SUBJECT: Initiation of Code Amendment to Provide for Limited Duration Use
Permits for Certain Uses
ISSUE:
Should the City Council direct staff to prepare an amendment to the Zoning Code that
would provide for use permits of limited duration for certain uses, such as vehicle rental,
restaurants and bars?
RECOMMENDATION:
Adopt a Resolution Initiating an Amendment to the Zoning Code to Provide for Limited
Duration Use Permits for Certain Uses.
DISCUSSION:
Council Member Daigle requested the initiation of a code amendment regarding the
regulation of vehicle rental uses in the Campus Tract adjacent to John Wayne Airport.
This area has been the subject of City studies for several years, and is one of the
special study areas in the General Plan update. One of the outstanding land use
questions is whether the area should provide for airport support uses, or be encouraged
to develop with uses that might be more productive for the City and the property
owners. Until this question is resolved, vehicle rental may be an acceptable use.
Traffic generation is not high, and some operations generate local sales tax through off -
airport rentals and sales of used vehicles. Because the investment in site
improvements for these uses is relatively low, it may be appropriate to allow these uses
for a limited duration while long -range plans are developed.
In discussing this issue with Council Member Daigle, staff also realized that limited
duration use permits may assist the City in dealing with other uses, such as restaurants
and bars. The City has had some experience with these uses changing their character

of operations over time, and turning into a different type of use than the Planning
Commission originally approved. Our recourse now is to have the Commission review
the operation and add conditions of approval to address new issues or, in extreme
cases, consider rescinding the use permit. These are cumbersome, and not always
effective, processes; staff would like the opportunity to explore whether limited duration
use permits would be more effective for these types of uses.

RESOLUTION NO. 2005-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH INITIATING AN AMENDMENT TO THE ZONING CODE TO PROVIDE
FOR LIMITED DURATION USE PERMITS FOR CERTAIN USES (PA 2005 -006)
WHEREAS, Title 20 of the Newport Beach Municipal Code authorizes the
City Council to adopt a Resolution initiating amendments to the Zoning Code;
and
WHEREAS, the City Council is concerned that certain uses may not be
appropriate for an extended period of time in areas identified for special study in
the update of the General Plan, now underway, and that certain uses may
require additional regulation to control changes in operation overtime; and
WHEREAS, the City Council wishes to consider an amendment that would
provide limited duration use permits for certain uses, such as vehicle rental,
restaurants and bars;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Newport Beach hereby initiates an amendment to Title 20 of the Newport
Beach Municipal Code to provide for limited duration use permits for certain
uses.
This Resolution was adopted at a regular meeting of the City Council of the City
of Newport Beach held on January 11, 2005, by the following vote, to wit:
