BOX 532711 LOS ANGELES, CALIFORNIA 90053-2325 June 2, 2009 REPLY T AMMON OP: Office of the Chief Regulatory Division Lillian, Lumpkin c/o Lisa Walters City of Newport Beach, Harbor Resources Division 829 Harbor Island Drive Newport Beach, California 92660 Dear Ms. Lumpkin: This is in reply to your application (File No. SPL-2009-00419-MAS) dated May 19, 2009 for a Department of the Army Permit to discharge fill onto waters of the U.S., in association with the dock dredging in Lower Newport Bay. The proposed work would take place at 1314 Balboa Boulevard in Lower Newport Bay in the City of Newport Beach, Orange County, California (as shown on attached drawing). Based on the information you have provided, the Corps of Engineers has determined that your proposed activity complies with the terms and conditions of Regional General Permit (RGP) No. 54-Maintenance Dredging, Beach Nourishment, and Dock Maintenance. As long as you comply with the general permit conditions of RGP No. 54- Maintenance Dredging, Beach Nourishment, and Dock Maintenance, an individual permit is not required. Specifically, you are authorized to: 1. Dredge 85 cubic yards of material from 0.015 acres at 1314 East Balboa Boulevard in Lower Newport Bay using a 6" suction dredge 2. Dredged material will be placed on 35 linear feet of beach at 1314 East Balboa -2- Boulevard. A general permit does not grant any property rights or exclusive privileges. Also, it does not authorize any injury to the property or rights of others or authorize interference with any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain other Federal, State, or local authorizations required by law. Attached to this verification that your project is authorized by RGP 54 is an approved jurisdictional determination (JD). If you are not in agreement with that approved JD, you can make an administrative appeal under 33 CFR 331. Thank you for participating in our regulatory program. If you have any questions, please contact Melanie Stalder at 213.452.3294 or via e-mail at Melanie.A.Stalder@usace.army.mil. Please be advised that you can now comment on your experience with Regulatory Division by accessing the Corps web -based customer survey form at: http:Lper2.nwl2.usace.army.mil/survey.hbxd. C. SIGNIFICANT NEXUS DETERMINATION A significant nexus analysis will assess the flow characteristics and functions of the tributary itself and the functions performed by any wetlands adjacent to the tributary to determine if they significantly affect the chemical, physical, and blolog Ica I integrity of a TNW. For each of the following situations, a significant nexus exists if the tributary, In combination with all of its adjacent wetlands, has more than a speculative or Insubstantial effect on the chemical, physical and/or biological integrity of a TNW. Considerations when evaluating significant nexus include, but are not limited to the volume, duration, and frequency of the flow of water in the tributary and Its proximity to a TNW, and the functions performed by the tributary and all Its adjacent wetlands. It Is not appropriate to determine significant nexus based solely on any specific threshold of distance (e.g. between a tributary and Its adjacent wetland or between a tributary and the TNW). Similarly, the fact an adjacent wetland lies within or outside of a floodplain is not solely determinative of significant nexus. Significant Nexus: Not Applicable D. Where there is a break In the OHWM that Is unrelated to the waterbodys flow regime (e.g., flow over a rock outcrop or through a culvert), the agencies will look for indicators of flow above and below the break. 7-Ibid. 8-See Footnote #3. a -To complete the analysis refer to the key in Section III.DS of the Instructional Guidebook. 10-Prior to asserting or dedin Ing CWA jurisdiction based solely on this category, Corps Districts will elevate the action to Corps and EPA HO for review consistent with the process described in the Corps/EPA Memorandum Regarding CWA Act Jurisdiction Following Rapanos. https://onn.usace.army.mil/onn2/f7p=106:34:767377872713210::NO:: 6/2/2009 HARBOR RESOURCES DIVISION 829 Harbor Island Drive Newport Beach, CA 92660 (949) 718-1844 Fax (949) 723-0589 www.newport-beacb.ca.us/libr DREDGING APPLICATION Applicant Name: Project Site Address: CITY CHECKLIST 11 lio-^ ® Applicant address, phone number Agent &. Stored in plastic containers and immediately delivered to the lab. SAMPLE PREPARATION Entire sample transferred into 1 liter glass containers, deionized water added, and mixed to desalt and disperse the sediment. The sediment is allowed to completely settle and the clear water is removed by siphoning. The sample is placed in a drying oven at 50°C and occasionally stirred until the entire sample is completely dry. The dry sample is transferred to a desiccator for cooling. The sample is disaggregated and a Riffle sediment splitter is used to evenly split the sample to reduce the quantity of Material to be analyzed to an allowable retention weight for the sieves. SAMPLE ANALYSIS The dry split fraction is processed through a # 10 U.S. standard sieve to remove the gravel/shell fraction of the sample. The material retained on the sieve is weighed and value recorded. The material passing through the # 10 sieve is wet sieved through a #230 sieve to remove the silt/clay fraction. The material retained on the sieve is transferred back Into the glass container and placed back into the drying oven at 50°C. The remaining sample is allowed to completely dry and the material is weighed and recorded to yield the sand fraction. The silt/clay fraction is calculated by subtracting the gravel/shell and sand fractions from the total analysis weight. MBC Applied Environmental Sciences, 3000 Red Hill Avenue, Costa Mesa, CA 9?02e rI F wwm P ev'' Ej IV Debris Management Plan - 1,5111 lr-: At The sand to be removed from this site is quite clean, with little debris present. This observation comes from past dredging projects at this site. The dredge itself will not pass anything larger than a 4" sphere. Smaller objects, such as shells and cobble, may be pumped to the beach with the sand where they would be difficult to remove before becoming buried. However, shells are a common component of all bay beaches. Most trash, such as plastics, bottles, and old boat covers, becomes lodged in the intake nozzle and creates a clog. The pumping operation is temporarily stopped while the nozzle is lifted and the debris removed and placed to the side for later disposal. Some smaller trash can pass through the pipeline and be deposited along with the sand on the beach. Being lighter than the sand, most of it tends to wash to the sides of the deposited sand along with the tail -water. After the dredging operation is complete, the beach is generally raked in order to level out high and low areas, and to remove any trash that might be on the beach. In addition, any lighter trash that has washed to the sides of the deposited fill is picked up as the tide drops and properly disposed of. This permit is issued once all the necessary approvals have been obtained by the applicant. A field inspection revealed that a groin seawall has been replaced along the eastern boundary of your property and work is in progress to your pier. There is no evidence of an application for the above mentioned work and therefore you are in violation of the section 17 of the Municipal Code. In addition, the pier walkway now has a width which extends to the property line and does not have the required 5' setback. Please call this office to discuss this matter further. Forms for this purpose may be obtained from the Marine Department." At the time of the inspection, it was noted that the float portion of the pier did not conform to the drawing on file with the City of Newport Beach, Marine Department, a copy of which is attached for your information. Specifically, the float appears to encroach across the property line and into the City street end, whereas the permit drawing shows the float with the required 5 foot set back from the property line. This deviation of the structure from the permit on file with the Marine Department could be grounds for revocation of the Harbor Permit, as provided by Section 17.24.090 of the.Newport Beach Municipal Code, which states: Revocation of Permit. A. GROUND FOR REVOCATION. Any permit heretofore granted for any structure or work in the waters of Newport Harbor or the Pacific Ocean may be revoked by the City Council upon any of the following grounds: Section 3.
