Box 1224 Newport Beach, CA 92663 Subject: Dock Reconstruction at 68 Balboa Coves Gentlemen: As you are aware, the City of Newport Beach has a proposed project to widen the westerly side of the Newport Boulevard bridge crossing over the Newport Channel. The widening will reduce the maneuvering room for boats using the alternate "north channel" beneath the bridge in relation to the existing dock for 68 Balboa Coves owned by Father William Barry. To mitigate the impact to boat maneuverability, the City staff contacted the owners of both 67 and 68 Balboa Coves and proposed to reconstruct the two existing docks attached to the respective properties. Several configurations of dock reconstruction were considered over a period of approximately 15 months. A configuration combining reduction in dock lengths and shifting both docks in a westerly direction was agreed upon by the City and the two lot owners. Also, that configuration was submitted to the Coastal Commission and was determined to be acceptable. At that point, the owner of the property at 66 Balboa Coves expressed opposition to the proposed intrusion of the relocated dock for 67 Balboa Coves into his view corridor. Further discussions and compromises resulted in a configuration that leaves the dock for 67 Balboa Coves unchanged but gives use of the space between docks to 68 Balboa Coves and involves complete reconstruction of the dock and ramp for 68 Balboa Coves along with extension of an existing deck area. The dock reconstruction that appears to be acceptable to all three property owners (66, 67 and 68 Balboa Coves) is depicted on the attached plan. Note that the plan also indicates the southerly extension of the boundary wall and the new deck area so as to provide greater security and privacy to the deck and patio area of the house at 68 Balboa Coves. The City hereby requests architectural review and approval. of the dock reconstruction, deck extensions, and boundary wall work proposed for 68 Balboa Coves. The cost of these improvements will be borne by the City as part of the overall project cost. The construction 3300 Newport Boulevard, Newport Beach Balboa Coves Community Association February 11, 1997 Page Two work is anticipated to be performed for the City by a private contractor, Swift Slip. The contractor will also be responsible for preparing the detailed structural plans from which the construction will be accomplished. The materials to be used for the new dock and ramp will be wood and lightweight concrete which are standard throughout the harbor. The deck extensions will be similar to and will match the existing deck which is wood frame with a tile covered deck surface and is supported by precast, reinforced concrete piles. The City will issue a new permit for the dock reconstruction at 68 Balboa Coves and will issue an amendment to the existing dock permit for 67 Balboa Coves covering the use of the space between the docks in favor of 68 Balboa Coves. The acknowledgement of 67 Balboa Coves for this use restriction is set forth in a letter dated December 27, 1996, a copy of which is enclosed. The revised dock, deck and wall improvements as shown on the enclosed plan will be submitted to the Coastal Commission for further review and is subject to their concurrence. Till Subject: Newport Channel Bridge Widening Public Notice 11-105 Reference: Ms. Jean Ann Lowry letter dated April 7, 1997 Dear Mr. Till: Ms. Lowry's letter expressed her opinion that the proposed widening of the Newport Channel bridge along its westerly side will cause a dangerous situation affecting the safety of boaters passing beneath the widened bridge. Her concerns appear to be a continuation of her opposition to widening of the bridge along its easterly side approximately seven years ago. No specific or statistical information was available in 1990 regarding the safety concerns expressed relative to the width and height clearances associated with the existing bridge. The number of accidents or mishaps over a period of time, the nature of personal injuries suffered, or the cost of property damages sustained were not able to be identified or established. Despite the lack of specific information related to safety issues, the 1990-1991 widening project was required to include (a) fendering of the columns along each side of the navigable waterway (the center channel), (b) installation of navigation lighting meeting current standards, and (c) installation of rubber soffitts (tell -tales) indicating to boaters that the vertical clearances varied as the vessel passed beneath the bridge. These improvements, along with the depth markers, constitute the navigational safety system for the Newport Channel bridge and the City believes the system is satisfactory and appropriate for this location. Establishment of a procedure for maintenance of the system is described in our response to Mr. Roy Van Orden's letter. 3300 Newport Boulevard, Newport Beach Coast Guard May 5, 1997 Page Two Subsequent to the public meeting held on March 25, 1997, the City staff and consultants reviewed again all the previous reports and written information relative to widening the Channel Bridge. A special effort was made to establish if any new information or different circumstances now existed than when the easterly side widening was done in 1991. As part of such effort, we consulted with Mr. Tony Melum, Deputy Chief in the City's Fire and Marine Department, who serves as the tidelands administrator for bulkheads, piers, and docks within the harbor. We also consulted with Captain Dave Mann, the Harbor Master, and his staff from the County of Orange Sheriff's department, and the Risk Managers for the County of Orange and the City of Newport Beach. None of these officials were aware of any new or significant reasons supporting a contention that widening the bridge along its westerly side will decrease boater safety or create dangerous conditions. There are no reported accidents related to the added length of the passage under the bridge. If the Coast Guard believes the addition of fendering attached to the bridge support columns forming one side of the unofficial alternate (northerly) channel is appropriate, the City will include such improvements as part of the bridge widening work covered by the current permit application. Also, we are unaware of any evidence to substantiate a reduction in safety related to an "increased venturi or wind tunnel effect" resulting from the past or proposed bridge widening. Boaters do need to exercise skill and care in navigating vessels beneath the bridge and they do need to be cognizant of tidal and wind conditions when making their passage. Till Subj: Newport Channel Bridge Widening Public Notice 11-106 Reference: Mr. Gary Shepherd letter dated April 11, 1997 Mr. Shepherd's comments contained in his letter raise a very important concern about the vertical navigation clearance at the site. This issue is very important to the City of Newport Beach. in its design for the widening of the west side of the Newport Channel Bridge. The bridge widening design maintains the existing vertical clearances in the main (center span) channel as well as the north span over the alternate unmarked channel. The project construction has no impact on water depth. As Mr. Shepherd stated in his letter, the difference in vertical clearance between the north span and center span is incorrectly stated as one foot. The actual difference in elevation is 1.8 feet greater vertical clearance under the north span. In order to maintain navigability through the north span, the City of Newport Beach has a separdte project to modify the floating dock arrangement west of the bridge on the north side of the channel. A copy of the conceptual layout plan for the dock reconfiguration is attached for your information. The construction of this project will be completed prior to widening of the Newport Channel Bridge. Till Subj: Newport Channel Bridge Widening Public Notice 11-106 Reference: Mr. Roy VQn Orden letter dated April 2, 1997 Mr. Vc1n Orden's letter raises several concerns that are important to consider in the widening of the Newport Channel Bridge. 1) Concern about the docks on the west side of the Newport Channel Bridge: With the widening of the Channel Bridge, the City of Newport Beach has developed a conceptual plan (see the attached exhibit) to reconfigure the floating dock on the west side of the Channel Bridge along the north edge. This reconfiguration will maintain navigability of the north channel. The conceptual plan was . developed with input from the County of Orange Harbor Patrol and Deputy Chief of the City of Newport Beach Fire and Marine Department. The new dock configuration is shown in the attached sketch. Construction to reconfigure the dock will be completed by a separate construction contract prior to widening of the Channel Bridge. 2) Question if vertical clearance tide signs will be posted at the east and west approaches to the bridge: Yes, vertical clearance signs will be posted on the main channel at the east and west approaches. The east approach will not be affected by construction for the west widening and the existing clearance sign will remain. On the west approach, a new vertical clearance sign will be mounted on new 3 -pile dolphins similar to the existing arrangement. Caltrans is responsible for maintaining the navigational aids on the bridge. In order to promote timely response for maintenance of the new aids, the City of Newport Beach is establishing a liaison program with Caltrans. The Deputy Chief in the Fire and Marine Department for the City of Newport Beach has been designated as the City's liaison with Caltrans for maintenance of the bridge navigation aids within the City of Newport Beach. The Caltrans contact will be the District 3300 Newport Boulevard, Newport Beach 2 May 5, 1997 Page 2 12 Deputy Director for Maintenance. The City's Deputy Chief is also the designated tidelands administrator and regularly makes inspections along the channels and waterways of .Newport Bay. In addition, flyers will be prepared and distributed to boaters that advise them of a telephone number at the City to report problems with the bridge navigation aids. This information will be forwarded via the liaison system to Caltrans for action. 3) Statement suggesting channel fenders similar to those in the main channel could be added to the north channel: The City of Newport Beach is willing to fund the construction of fendering on the piling along the north channel. After discussing this with the Harbor Patrol and Fire Boat crews they are in agreement that this may be a benefit to navigation. 