Discussion This application is being brought to the Council in conformance with Section 5C3 which states: "C. The applicant wishes to extend the fingers of the existing slips to provide additional guest mooring spaces for patrons of the upland business Woody's Wharf Restaurant. Condition b) is suggested to insure compliance with Section 21A which reads: "Boats moored at private or public docks shall not extend beyond the projection of the property lines of the property to which the dock facility is connected......" Payne to install 4 reinforced concrete seawall baywar,4 of 2320 W. Newport Boulevard, Lot 8 and a portion of Lot 7, Block 223$, Section A, Newport Beach. This property is leased by Mr. Payne and is ad- jacent northerly to the Woody's Wharf restaurant owned by Mr. Payne. I talked to John Trautwein and Ray Hermes of Trautwein Brothers on at least two separate occasions, advising this that if Mr. Payne eventually desired to install floats that it would be more convenient for all concerned to include the floats on the application under consideration. In that way, if floats were desired, it would not be necessary to process another application through the City Council. The floats mere not added, to the application. The permit for the seawall only was approved by the City Council on April 24, 19670 and the permit was issued by the City Engineer several days later, the exact date being unknown at this time. On July 77, 1967, Woodrow W. Payne submitted an appli* cation for a ravislon to Harbor Permit Application No, A-1492 to install 35' x 43' addition to an existing slip. The drawing attached to the application shows the proposed addition to be located in front of 2320 W. Newport Blvd., Lot 8 and a portion of Lot 7, Block 223. Page 268 CITY ATTORNEY DEPARTMENT November 69 1967 To.- The Honorable Mayor and Members of the City Council Prom.- City Attorney Subject.- Investigation of the installation of a float at Woody°s Wharf prior to the issuance of a permit In accordance with the instructions of the City Council, we have reviewed the circumstances surrounding the installation of a float by Trautwein Brothers adjacent to Woody°s Wharf restaurant prior to the issuance of a City harbor permit for the installation of same. The restaurant is located at 2318 Newport Boulevard. On October 30th a hearing was held at the City Attorneyvs office to determine whether a criminal complaint should be filed against the persons responsible for the construction of the float. Present at ,the hearing were Paul Trautwein, John Trautwein, Ray Hermes of Trautwein Brothers, and their attorney, Robert Hurwitz, together with representatives from the Public.Works Department and the City Attorneys office. As a result of the discussion that took place, it appears that (1) there is no question that the violation occurred, (2).the prob- able cause of the violation was a failure of communication between Trautwein Brothers and their client, Mr Woodrow Payne, in that the employees of 'Trautwein Brothers responsible for installing the float were under the impression that the permit had been obtained by Mr. Payne at the time they installed the float, and (3) the management of Trautwein Brothers is familiar with the City's rules and regulations relating to harbor permits and normally attempts to comply with them, The Trautwein representatives were apologetic and indicated a will- ingness to cooperate with the Public Works Department in order to avoid this type of mistake in the future. In order to avoid anise understandings, it is agreed that, in cases where a property owner applies for a permit to install a structure in the harbor for which Trautwein Brothers has been retained to do the work, he will be in- structed to request that the permit be mailed directly to Trautwein Brothers. It was also agreed that Trautwein Brothers will not com- mence any°work on harbor installations without first having ob- tained a copy of a valid City permit, As a result of the discussion with the representatives of Trautwein Brothers, we believe that the type of situation criticized by the City Council will be avoided in the future.
