amount of silt Bedrock was
not encountered, but is estimated to lie at a depth of 75-100 feet. Perched water was detected at a depth of 11 to 13 feet in the
borings, and it is often encountered in the upper layers of the mesa marine terrace sequence. Slope stability is not considered a
constraint to the proposed library. There are mapped buried faults associated with the Newport- Inglewood fault, but only one has
been identified as being active. In addition to possible strong ground motion, other secondary effects of earthquake such as
liquefaction, induced flooding, landsliding and subsidence were considered and the potential for any of these secondary
earthquake events is considered very low to nil.
The recommendations include over excavation and reoompacton to 90% on the order of 4 feet from finish subgrade elevation or
2 feet below the bottom of the footings. This process does not significantly affect the costs of the project. The allowable soil
bearing capacity after compaction is 2,000 psf and conventional continuous footings and isolated column footings shall be
designed to meet applicable sections of the UBC.
The report concludes that with implementation of the recommendations for design, the site is suitable for the proposed library
project.

Financial rapacity (New Construction and Conversion Projects Only)
Applicants with new public library projects shall describe their financial capacity to open and maintain operation of the proposed
library including anticipated revenue sources for library operations support.
The Newport Beach Public Library (NBPL) is funded by approval of the Newport Beach City Council. The library budget has
historically been approximately 4% of the total City budget. The library has been funded by the City since its inception in 1920.
The budget includes fines, fees, and some funding from the California State Library for Direct Loans to non - residents. For FY
2002)03, the proposed library budget is $4.2 million, to support the Central Library and the 3 branches.
These appropriated funds are augmented with significant donations from the NBPL Foundation, the Friends of the Library, the
Literacy Advisory Council, and grants, in excess of $350,000 annually.
The funds for the library are apportioned to provide quality services to all the library sites. In FY 2002)03, the specific site
budget for Mariners Branch is $400,000

S OVERALL EXECUTIVE SUMMARY
The City of Newport Beach was incorporated in 1906 and is now a community of 75,662
residents and 10,076 businesses that work together to create a safe, vibrant, and productive
environment in which to live and work. An essential facet of City service to its population is the
Newport Beach Public Library (NBPL) system. The backbone of the NBPL is the Central Library,
which manages an in -depth collection of materials and reaches the City through its three
branches. The largest branch in the NBPL system is Mariners Branch Library. The Mariners
Branch is an extremely popular community resource and destination for the surrounding
neighborhood and local schools in the area. The Marines Joint Use Library (MJUL) project has
been created to improve the service capacity of this Branch to both groups by constructing a
totally new 15,125 gross square foot Library. The new Mariners Branch Library has been
designed so that it will meet the present and future needs of citizens and students.
A unique collaboration between the City of Newport Beach (CNB) and the Newport Mesa Unified
School District ( NMUSD) resulted in the MJUL project. Two separate planning processes were
united in order to maximize resources and ensure a successful Library project. One planning
process was targeting the Mariners Branch Library, which was originally built in 1963. The
Mariners Branch has been re- modeled several times over the years to meet the growing needs
of its users. The latest strategic planning efforts, the Commitment to Excellence: Library Services
2000 -2005 and the Fiscal Year 2001 -2002 Tactical Plan, documented the need for yet another
Mariners Branch upgrade and possible expansion.
The other planning process underway was addressing the needs of Mariner Elementary School.
. Although a number of other schools frequent the Mariners Branch, by far the largest group of
students come from Mariners Elementary. Mariners Elementary is 500 feet from the existing
Mariners Branch, separated by a CNB public park. Mariners Elementary was originally built in
1959 and consists of a main campus and building with six interconnected classroom wings. A
library was initially housed within the school, but was relocated to small portable in 1999 to
accommodate the growing student population. In December 1999, the Board of Education
approved an Educational Facilities Master Plan detailing the needs of the District's school
facilities based upon communities' input and the evaluations of consultants.
An innovative discussion in December 2000, between the Vice Chair of the Board of Library
Trustees and NMUSD Superintendent of Schools identified the parallel planning efforts for the
two facilities and laid the foundation of MJUL cooperative effort. A Public Library/School District
Committee was formed and started the joint planning process. Members of the Committee
included the Vice Chair of the Board of Library Trustees, the City Librarian, the Youth and
Branch Services Manager, the Mariners Branch Librarian, members of the Board of the Newport
Mesa Unified School District, the Superintendent of Schools, the Principal of Mariners
Elementary, the NMUSD Director of Educational Technology, and two NMUSD Administrative
personnel.
The primary user groups of the new MJUL project include the community users from the original
Mariners Branch service area, and school users from four NMUSD schools. The Public
Library/School District Committee founded a number of subcommittees to work on a plan that
would meet the needs of both these groups. A Joint Use Library Service plan was drafted that
situated the new MJUL in its original location, but with greatly enhanced services. After studying
. this plan, the Public Library/School District Committee realized that to maximize the
effectiveness of a MJUL, it would be necessary for the MJUL to be located adjacent to Mariners
Elementary for reasons such as staffing, security, and to limit the amount of class time spent