4) Statement that the navigation lights should not project into the posted vertical clearance: Agree, the detail for remounting the navigation lights on the west widening will be similar to the east side. This configuration was developed during the 1991 east side widening. The navigation lights are held slightly above the tell-tale soffit to keep the lights out of the channel clearance envelope. Subsequent to our discussion last week, I added three items to the plan: 1. A 20' x 10' deck area extending easterly of your existing deck. 2. A note indicating that the maximum length vessel that can be "site -tied" to the new dock in an alignment parallel to the navigational channel is 18 feet. 3. A note indicating that the 8 -foot wide space between the new dock for Lot 68 and the existing dock for Lot 67 shall be for the primary use of the Lot 68 dock owner. Please review the plan to determine that it reflects the key conceptual issues that we have discussed. Clearly, Dr. Vaziri should have no objection to this plan; but the restriction to Lot 67 of the usage of the space between the two docks needs to be explained to the McLaughlin children and their acquiescence to the restriction should be obtained. The City's harbor permit administrator, Tony Melum, indicates that the permit for the new Lot 68 dock can include such restrictions and that the permit for the existing Lot 67 dock can be modified to include such limitation. (b) That the structure or work authorized herein shall be in accordance with the plans and drawings attached hereto and construction shall be subject to the supervision and approval of the District Engineer, Corps of Engineers, in cbarge of the District in which the work is to be performed. (c) That the District Engineer may at any time make such inspections as he may deem necessary to assure that the construction or work is performed in accordance with the conditions of this permit and all expenses thereof shall be borne by the permittee. (d) That the permittee shall comply promptly with any lawful regulations, conditions, or instructions affecting the structure or work authorized herein if and when issued by the Environmental Protection Agency and/or the State water pollution control agency having jurisdiction to abate or prevent water pollution, including thermal or radiation pollution. Such regulations, conditions or instructions in effect or hereafter prescribed by the Environ- mental Protection Agency and/or the State agency are hereby made a condition of this permit. (e) That the permittee will maintain the work authorized herein in good condition in accordance with the approved plans. (f) That this permit may, prior to the completion of the structure or work authorized herein, be suspended by authority of the Secretary of the Army if it is determined that suspension is in the public interest.* (g) That this permit may at any time be modified by authority of the Secretary of the Army if it is determined that, under existing circumstances, modification is in the public interest.* The permittee, upon receipt of a notice of modification, shall comply therewith as directed by the Secretary of the Army or his authorized representative. (h) That this permit may be revoked by authority of the Secretary of the Army if the permittee fails to comply with any of its provisions or if the Secretary determines that, under the existing circumstances, such action is required in the public interest.* (i) That any modification, suspension or revocation.of this permitshall, not be the basis for a claim for damages against the United States. (j) That the United States shall in no way be liable for any damage to any structure or work authorized herein which may be caused by or result from future operations undertaken by the Government in the public interest. (k) That no attempt shall be made by the permittee to forbid the full and free use by the public of all navigable waters at or adjacent to the structure or work authorized by this permit. (1) That if the display of lights and signals on any structure or work authorized herein is not otherwise provided for by law, such lights and signals as may be prescribed by the United States Coast Guard shall be installed and maintained by and at the expense of the permittee. (m) That the permittee shall notify the District Engineer at what time the construction or work will be commenced, as far in advance of the time of commencement as the District Engineer may specify, and of its completion. (n) That if the structure or work herein authorized is not completed on or before the 319t day of December 1976, this permit, if not previously revoked or specifically extended, shall cease and be null'and void. (o) That the legal requirements of all Federal agencies be met. (p) That this permit does not authorize or approve the construction of particular structures, the authorization or approval of which may require action by the Congress or other agencies of the Federal Government. (q) That all the provisions of this permit shall be binding on any assignee or successor in the interest of the permittee. (r) That if the recording of this permit is possible under applicable State or local law, the permittee shall take such action as may be necessary to record this permit with the Registrar of Deeds or other appropriate official charged with the responsibility for maintaining records of title to and interests in real property. (s) That the permittee agree to make every reasonable effort to prosecute the construction or work authorized herein in a manner so as to minimize any adverse impact of the construction or work on fish, wildlife, and natural environmental values.
