SUBJECT: LEGAL ADVERTISING BID FOR FISCAL YEAR 2004 -2005
RECOMMENDATION:
Accept the bid of the Daily Pilot and authorize a purchase order for the one -year period
of fiscal year 2004 -2005.
DISCUSSION:
Background:
Publication of the City's legal notices in a newspaper of general circulation is required
by law. During the last fourteen fiscal years the Daily Pilot has performed this function
for the City.
Notices inviting bids for a one -year period were sent to the Daily Pilot, the Orange
County Register/The Current, Newport News, and the Los Angeles Times. The
deadline for submitting bids was 4:00 p.m. on Friday, June 11, 2004. Bids were
received from the Daily Pilot, The Orange County Register and The Current. The
breakdown of the three bids submitted is as follows:

Based on their daily publication schedule and local circulation, I am recommending that
the contract be awarded to the Daily Pilot. Using a newspaper that publishes daily
allows the City more flexibility in meeting legal noticing requirements. In general, most
of the City's public hearing notices require publishing ten (10) days prior to the hearing
date, and oftentimes relatively short notice is provided about the need to advertise. If
timing permits, we try to publish most of our legal notices on Saturday to take
advantage of the highest circulation possible.
The Daily Pilot will continue to abide by all agreements previously made as far as
complimentary copies, pick -up service for all advertising needs, accepting emergency
copy insertions to meet legal requirements, and publishing the Council agenda
summary at no charge.
Environmental Review: Not applicable.
Public Notice:
The Notice Inviting Bids was published in The Daily Pilot on Saturday, May 29, 2004
and Saturday, June 5, 2004. The Notice was also posted on the public bulletin board at
City Hall on Wednesday, May 26, 2004.

SUBJECT: LEGAL PUBLICATIONS FOR ONE -YEAR CONTRACT COVERING
FISCAL YEAR JULY 1, 2004 TO JUNE 30, 2005
RECOMMENDATION:
Authorize the City Clerk to publish a notice advertising for bids to be received on or
before the hour of 4:00 p.m., on Friday, June 11, 2004 for a one -year contract covering
the publishing and printing of legal notices, or other material required to be published
and circulated in the City of Newport Beach.
DISCUSSION:
Background:
Pursuant to Section 419 of the City Charter, it is required that the City Council, prior to
the beginning of each fiscal year, publish a notice inviting bids and contract for the
publication of all legal notices or other matter required to be published in a newspaper
of general circulation in said City.
Copies of the "Notice Inviting Bids" will be mailed to all newspapers of general
circulation published and circulated in the City of Newport Beach.
The current contract that expires on June 30, 2004 is with The Daily Pilot. In 2003 they
were awarded a one -year contract at the following rate:

After receiving and reviewing the bids, the City Clerk will make a recommendation to
award the contract at the Council meeting of June 22, 2004.

NOTICE INVITING LEGAL ADVERTISING BIDS
NOTICE INVITING BIDS to be received on, or before the hour of 4:00 p.m. on
Friday, June 11, 2004, for a one -year contract covering the publishing and printing
of legal notices, or other material required to be published in a newspaper of general
circulation published and circulated in the City of Newport Beach for Fiscal Year
2004 -05 (July 1, 2004 - June 30, 2005). Bidders are required to submit a copy of
their latest verified (audited) circulation figures from the auditing firm as part of
their bid. Documentation must be from auditing firm.