walking from the school to the library. The MJUL plan evolved and now seeks to combine the
two existing inadequate libraries and replace them with a single Mariners Branch facility at a new •
site directly adjacent to Mariners Elementary. A creative land exchange program between the
CNB and the NMUSD has been arranged to permit the relocation.
The MJUL will serve the 25,615 residents in the original Mariners Branch service area. This
population is expected increase to 30,021 residents by the year 2020, a growth rate of 17 %. The
residents in the service area have a larger percentage of people with post - secondary education
than the state and nation. This creates high educational expectations and a demand for quality
library services. The area is also characterized by a higher percentage of adults 55 or older than
either the state or the nation. In the past 2 years, 891 homes have sold in the Mariners service
area. Older residents are selling their homes to buyers with families. The young families often
combine trips to the Mariners Branch with a visit to the heavily used public park, which has
tennis courts, a baseball field, a playground, and a picnic area. A familiar sight in the
neighborhood is a parent, grandparent or caregiver along with a stroller or kids walking to the
library. The needs of the large group of Mariners adult users cannot be overlooked and the new
facility will provide balanced collections.
The schools that the MJUL project will serve include Mariners Elementary, Newport Heights
Elementary, Kaiser Elementary, Ensign Middle School, Harbor High School, and several private
schools. Mariners Elementary is the main school, and has 736 students K -6.
MJUL service area includes 5,257 students enrolled in K -12. Fifty percent of student body
receives free or reduced lunch programs and 51 % reside in Costa Mesa. The general population
in the area grew by 11 % since 1980, but the school age population grew by 13 %. All of the
schools in the service area have school library media centers. Unfortunately, California school
libraries rank among the bottom for the nation. The NBPL is ranked third in the country for its
size. Therefore it is anticipated that the new MJUL will be an excellent supplement to the
NMUSD library program.
The needs assessment process for the MJUL project identified a number of important qualities,
programs, and services that the new library will have to provide. The process diligently
considered the needs of both the community and the schools that will use the MJUL. The major
needs include:
Provide MJUL users with outstanding resources, service, and state -of- the -art library
technology
Identify programs, actions, and initiatives to make the MJUL an important community and
cultural center
Expand collections, increase library space, and provide comfortable youth and adult
seating
Establish effective quality library services the youth of the community through their years
of development to instill a pattern of lifelong learning
Extend library hours to meet school needs, increase security, start a Teen Center, set up
a Preschool Center, and create a well - designed community room
The MJUL project endeavors to meet all of these needs with a well - planned library project that
will operate for many, many years to come.

