Planning Commissioners are citizens of Newport Beach who volunteer to serve on the Planning
Commission. They were appointed by the City Council by majority vote for 4 -year terms. At the
table in front are City staff members who are here to advise the Commission during the meeting.

NOTICE TO THE PUBLIC
Regular meetings of the Planning Commission are held on the Thursdays preceding second and fourth
Tuesdays of each month at 6:30 p.m. Staff reports or other written documentation have been prepared
for each item of business listed on the agenda. If you have any questions or require copies of any of the
staff reports or other documentation please contact the Planning Department staff at (949) 644 -3200.
The agendas, minutes and staff reports are also available on the City's web site. The address is:
http://www.city.newport-beach.ca.us/.
It is the intention of the City of Newport Beach to comply with the Americans With Disabilities Act (ADA)

APPEAL PERIOD: Use Permit, Variance, Site Plan Review, Resubdivision, and Modification
applications do not become effective until 14 days after the date of approval, during which time an
appeal may be filed with the City Council. General Plan and Zoning Amendments are automatically
forwarded to the City Council for final action.
If in the future, you wish to challenge in court any of the matters on this agenda for which a public
hearing is to be conducted, you may be limited to raising only those issues which you (or someone else)
raised orally at the public hearing or in written correspondence received by the City at or before the
hearing.

All matters) listed under CONSENT CALENDAR (Item 1 and 1 B) is considered by the Commission to be
routine and will all be enacted by one motion in the form listed below. The Planning Commission Members
have received detailed staff reports on each of the items recommending an action. There will be no
separate discussion of these items prior to the time the Commission votes on the motion unless members
of the Commission, staff or the public request specific items to be discussed and/or removed from the
Consent Calendar for separate action.
Members of the public who wish to discuss a Consent Calendar item should come forward to the lectern
upon invitation by the Chairman, state their name and Consent Calendar Item number.
ITEM NO. 1.
SUBJECT: Minutes of the adjourned and regular meeting of June 3, 2003.
ACTION: Approve as written and order filed.
HEARING ITEMS:
ITEM NO. 2.
SUBJECT Group Homes in Residential Zones (PA2004 -102)
SUMMARY: The proposed amendment will establish new definitions applicable to group homes
and amends where and how group homes may locate and operate within
residential zones.
ACTION: Conduct the public hearing and recommend approval of Code Amendment No.
2004 -005 to the City Council.

ITEM NO. 3.
SUBJECT: Carty Residence (PA 2004 -079)
1306/1308 South Bay Front
SUMMARY: An appeal of the Modifications Committee's denial of a request for approval of a
Modification Permit to allow the addition of an elevator that will reduce the depth of
the existing carport parking space. The proposal includes a request to allow the
carport parking space to encroach 4 feet into the required 5 -foot rear yard setback
at the alley.
ACTION: Conduct a public hearing and uphold the decision of the Modification Committee to
deny Modification Permit No. 2004 -028.
ITEM NO. 4.
SUBJECT Bahia Corinthian Yacht Club (PA2004 -002)
1601 Bayside Drive
SUMMARY: An amendment to Use Permit No. 1437, to allow the reduction of required on -site
parking from 122 to 95 spaces and to increase the dry storage boat capacity from
100 to 200 boats. The request requires consideration of a parking waiver per
Section 20.66.100 of the Municipal Code.
ACTION: Conduct a public hearing, and deny Use Permit No. 2004 -001 by adopting the draft
resolution attached to the staff report.
ITEM NO. 5.
SUBJECT: Mariner's Mile Landscape Amendment (PA2004 -104)
Commercially designated properties fronting on Coast Highway between
MacArthur Boulevard and the Bay Bridge
SUMMARY: An amendment to Chapter 20.42 (Mariner's Mile Specific Area Plan) related to
landscape requirements.
ACTION: Conduct a public hearing and recommend approval of Code Amendment 2004-
006 to the City Council by adopting the draft Resolution attached to the staff
report.
ITEM NO. 6.
SUBJECT: St. Andrews Presbyterian Church Expansion (PA2002 -265)
600 St. Andrews Road
SUMMARY: Request for a General Plan Amendment, Zone Change and Use Permit for the
replacement and construction of additional buildings and a below grade parking
garage. The General Plan Amendment involves an increase the maximum
allowable building area with no change to the existing land use designation. The
Zone Change would change the zoning district from R -2 & R -1 to GEIF to be
consistent with the existing General Plan, Land Use Element designation. The Use
Permit involves the alteration of existing buildings, replacement of the existing
fellowship hall and classroom building and the construction of a new multi - purpose
gymnasium and youth center. The Use Permit also considers setting the
maximum allowable building height of 40 feet for the two proposed buildings.
ACTION: Conduct a public hearing and continue this item to July 22, 2004.

SUBJECT: Planning Commission Agenda —June 17, 2004
Report of the actions of the Planning Commission Meeting:
Item 1: The minutes of June 3, 2004 were approved as amended. (5 Ayes, 2
Excused)
• Item 2: The Group Homes in Residential Zones (PA2004 -102) Code Amendment
was recommended to the City Council for approval. (4 Ayes, 1 No, 2
Excused)
While the majority of the Planning Commission felt that the proposed
Code amendment represent what was in the limits of the City's discretion
to implement, concerns were still expressed about the preemption of City
decision making for uses which have the characteristics of commercial
land uses. In making its recommendation for approval, the Commission
asked that further analysis be conducted on the terms of the proposed
"campus" definition, including the magnitude of the geographic size of a
campus.
Item 3: Carty Residence (PA2004 -079) regarding appeal of the decision of the
Modification Committee to deny Modification Permit No. 2004 -028, the
decision of the Modification Committee was upheld. (4 Ayes, 1 No, 2
Excused)
The requested Modification was a 4 foot, 6 inch encroachment into the
required 5 foot alley setback for a required parking space, to allow for the
installation of an elevator to the second floor unit of a duplex. Discussion
focused on the constricted alley widths and tight turning radii in the alleys

safe vehicle passage in these areas. After taking testimony the Planning
Commission voted to sustain the action of the Modification Committee.

Item 4: Bahia Corinthian Yacht Club (PA2004 -002) regarding an amendment to
Use Permit No. 1437 was continued to July 22, 2004. (5 Ayes, 2
Excused)
This Use Permit amendment was filed to authorize the existing site plan of
the yacht club which was being operated in violation of the existing permit
because the number of on -site parking spaces had been reduced to install
additional dinghy storage, and control gates had been install without
approval or permits. Because staff had recommended denial of the
application, the applicant had requested a continuance to provide addition
information by conducting a parking study and management plan.
However, there were several neighbors in attendance who testified to the
problems being created by the existing operation of the yacht club. With
the agreement to make modifications to the operation of the parking lot in
the interim, the item was continued to July 22, 2004.
Item 5: Mariner's Mile Landscape Amendment (PA2004 -104) regarding an
amendment to Chapter 20.42 (Mariner's Mile Specific Area Plan) related
to landscape requirements was recommended for approval to the City
Council. (5 Ayes, 2 Excused)
This amendment is a proposal to make adjustment to the landscaping
requirement in the Mariners Mile area. Suggested revisions were to
increase the spacing requirements for the specified palm trees, and to •
increase the number of species allowed for the hedge treatment at the
back of sidewalk. The item was approved and sent to the City Council
without comment.
Item 6: St. Andrews Presbyterian Church Expansion (PA2002 -265) request for
General Plan Amendment, Zone Change and Use Permit was continued to
July 22, 2004. (5 Ayes, 2 Excused)
