SUBJECT: APPROVAL OF FILM FESTIVAL BANNERS — ENCROACHMENT
PERMIT N2005 -0098
RECOMMENDATION:
Conditionally approve the request of Exterior Products, Inc. for the installation of eighty
(80) banners, from April 1, 2005 to April 30, 2005, for the annual Newport Beach Film
Festival. Installation will be along Newport Center Drive East/West.
DISCUSSION:
Exterior Products, Inc. representing Newport Beach Film Festival, Inc. has requested
that eighty (80) banners be installed from April 1, 2005 to April 30, 2005 along Newport
Center Drive East/West for the annual Newport Beach Film Festival. There will be two
(2) banners to be mounted on each of the forty (40) median street light poles within the
public right -of -way along Newport Center Drive East/West. See attached Exhibits.
During the period of April 22, 2005 through April 30, 2005, Newport Beach Film
Festival, Inc. will host the annual Newport Beach Film Festival — an entertainment
celebration highlighting the screening /viewing of many films /movies in Newport Beach.
The Newport Beach Film Festival, Inc. reports that approximately 2,500 people daily will
attend the Newport Beach Film Festival. Attendees pay a $10.00 to $80.00 admission
charge to attend Theater screening of various films and movies.
The Orange County Register and Coast Magazine are commercial sponsors of the
event and the banner design includes their name on the top and bottom of the banner,
respectively. The event is co- sponsored by the City of Newport Beach but it is not free
to the public. Council Policy L -16 prohibits the use of a commercial sponsor's name on
the banner and it specifies that banners can be authorized for events that are free to
the public.

The applicant's request to install eighty (80) private banners will not comply with the
single banner per pole concept allowed per City Council Policy L -16. In the past, a
similar request was approved by City Council on August 10, 2004 for the annual "Taste
of Newport" event and there have been no reported public complaints or problems.
Should the City Council elect to approve the installation of eighty (80) private banners
along Newport Center Drive East/West for 30 days, staff recommends the following
conditions of approval:
1. No banners shall be installed on traffic signal poles
2. The locations shall be limited to the center median and two (2) banners will be
installed per each pole.
3. The applicant must provide on -going maintenance of the banners and brackets.
4. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the
banners /brackets and indemnification and hold harmless for any liability associated
with the banners /brackets.
5. The applicant must maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better, and a financial
size category of "VIII" or higher.
6. Issuance of an Encroachment Permit by the Public Works Department
(Encroachment Permit No N2005- 0098).
7. The banners shall conform to City Council Policy L -16 with the exception of the
number of banners, open to the public free of charge, and co- sponsor by the City.
8. All banners and brackets shall be removed by the end of the approved time unless
otherwise approved by the conditions stated in the Encroachment Permit.
9. All banners and brackets shall comply with the Encroachment Permit conditions.
10. If needed, the City may require removal of some of the banners to allow other
organizations to install banners at the same location and during the same time
period.
11. A minimum of two 5 -inch wide half - circle wind slits per banner are required to
minimize the wind load.
Environmental Review:
Staff determined that the project is exempt from the California Environmental Quality
Act (CEQA) pursuant to Section 15301 of the Guidelines. This exemption covers the
minor alteration of existing public facilities with negligible or no expansion of the
facilities in areas that are not environmentally sensitive.

Funding Availability:
No City funds will be required. The applicant will pay all costs associated with the
installation and removal of the banners.