OVERALL EXECUTIVE SUMMARY
The Mariners Joint Use Library (MJUL) project will combine the current Mariners Branch Library
and Mariners Elementary School Media Center into one new joint use library facility. The current
Mariners Library is the largest Branch of the Newport Beach Public Library (NBPL). Mariners
Elementary (K -6) is part of the Newport Mesa Unified School District ( NMUSD) and the School
Media Center (the term for NMUSD libraries) serves 736 students. However, the new MJUL will
also officially serve four other NMUSD schools, Kaiser Elementary School (K -6), Newport
Heights Elementary School (K -6), Ensign Intermediate School (7 -8), and Newport Harbor High
School (9 -12).
The vision for the progressive MJUL is that it will serve as an essential community and
educational center. The library will house a carefully balanced collection of materials that will
contain popular youth and adult materials to meet the diverse needs of the community. As well,
the MJUL will provide NMUSD educational resources to meet the needs of the increasing
student population. The new joint branch /school library will continue to provide the outstanding
Public Library service for which the current Mariners Branch is renowned, and the personalized
school library service of the School Media Center to students and faculty of Mariners
Elementary, and to other student users.
Mariners Elementary students constitute the predominant group of MJUL school users because
the new library will be located directly adjacent to Mariners Elementary. A separate entrance to
the children's room of the MJUL will be opened during school hours for students and faculty use
only. During the other MJUL hours the children's room will serve other preschoolers, home -
schoolers, and NMUSD students in the area.
is The collective project planning efforts of the NBPL staff and the NMUSD District Media staff has
resulted in a superior plan of service that will ensure the MJUL shall provide outstanding library
services. The continued guidance of the Joint Advisory Committee will monitor the progress of
the project to make certain goals are achieved. The plan of service calls for a rich collection of
materials for community enjoyment and for use by the student population, access to online
resources to support school curriculum, and state of the art technology.
The plan of service for the MJUL includes personal one - on-one work for individual students,
guidance for student/group projects, and general assistance to regular class instruction. These
services will be available in the children's room, which has been specially designed to meet the
unique needs of the student users. Another resource available to school users is a Community
Meeting Room, which will be available for class instruction.
As well, an exclusive system of reserves will be established to support Mariners Elementary.
This will guarantee sufficient materials are available for the school and its special projects.
Students will be able to checkout materials directly through the children's room as they return to
their classrooms. The students will be issued a private MJUL Library Card for use during school
hours to facilitate self- checkout by individual students.
The service principle guiding MJUL staff will be the achievement of a cultural, educational, and
informational resource for users. The MJUL staff will create a special atmosphere that is inviting
and accommodating for the community users as well as providing leadership and support to the
NMUSD users. Proper training and clearly articulated responsibilities will be utilized to
accomplish this goal.

MISSION STATEMENT
Mariners Joint Use Library
The MJUL mission statement originates from the historical commitment to service that
characterizes both public agencies involved with the project The NBPL and the NMUSD formed
an invaluable partnership to create the MJUL project, and both bring innovative service concepts
to the union. The NBPL has been operating since 1920 and continually strives to reinvent itself to
keep pace with the needs of its users. The NMUSD has been operating since July 1966, and
also goes to great lengths to provide its students with the highest quality education possible.
The NBPL Board of Library Trustees adopted a new NBPL mission statement in June 1999. The
statement reflected the NBPL's strategic planning efforts for the 215t Century, which were
focused on meeting the new challenges the library would face providing service. It reads: "
The library is the cultural, educational and informational heart of Newport Beach."
In May 2000, the NBPL Library Strategic Planning Task Force wrote a vision statement to guide the
planning process in the development of an overall plan of service. The vision statement reads:
"We see the Newport Beach Public Library as the cultural, educational and
informational heart of the City, providing a variety of exceptional services for all
ages supported by state- of- the-art library technology. Further, that it will be
recognized as the finest library for a city of its size in the United States, both in
the eyes of its community and according to nationally recognized library surveys."
The Task Force's observation ensured that the new NBPL vision statement would uphold the
needs of community in its pursuit of service.
The launch of the MJUL project brought another vision of service into the mission statement
creation process. The vision statement of the NMUSD reads:
"The mission of the Newport-Mesa Unified School District, in partnership with the
Costa Mesa - Newport Beach communities, is to graduate students who have
acquired the knowledge, skills and attitudes necessary to achieve significant
career, educational, civic, and personal goals, which will enrich our society."
The NMUSD had also been planning for the new millennium. The NMUSD illuminated a crucial
aspect of library service for the MJUL in its District -Wide School Library Plan. The plan stated:
"Literacy for the Twenty-first Century includes three components: reading,
information, and technology. NMUSD library media centers support these
components of literacy. NMUSD library media centers will provide a setting
where all students and staff at every site are given the necessary skills to locate,
analyze, evaluate, interpret, and communicate information and ideas in an
information rich worid."
The emphasis on excellent library technology is a very important to the MJUL project.
The pivotal combination of mission statements of the two agencies led to the creation of the
MJUL mission statement. The new statement serves as the guiding principle to all those involved
with the project, and is the foundation upon which the project is built. The delivery of service to
customers, in every possible way, has been enshrined as the highest priority for the new project.

A. Project Overview and Timeline
The current Mariners Library is the largest branch of the Newport Beach Public Library
(NBPL). The Mariners Branch Library was built in 1963. The facility has seating for 57
customers. The school media center at Mariners Elementary is a portable building. The
media center was moved to this facility in 1999 to make room for an additional classroom.
Both the library facilities lack the infrastructure to support an increased number of
Personal Computers (PCs). The limited number of PCs in the Mariners Branch restricts
customer access to the library's databases. Information literacy is a major goal of the
NMUSD. In the current school media center, there is one PC with access to the Internet.
The students' development of information literacy is hampered in the current
environment. For the past eighteen months meetings, have been held with the Board of
Library Trustees, library staff, NMUSD Board Members, District staff, and with the
community. A demographic analysis of the community shows a changing community with
various needs. The City of Newport Beach (CNB) community population of the MJUL
service area in 1980 was 23,079. The population grew by 11% between 1980 and 2000,
and the service area currently has 25,615 residents. According to the Center for
Demographic Research at California State University Fullerton, the population of CNB is
expected to grow 17% by the year 2020. At this rate the MJUL project service area will
increase to 30,021 residents by the year 2020.
It is important to note that while the general population of the MJUL project area grew
11 %, the school population grew by 13 %. The service area currently has a larger
population of adults aged 55 and older than either the state or the national average. The
new facility will meet the needs assessment in the following ways:

Built in 1963, the 8,000 square -foot library is a
critical educational resource for many students
at Harbor High School, Back Boy High School,
Ensign Intermediate School, four public elementary
schools, and several private schools. Additionally,
it enriches the lives of thousands of adults fulfilling

The Inspiration
Inspired by an opportunity to receive $2 million
in public funds from Proposition 14, the Newport
Beach Public Library and the Newport Mesa
Unified School District have joined together to
propose a new Mariners Branch. The California
Public Library Construction and Renovation Board,
which administers the grant funds, has given highest
priority to joint use facilities.
To give the project the best chance of receiving
available state funding, the application is for a
facility that combines a community and a school
library in a single unit, i.e., a joint use facility.
The Dream
The dream is for a new $3 million, stateof- the -orl
library that would replace the small, noisy and
overcrowded Mariners Branch. The new library
would be located on Irvine Avenue, adjacent to
the Mariners Elementary School campus, and
would function as both a community resource and
a school library.
The 14,000 square -foot facility would be a
high -tech library with up- todate books,
books-on cassette, online resources, reference
materials, videos, CDs, DVDs, magazines and
newspapers. Highlights would include:
• expanded print, electronic and audiovisual
collections for children, teens and adults
• 30 additional computers, including 12
reserved for children
• new teen center with study areas and young
adult resources
• extended operating hours
• additional staff
• quiet adult section
• separate children's reference desk
• storytime room that doubles as a classroom
• 60% larger community meeting room
• new parking area

anticipated by fall 2002. If the fundraising goal is
not met or the grant application is not approved,

SUBJECT: MARINERS LIBRARY JOINT USE PROJECT — SUPPLEMENTAL
DISCUSSION:
Several items changed since Council received their package of materials for this Agenda item.
The major change involves the budget for the project. Preliminary projections anticipated a
total project budget of $3.8 million. After detailed review of all eligible expenses including site
development, furnishings, architectural and engineering fees, and 10% contingency, the total
budget has been revised to $4.9 million. Funding from the Library Bond Act will provide 65
percent ($3.2 million) and the remaining 35 percent ($1.7 million) for construction and operating
funds are to be provided locally.
In addition to the change in budget projection, the following items have been updated:
• Page 3 of the Cooperative Agreement, second to the last paragraph should read:
`The Mariners Library Branch Manager shall provide overall supervision of the library."
• Exhibit A of the Exchange Agreement has been revised to include a legal description for
both the City site and School site.
• Page 4 and Page 12 of Exhibit A, Grant Application Form — Appendix 1, should indicate
the total square footage of the proposed library will be 15,125 square feet.

We, the undersigned, believe that there are numerous issues related to the proposed Mariners
Joint Use Public Library. These issues include but are not limited to: (1) Effectiveness -the
Mariners School Library will be closed and teachers/students can no longer guarantee that books
will be available when needed nor space reserved for school library activities; (2) Safety -
Mariners School children will be exposed to the risk of interacting with the general public during
school hours, something which is not allowed today; (3) Financial- the current $3M estimate
does not include the cost of removing the current library, replacing displaced park facilities
(tennis courts, baseball field), books and library material, or increased personnel and
maintenance costs. We, the undersigned, are not in support of the proposed joint use library until
these issues are addressed and alternative options are explored.
